`JOINT MOTION FOR LEAVE TO INCREASE PAGE LIMITS FOR CLAIM
`CONSTRUCTION BRIEFING
`
`Plaintiff AGIS Software Development LLC (“Plaintiff” or “AGIS”) and Defendants T-
`
`Mobile USA, Inc. T-Mobile US, Inc., Lyft, Inc., Uber Technologies, Inc. d/b/a/ Uber, and
`
`WhatsApp LLC1 (collectively “Defendants”) jointly file this Motion for Leave to Increase Page
`
`
`1 WhatsApp, Inc. is incorrectly named in the First Amended Complaint (Dkt. 47).
`
`

`

`Case 2:21-cv-00072-JRG-RSP Document 137 Filed 08/27/21 Page 2 of 6 PageID #: 3319
`
`
`
`Limits for Claim Construction Briefing from the default set forth in P.R. 4-5 and L.R. CV-7 as
`
`follows:
`
`•
`
`•
`
`•
`
`Increase Plaintiff’s opening brief by 30 pages to a total of 60 pages;
`
`Increase Defendants’ responsive brief by 30 pages to a total of 60 pages; and
`
`Increase Plaintiff’s reply brief by 10 pages to a total of 20 pages. 2
`
`This page limit increase is warranted in view of the number of parties, patents, and terms
`
`in dispute as well as the complexity of the legal issues involved in the parties’ claim construction
`
`disputes. There are nine asserted patents in the consolidated cases, only two of which are common
`
`across all Defendants. A page limit increase is appropriate and necessary to allow the parties to
`
`meaningfully address these challenging legal issues for such a large number of disputed terms.
`
`For the reasons set forth above, the parties respectfully request that the Court grant the joint
`
`motion for leave to increase page limits for claim construction briefing; specifically, increasing
`
`Plaintiff’s opening brief, Defendants’ responsive brief, and Plaintiff’s reply brief to a total of 60,
`
`60, and 20 pages, respectively.
