`The United States District Court for the Eastern District of Texas presents its compliments

`to the National Court Administration and requests international judicial assistance for the
`
`production of documents and source code from Samsung SDS Co., Ltd. as set forth in Schedule
`
`A attached.
`
`This request is made pursuant to the Hague Convention of 18 March 1970 on the Taking
`
`of Evidence Abroad in Civil or Commercial Matters, as adopted and implemented at 28 U.S.C.
`
`§ 1781 and the Evidence (Proceeding in Other Jurisdictions) Act 1975 c. 34. This Court, the United
`
`States District Court for the Eastern District of Texas, Marshall Division, is a competent court of
`
`law and equity which properly has jurisdiction over this proceeding and has the power to compel
`
`the attendance of witnesses and production of documents both within and outside its jurisdiction.
`
`The documents and information requested in Schedule A exist and Samsung SDS Co., Ltd. has or
`
`will likely have them in its possession, custody, or control.
`
`The documents requested from Samsung SDS Co., Ltd. are intended for use at trial and
`
`will be highly relevant to numerous claims and defenses in the case. Specifically, the documents
`
`sought herein will be relevant to Plaintiff AGIS Software Development LLC’s (“AGIS” or
`
`“Plaintiff”) claims of patent infringement (including its alleged damages) against Defendants
`
`Samsung Electronics Co., Ltd. and Samsung Electronics America, Inc. (collectively, “Samsung”
`
`or “Defendants”). This Court understands that the approach of the Korean courts may be more
`
`restrictive than that of this Court regarding requests for evidence from a third party, and on this
`
`basis is of the view that the information sought in this Letter of Request goes to the heart of
`
`significant issues of fact and law that will influence the final determination (at trial and/or by
`

`motion) of the existence, non-existence, and/or extent of any liability under Title 35 of the United

`This request is made with the understanding that it will in no way require any person to

`commit any offense, or to undergo a broader form of inquiry that he or she would if the litigation
`
`were conducted in Korea. In the proper exercise of its authority, this Court has determined that the
`
`documents described in Schedule A cannot be secured except by the intervention of the National
`
`Court Administration.

`Summary of defenses and counterclaims
`
`Defendants argue that they “does not infringe and has not infringed (not directly,
`
`contributorily, or by inducement), either literally or under the doctrine of equivalents, and is not
`
`liable for infringement of any valid and enforceable claim of the Patents-in-Suit” and “[t]he claims
`
`of the Patents-in-Suit are invalid and unenforceable under 35 U.S.C. § 101,” 102, 103, 112, 116 ,
`
`and obviousness-type double patenting. See Defendants’ Answer to Plaintiff’s Second Amended
`
`Complaint (attached hereto as Exhibit 3) at 12-13. Defendants also argue that Plaintiff’s claim for
`
`infringement is barred by the following affirmative defenses: substantial non-infringing uses,
`
`failure to state a claim, patent unenforceability due to unclean hands or inequitable conduct, patent
`
`misuse, lack of standing, equitable doctrines, prosecution history estoppel, ensnarement, 28 U.S.C.
`
`§ 1498, and unclean hands. Id. at 13-39. Defendants further contend that Plaintiff’s claim for relief
`
`is limited in whole or in part by its failure to comply with 35 U.S.C. §§ 286, 287, or 288. Id. at 13.

`Lastly, Defendants argue that Plaintiffs claim for equitable relief is barred (id. at 32), license or
`
`exhaustion (id. at 33), not an exceptional case (id.), and Plaintiff is not entitled to injunctive relief
`
`(id.).

`AGIS seeks documentary and source code evidence from Samsung SDS Co., Ltd. concerning the
`
`Samsung Knox Manage application. This information is relevant to the merits of AGIS’s claims.
`
`Specifically, AGIS has brought claims of direct and indirect patent infringement against
`
`Defendants. The documents and information sought herein will be highly relevant to the
`
`determination of whether AGIS’s patents have been infringed. In sum, the information sought in
`
`this Letter of Request goes to the heart of significant issues of fact and law that will, in large
`
`measure, determine the existence, non-existence, and/or extent of Defendants’ liability under the
`
`U.S. Patent Laws.

`“Document(s)” shall have the broadest meaning ascribed to it by Federal Rule of

`Civil Procedure 34 and Federal Rule of Evidence 1001, and shall include within its meaning any
`
`and all papers, videotapes or video recordings, photographs, films, recordings, memoranda, books,
`
`records, accounts, letters, correspondence, notes of meetings, notes of conversations, notes of
`
`telephone calls, inter-office memoranda or written communications of any nature, including email
`
`and chat logs, recordings of conversations either in writing or by means of any mechanical or
`
`electrical recording device, notes, papers, reports, analyses, invoices, canceled checks or check
`
`stubs, receipts, minutes of meetings, time sheets, diaries, desk calendars, ledgers, schedules,
`
`licenses, financial statements, bills, logs and any differing versions of the foregoing whether
`
`denominated formal, informal or otherwise, as well as copies of the foregoing which differ in any
`
`way, including handwritten notations or other written or printed matter of any nature, from the
`
`original. The foregoing specifically includes all forms of “electronically stored information,” as
`
`that term is used in Federal Rule of Civil Procedure 34, including electronic mail, except to the
`
`extent that an Order Regarding E-Discovery in Patent Cases is entered in This Action and requires
`
`that e-mail production requests be propounded separately from requests seeking electronically
`
`stored information. Moreover, the term “Document” shall also include all “technical documents,”
`
`such as source code, specifications, schematics, flow charts, artwork, drawings, pictures, pictorial
`
`representations, formulas, troubleshooting guides, service bulletins, technical bulletins, production
`
`specification sheets, white papers, operator manuals, operation manuals and instruction manuals.

`“Communication(s)” means, including its usual and customary meaning, any

`transmission, conveyance, or exchange of a word, statement, fact, thing, idea, document,

`“Thing(s)” refers to any physical specimen or tangible item, including research and

`development models, samples, prototypes, and the like.

`“Person(s)” refers to all natural persons and all types and kinds of business or other

`entities including, but not limited to, corporations, limited liability companies, partnerships, joint

`ventures, associations, sole proprietorships, government bodies and government agencies. Any

`reference to an individual person, either singularly or as part of a defined group, includes that
`
`person’s employees, agents, legal and non-legal representatives, heirs, successors, assigns and any
`
`other person or entity acting on the behalf of such individual person. Any reference to a corporation
`
`or any other entity also refers to and includes any and all parents, subsidiaries, predecessors,
`
`successors, affiliates, partners, joint venturers, agents, employees, representatives, accountants,
`
`investment bankers, consultants or attorneys acting on behalf of the corporation or other entity.

`The masculine includes the feminine and vice versa; the singular includes the plural and vice versa.

`“Infringe” or any variation thereof, including “infringing,” “infringement,” and

`“infringer,” refers to the commission of any act constituting infringement under the Patent Laws

`including, but not limited to, 35 U.S.C. § 271, and “infringement” means direct infringement,
`
`contributory infringement, infringement by inducement, literal infringement, and infringement by
`
`the doctrine of equivalents.

`“Prior Art” means the subject matter described in 35 U.S.C. §§ 102 and 103

`“Identify” means to state the following: (1) when referring to a person, the person’s

`identity of the documentary or testimonial support for that fact; (4) when referring to a product or

`singular or plural, are one and the same and no term is to be treated with distinction relative to the
