`
`Petition for Inter Partes Review of USP 9,408,055
`
`This petition sets forth in detail the lack of written description support for
`
`the ’055 patent claims in the ’055 patent’s grandparent. It also details how the prior
`
`art ’724 patent invalidates the ’055 patent claims. The Board should therefore
`
`institute review of all claims of the ’055 patent, and find them unpatentablc.

`
`Related Matters
`
`The ’055 patent is asserted in the following case that may be affected by a
`
`decision in this proceeding: AGIS Software Development LLC v. Apple Inc. , No.
`
`2: 17-cv-00516-JRG (E.D. TeX.).
`
`In addition, the ’05 5 patent is asserted against third parties in four litigations:
`
`AGIS Software Development LLC v. Huawei Device USA Inc. et al., No. 2: l7-cv-
`
`00513 (E.D. Tex.); AGIS Software Development LLC v. LG Electronics, Inc., No.
`
`2: 17-cv-00515 (E.D. Tex.); AGIS Software Development LLC v. ZTE Corporation

`
`Dependent Claims
`
`1.
`
`Claims 2, 29, and 42: Call a fixed entity by selecting its
`symbol
`
`— This
`
`element is substantially similar to the additional element of claim 44 of the ’838
`
`patent. During the prosecution of the co-pending ’838 patent, AGIS represented
`
`and admitted that issued claim 44 of the ’838 patent is described in the ’724 patent
`
`725-13 (select (“hook”) symbol to display data), 7:35-38 (display facilities such as
`
`fire departments, police stations, etc.), 8:23-48 (select symbol to call such
`
`facilities), 1029-22 (selecting such a facility, accessing database with information
`
`including URL), 19:41-49 (go to facility’s website by selecting symbol to obtain
`
`URL), 20:1-19 (go to facility’s website by selecting symbol to obtain URL). ’838
`
`FH 70, 72 (EX. 1004); Bederson Decl. llll 141-44.
`
`2.
`
`Claims 21 and 22: Selecting symbol corresponding to a
`facility
`
`Claim 21 recites presenting a symbol representing a hospital, fire station,
`
`etc., and claim 22 recites selecting it to display information. These elements are
`
`substantially similar to the additional elements of claims 45 and 46 of the ’838
`
`patent. During the prosecution of the co-pending ’838 patent, AGIS represented
`
`and admitted that these claim elements are taught in the ’724 patent 7:5-13 (select
`
`(“hook”) symbol to display data), 7:35-38 (display facilities such as fire
