`
`Plaintiff Invensys Systems, Inc. (“Invensys”) requests that the Court order expedited
`
`briefing on Invensys’s Motion to Compel and for Sanctions, which was filed today. Invensys’s
`
`motion to compel seeks important documents, including sales information on all of the accused
`
`products and emails, that Defendants have refused to produce. Discovery in this case closes on
`
`July 16, 2014. See 4th Am. Docket Control Order at 3, ECF No. 103. In addition, the parties
`
`have scheduled numerous depositions over the next few weeks. Delaying resolution of
`
`Invensys’s motion to compel until after the close of discovery could interfere with the orderly
`
`completion of fact discovery. Invensys has only recently become aware of the extent of
`
`Defendants’ discovery abuses and had assumed (incorrectly) that Defendants would rectify some
`
`of these deficiencies, as promised, which they have not. Recent depositions of Defendants’
`
`witnesses have confirmed these deficiencies.
`
`Invensys proposes the following expedited briefing schedule:
`
`
`Date
`July 3, 2014 (Thursday)
`July 8, 2014 (Tuesday)
`July 11, 2014 (Friday)
`
`Event
`Defendants’ Response
`Invensys’s Reply
`Defendants’ Sur-reply
`
`For the foregoing reasons, Invensys respectfully requests that the Court order briefing on
`
`Invensys’s Motion to Compel and for Sanctions to be completed on the expedited schedule set
`
`forth above.
