`JOINT MOTION FOR ENTRY OF SECOND AMENDED DOCKET CONTROL ORDER

`Plaintiff AGIS Software Development LLC (“AGIS”) and Defendants HTC Corporation
`
`
`
`(“HTC”) and LG Electronics, Inc. (“LG”) (collectively, “Parties”), hereby submit this Joint Motion
`
`for Entry of a Second Amended Docket Control Order and show the Court as follows:
`
`
`
`Good cause exists for requesting the extensions of time reflected in the proposed Second
`
`Amended Docket Control Order. The Parties worked diligently to address unavoidable conflicts of
`
`the Parties’ experts and subsequent scheduling conflicts resulting from the same. AGIS’s experts,
`
`Joseph McAlexander and Alan Ratliff, are each scheduled to submit multiple expert reports and
`
`testify in multiple depositions in other matters leading up to and immediately after the current
`
`deadline for opening reports. HTC’s experts are similarly unavailable to submit rebuttal reports
`
`until January 18, 2019 if the schedule were moved to accommodate for Joseph McAlexander and
`
`Alan Ratliff’s schedules. Extensions to the schedule are requested to allow sufficient time to
`
`complete expert discovery, motion practice, mediation, and pre-trial practice. The extensions as to
`
`all Parties would maintain alignment of schedules of the parties in this consolidated case. The
`

`parties therefore respectfully request that the Court grant the extensions of dates in the proposed
`
`Second Amended Docket Control Order.

`The Parties have conferred and agreed upon all provisions of the Second Amended Docket
`
`Control Order and hereby jointly move that the Court approve and enter same, a copy of which is
`
`attached hereto for the Court’s entry.
`
