`It is my opinion that Apple literally infringes claim 4 of the ’991 Patent.

`158. Claim 4 depends from claim 3, which depends from claim 2, which depends from
`
`claim 1. I will therefore discuss claims 1-4 below.

`159. Claim 1 is infringed by each of the Accused Products at least because each of
`
`them includes components that correspond to a communication apparatus for transmitting and
`
`receiving digital information from another communication apparatus, a network interface, a
`
`camera, a display, and a processor for making and receiving FaceTime calls with another
`
`communication apparatus. Evidence of the infringement is shown in my element-by-element
`
`analysis below:

`It is my opinion that each of the Accused Products is a “communication apparatus
`
`for transmitting and receiving digital information to and from another communication apparatus”

`as required by claim element [1.pre] of the ’991 Patent. For example, each of the Accused
`
`Products include the FaceTime application indicating that they can receive and transmit digital
`
`information to another communication apparatus.
`
`161. As noted above, the Court construed “communication apparatus” to be a
`
`“videophone function-added TV receiver.” In my opinion, the Accused ’991 Products
`
`correspond to a videophone function-added TV receiver.
`

`For example, the ’991 Patent discloses an embodiment in which a decoder is
`
`adapted to decode TV/VOD signals as well as videophone signals. The ’991 Patent discloses that
`

`buttons 7i in cross-like layout, “Enter” button 7j, sound volume adjustment

`Thus, the patent describes an embodiment where a user has the ability to select the VOD, or
`
`video on demand button 7c, which corresponds to, for example, a user accessing content from
`
`iTunes, Safari, and/or Apple TV on demand.
`

`The ’991 Patent further describes what happens when the VOD button is selected:
`
`When the “VOD” button 7 b (FIG. 4) of the remote control 7 is operated, the
`decoder 11 executes
`the VOD-use decode function under control of
`the
`processor 12; then, the HTML browser 13 is rendered operative, followed by
`setup of the VOD function mode.
`
`Then, the VOD contents from the VOD server 21 (FIG. 3) which are received at
`the network I/F 15 are such that moving-picture image contents and still image
`contents plus audio contents thereof are decoded by the decoder 11 and then
`supplied to the display panel 8 and speakers 3, resulting in visualization and
`reproduction of these contents. Text data in the VOD contents is supplied to
`the HTML browser 13 and converted into data displayable on the display
`screen 2 and then supplied to the display panel 8. It is noted that although not
`specifically depicted herein, the contents to be provided from the VOD
`server 21 are supplied to the decoder 11 and/or the HTML browser 13 for
`viewing/listening and playback at the user's desired time and also supplied to the
`display panel 8 and speakers 3 for enabling the contents to be reproduced thereby.
`
`Additionally, when the “VOD” button 7 b of the remote control 7 is depressed, a
`request signal is transmitted from the processor 12 to the VOD server 21 through
`the network I/F 15 and network 6. In responding thereto, data of titles of all
`contents available from the VOD server 21 are provided. The title data is passed
`to the HTML browser 13 through the network I/F 15 whereby a title list
`window image or “menu” is generated and supplied to the display panel 8.
`When the user's preferred contents are designated from this menu window by
`manual operations of the cross-like layout arrow buttons 7 i and “Enter”
`button 7 j, the processor 12 issues and sends a request of the contents to the VOD
`server 21 via the network I/F 15 and network 6. With this procedure, the VOD
`contents requested are provided from the VOD server 21 and are processed in the
`way stated supra so that the contents are displayed on the display screen 2 of
`display panel 8 while letting audio sounds thereof be output from the speakers 3.
`

`server via an HTML browser to retrieve content, which is decoded and then rendered on the
`
`display.

`Similar to this disclosed embodiment, the Accused Products can access a content
`
`server via, for example, an HTML browser (e.g., Safari), retrieve/process/decode the content and
`
`then render it on a display screen. Thus, the accused products correspond to a videophone
`
`function-added TV receiver as disclosed in the VOD model in the context of requesting and
`
`viewing digital content from a content server.
`
`165. Moreover, my interpretation of a videophone function-added TV receiver is also
`
`supported by the following definitions:
