`JOINT NOTICE OF PARTIES’ VERDICT FORM AND JURY INSTRUCTIONS

`Pursuant to the Court’s Amended Docket Control Order (Dkt. No. 545), Plaintiff Maxell,
`
`
`
`Ltd. (“Plaintiff” or “Maxell”) and Defendant Apple Inc. (“Defendant” or “Apple”) hereby submit
`
`to the Court their Verdict Form and Jury Instructions. Although the parties exchanged several
`
`rounds of the foregoing documents and held a meet and confer, they were not able to reach full
`
`agreement regarding the materials.
`
`
`
`The parties’ Verdict Form is attached hereto as Exhibit A. The parties’ Jury Instructions
`
`are attached hereto as Exhibit B. Each of the attached documents reflect the areas of agreement
`
`and, where there is disagreement, present the parties’ competing proposals. Maxell’s proposals are
`
`designated by blue highlighting and Apple’s proposals are designated by green highlighting. The
`
`parties intend to continue the meet and confer process, including a meet and confer scheduled for
`
`November 30, with respect to the form of the verdict and jury instructions prior to trial in hopes of
`
`being able to reach further agreement.
