`Presently before the Court is Plaintiff Invensys Systems, Inc.’s Opposed Motion
`
`to Amend Docket Control Order, (Dkt. Nos. 182, 194), which seeks to modify the expert and
`
`dispositive motion deadlines in the Fourth Amended Docket Control Order, (Dkt. No. 103).
`
`Since the filing of Invensys’s Motion, the parties have met and conferred, and Defendants Micro
`
`Motion, Inc. and Emerson Electric Co. have agreed to withdraw their Opposition to the Motion,
`
`(Dkt. Nos. 188, 198). With Invensys’s Motion now moot, the parties agree and stipulate, subject
`

`to the Court’s approval, on an extension of various deadlines related to experts and dispositive
`
`motions, as follows:

`Response to Dispositive Motions (including Daubert
`motions) due. Responses to dispositive motions filed prior to

`granted in exceptional circumstances.

`deadline. However, except as provided in Patent Rule 3-6, if
`the amendment would effect infringement contentions or
`invalidity contentions, a motion must be made pursuant to
`Patent Rule 3-6 irrespective of whether the amendment is
`made prior to this deadline.
`Deadline to File Letter Briefs for Summary Judgment
`Motions and Daubert Motions. See the Court’s website for
`further information.
`Expert Discovery Deadline.
`Parties designate rebuttal expert witnesses (non-construction
`issues), Rebuttal expert witness reports due. Refer to Local

`The amendments and proposed extension neither affect any other case deadlines nor are they

`sought for the purposes of delay.
`
`The parties respectfully request that the Court enter the proposed Fifth Amended
`
`Docket Control Order, attached as Exhibit A. In addition, as there is no longer a dispute about
`
`the schedule, the requested interim relief that the Court granted with respect to expert discovery
`
`is unnecessary. Thus, the parties also respectfully request the Court vacate its Order Granting
`
`Joint Motion for Interim Relief of Expert Discovery Deadlines, (Dkt. No. 200).
