Case 2:19-cv-00209-JRG Document 162 Filed 07/16/20 Page 1 of 3 PageID #: 5948
`
`IN THE UNITED STATES DISTRICT COURT
`FOR THE EASTERN DISTRICT OF TEXAS
`MARSHALL DIVISION
`
`
`THE HILLMAN GROUP, INC.,
`
`
`Plaintiff,
`
`
`v.
`
`KEYME, LLC,
`
`
`Defendant.
`
`
`
`
`
`Case No. 2:19-cv-00209-JRG
`
`
`JURY TRIAL DEMANDED
`
`
`
`
`
`JOINT NOTICE REGARDING MEDIATION
`
`Pursuant to the Court’s Claim Construction Memorandum and Order (Dkt. 159), Plaintiff
`
`The Hillman Group, Inc. (“Hillman”), and Defendant KeyMe, LLC (“KeyMe”) (collectively, “the
`
`Parties”) hereby submit this Joint Notice regarding the Parties’ position on mediation.
`
`
`
`The Parties agree that mediation would be useful and currently plan on trying to accomplish
`
`the same sometime in August. However, due to the current focus on discovery and depositions
`
`the Parties have not yet agreed upon a mediator, though they expect that they will be able to.
`
`Accordingly, with this Honorable Court’s permission, the Parties propose that within two (2)
`
`weeks of this filing they will identify an agreed mediator to the Court, or in the alternative, let the
`
`Court know that they have been unable to agree and request the Court to appoint a mediator of its
`
`choosing.
`
`Dated: July 16, 2020
`
`
`
`
`
` Respectfully submitted,
