`Case No. 2:21-cv-00072-JRG
`(MEMBER CASE)
`
`JURY TRIAL DEMANDED
`
`
`ORDER GRANTING DEFENDANT UBER TECHNOLOGIES, INC.’S MOTION
`TO STRIKE
`
`
`
`Before the Court is Defendant Uber Technologies, Inc.’s (“Uber”) Motion to Strike
`
`Plaintiff AGIS Software Development LLC’s (“AGIS”) First Amended Disclosure of Asserted
`
`Claims and Infringement Contentions (the “Motion”). Having considered the Motion, the Court
`
`finds that the Motion should be granted.
`
`
`
`Accordingly, the Court GRANTS Uber’s Motion to Strike Plaintiff’s First Amended
`
`Disclosure of Asserted Claims and Infringement Contentions . It is therefore ORDERED that
`
`AGIS shall identify which infringement theory it will pursue. It is further ORDERED that all
`
`portions of AGIS’s contentions that are inconsistent with that theory are STRICKEN. AGIS is
`
`ORDERED to serve supplemental amended contentions consistent with this Order within ten (10)
`
`days.
