`INTER PARTES REVIEW ON SOME, BUT NOT ALL, ASSERTED CLAIMS

`Defendants’ assertion that the Patent Trial and Appeal Board (“PTAB”) “instituted inter
`
`
`
`
`
`partes reviews of U.S. Patent Nos. 7,124,646, 7,136,761, 6,311,136, and 7,505,854” (Dkt.
`
`No. 160), does not accurately reflect the status of the IPR reviews. The PTAB declined to
`
`review asserted claims 24, 25, and 26 of the ’136 patent. It is undisputed that the PTAB has yet
`
`to even accept the IPR petitions for U.S. Patent Nos. 8,000,906, 6,754,594, and 7,571,062.

`Despite Defendants’ proclamation that the “PTAB is statutorily mandated to issue a final
`
`decision regarding the patents’ validity by June 2, 2015,” the PTAB’s disposition of the
`
`instituted claims could take another 18 months to complete (until December 2015), and will
`
`necessarily be limited to validity under §§ 102 and 103, and only on the basis of prior art
`
`
`

`consisting of “patents or printed publications.” 35 U.S.C. § 316(a)(11); 35 U.S.C. § 311(b). In
`
`any case, no decision of the PTAB on the instituted claims will be final until all appeals
`
`therefrom are exhausted. 35 U.S.C. § 141(c).
