`Before the Court is Plaintiff Blitzsafe Texas, LLC (“Blitzsafe”) and Defendants Nissan North
`
`America, Inc. and Nissan Motor Co., Ltd. (collectively “Nissan”) Agreed Motion To Dismiss
`
`With Prejudice claims and causes of action asserted by Plaintiff Blitzsafe against Nissan and all
`
`Counterclaims filed by Nissan against Blitzsafe in the above-captioned action pursuant to Fed. R.
`
`Civ. P. 41(a)(2). Having considered the motion, the Court finds that it is well taken and it is
`
`hereby GRANTED, it is hereby ORDERED that all claims and causes of action asserted by
`
`Plaintiff Blitzsafe in this action against Defendants Nissan are dismissed with prejudice to the
`
`Plaintiff to re-filing same and without costs, except that Blitzsafe’s claims and causes of action
`
`against Nissan arising out of Nissan’s sale, offer for sale, use, or importation into the United
`
`States of products made, used, sold, offered for sale or imported into the United States by Robert
`
`Bosch GmbH; Bosch Automotive Products (Suzhou), Co., Ltd.; Robert Bosch LLC; Robert
`
`Bosch Sistemas Automotrices, S.A., de C.V. LTDA, and their parents, subsidiaries and affiliated
`
`entities are dismissed without prejudice to the Plaintiff to re-filing the same and without costs
`
`

`and all Counterclaims filed by Nissan against Plaintiff Blitzsafe are hereby dismissed without
`
`prejudice. This Order does not dispose of Nissan’s claims against Panasonic.

`It is further ORDERED that all attorneys’ fees and costs are to be borne by the party that
`
`incurred them.
