`Plaintiff AGIS Software Development LLC (“AGIS”) respectfully submits this notice of

`supplemental authority relevant to Defendants Samsung Electronics Co., Ltd. and Samsung
`
`Electronics America, Inc.’s (collectively, “Samsung”) Partial Motion to Dismiss Plaintiff’s
`
`Amended Complaint Under Rule 12(b)(6) (Dkt. 39). AGIS hereby attaches a Memorandum
`
`Opinion reaffirming the denial of a partial motion to dismiss based on 28 U.S.C. § 1498(a) in
`
`Arbutus Biopharma Corp. v. Moderna, Inc., No. 1:22-cv-00252, Dkt. 64 (D. Del. Mar. 10, 2023)
`
`as Exhibit A. See also Exhibit B, Arbutus Biopharma Corp. v. Moderna, Inc., No. 1:22-cv-
`
`00252, Dkt. 31 (D. Del. Nov. 2, 2022).
`
`AGIS submits that the Memorandum Opinion in Arbutus Biopharma Corp. v. Moderna,
`
`Inc. is relevant to at least (1) a district court’s consideration of factual disputes under 28 U.S.C. §
`
`1498(a) to dismiss all TAK-based claims at the pleading stage, (2) the need for factual discovery
`
`to ensure that any application of the affirmative defense under 28 U.S.C. § 1498(a) is based upon
`
`a developed record, and (3) the accused infringer’s burden of establishing under § 1498(a) that
`
`
`

`the infringing use is “for the Government” and “with authorization and consent of the
`
`Government.”
