`Before the Court is the parties’ Joint Motion to modify the schedule for discovery and for
`
`briefing on Defendant Databricks, Inc.’s Motion to Transfer Venue to the Northern District of
`
`California pursuant to 28 U.S.C. § 1404(a) (Dkt. No. 39). Dkt. No. 44. Having considered the
`
`Motion, the Court is of the opinion that it should be and hereby is GRANTED.
`
`Therefore it is ORDERED that:
`
`The parties may conduct limited, expedited venue-related discovery, including service on
`
`the other party of no more than six (6) Interrogatories and no more than six (6) Requests for
`
`Production related to venue. Each party shall be limited to one 30(b)(6) deposition notice and each
`
`such 30(b)(6) deposition notice shall be limited to no more than ten (10) 30(b)(6) deposition topics
`
`on issues related to venue.1 Byteweavr shall also be permitted a deposition under Rule 30(b)(1) of
`
`Databricks’ declarant, Mr. Abhinav Taneja, which may be combined with Databricks’ 30(b)(6)
`
`deposition if Mr. Taneja is presented as the corporate witness on all noticed topics. The venue
`

`discovery period shall commence on the date of the parties’ submission of this motion (“Venue
`
`Discovery Start Date”).
`
`It is further ORDERED that the Motion’s briefing schedule is modified subject to the
`
`agreements set forth below.
`

`same day with the same witness.

`Byteweavr to file its Opposition brief to the
`Discovery Period.

`Databricks to file its Reply brief to the Motion Within 7 days of the filing of Byteweavr’s

`Within 7 days of the filing of Databricks’
`Reply brief

`Byteweavr to file its Sur-Reply brief to the
`Motion
`
`2 Should a party disclose a declaration in support of any brief related to the Motion following this
`deadline, the deposition of such declarant may occur on a separate day as the 30(b)(6) deposition.
`The parties agree that any 30(b)(1) Deposition Notice directed to such declarant is 14 days
`following disclosure of the declaration, and that they will accordingly agree to submit a request to
`modify the briefing schedule in this Order if necessary.
