`Before the Court is the Joint Motion to Take Deposition Out of Time (the “Motion”) filed
`
`by Plaintiff Touchstream Technologies, Inc. (“Plaintiff”) and Defendants Comcast Cable
`
`Communications, LLC, d/b/a Xfinity; Comcast Corporation; Comcast Cable Communications
`
`Management, LLC; and Comcast of Houston, LLC, (collectively “Comcast” and with Plaintiff,
`
`the “Parties”). (Dkt. No. 66.) In the Motion, the Parties state that fact discovery closes on June 11,
`
`2024. (Id. at 1.) However, Ms. Linda Yaccarino, a third-party witness, informed the Parties that
`
`she is no longer able to sit for a deposition scheduled to occur before the end of fact discovery.
`

`(Id.) The Parties therefore “request that the deadline to take Ms. Yaccarino’s deposition be
`
`extended up to and including June 28, 2024.” (Id.)
`
`Having considered the Motion, and noting its joint nature, the finds that it should be and
`
`hereby is GRANTED. Accordingly, the Court ORDERS that the deadline to take Ms. Yaccarino’s
`
`deposition is extended up to and including June 28, 2024.
`
