`Pursuant to Rules 41(a)(1) and 41(c) of the Federal Rules of Civil Procedure, Plaintiff

`Allergan, Inc. (“Allergan”) and Defendant InnoPharma Inc. (“InnoPharma”) by and through their
`
`respective counsel, hereby stipulate and agree as follows, pursuant to their Settlement and
`
`License Agreement entered as of October 12, 2017:
`1. Allergan’s claims against InnoPharma shall be dismissed without prejudice;
`2. InnoPharma’s counterclaims against Allergan shall be dismissed without prejudice; and
`3. The parties to this stipulation shall bear their own costs, expenses, and attorney fees.
