`On January 19, 2022, the Court granted Lyft, Inc.’s (“Lyft”) motion to dismiss for improper
`
`venue (Dkt. 334). Although the Parties dispute whether Lyft is the prevailing party1 in this case
`
`due to the Court’s January 19, 2022 Order, to avoid burdening this Court with issues that may not
`
`need to be adjudicated, the Parties hereby stipulate to extend the deadline for Lyft to file any
`
`motion for costs and fees in this case until thirty days after the resolution of the Lyft, Inc. v. AGIS
`
`Software Development LLC case, No. 3:21-cv-04653, pending in the Northern District of
`
`California (“NDCA case”). The Parties stipulate that this Court will retain jurisdiction to decide
`
`

`that Lyft is a prevailing party under the applicable rules and reserves the right to challenge any
`motion for costs or fees on any grounds, including the ground that Lyft is not a prevailing party.

`any motion for costs and/or fees that Lyft files within thirty days of the resolution2 of the NDCA

`This motion for extension supersedes and moots Lyft’s previous motions for extensions
`
`(Dkts. 356 & 363). In light of the present filing, Lyft will withdraw its previous motions (Dkts.
`
`356 & 363).
`
