Case 5:19-cv-00036-RWS Document 316 Filed 05/05/20 Page 1 of 4 PageID #: 10355
`
`
`IN THE UNITED STATES DISTRICT COURT
`FOR THE EASTERN DISTRICT OF TEXAS
`TEXARKANA DIVISION
`
`MAXELL, LTD.,
`
`
`
`v.
`
`APPLE INC.,
`
`Plaintiff,
`
`Defendant.
`
`Case No. 5:19-cv-0036-RWS
`
`
`JURY TRIAL DEMANDED
`
`
`
`
`
`JOINT REPORT REGARDING
`APPLE’S RENEWED MOTION TO COMPEL INFRINGEMENT CONTENTIONS
`COMPLIANT WITH PATENT RULE 3-1(G) (D.I. 284, 299, 306)
`
`
`On April 20, 2020, Apple filed a renewed motion to compel infringement contentions
`
`compliant with Patent Rule 3-1(g) and for schedule extension or, in the alternative, to preclude
`
`Maxell’s reliance on source code for infringement. D.I. 284. The Court granted an unopposed
`
`motion for expedited briefing. D.I. 287. Maxell filed its opposition on April 28. D.I. 299.
`
`Pursuant to this Court’s Order (D.I. 287), Apple filed its reply on May 1 (D.I. 306) and the parties
`
`met and conferred on May 4. The parties were unable to reach agreement and so the motion
`
`remains unresolved.1
`
`
`
`
`
`
`
`
`
`
`
`
`
`
`
`1 Maxell moved for leave to file a surreply on May 4.
