`Contentions to Plaintiff Blitzsafe Texas, LLC (“Blitzsafe”).

`The Invalidity Contentions address the following claims of U.S. Patent No. 7,489,786
`
`(“the ’786 patent”) and U.S. Patent No. 8,155,342 (“the ’342 patent) (collectively, the “Patents-
`
`

`Blitzsafe’s Infringement Contentions are deemed to be its final contentions pursuant to

`P. R. 3-6. Should the Court allow Blitzsafe to later assert infringement of additional claims not

`asserted in Blitzsafe’s Infringement Contentions or additional infringement theories with respect
`
`to the Asserted Claims, the Defendants reserve the right to supplement their Invalidity
`
`Contentions to assert invalidity of those additional claims and/or to assert invalidity based on the
`
`additional infringement theories.

`I.
`
`Preliminary Matters
`
`The Defendants’ Invalidity Contentions are based in whole or in part on their present
`
`understanding of the Asserted Claims and Blitzsafe’s Infringement Contentions against each
`
`respective Defendant, including the priority dates of each of the Patents-in-Suit as asserted by
`
`Blitzsafe in its Infringement Contentions.
`
`The Defendants’ Invalidity Contentions are responsive at least to the same level of
`
`specificity of Blitzsafe’s Infringement Contentions. The Defendants’ Invalidity Contentions may
`
`also take into account Blitzsafe’s apparent claim constructions, to the extent Blitzsafe’s
`
`constructions can be gleaned from Blitzsafe’s Infringement Contentions. Such apparent
`
`
`2 Claims 66, 68, 70, 94, 113, and 115 were not asserted by Blitzsafe against the Hyundai and Kia Defendants, and
`therefore they make no contentions with respect to those claims at this time. However, they reserve all rights

`constructions may be inconsistent with the constructions that the Defendants ultimately will
`
`proffer in this case. By including prior art that would anticipate or render obvious the asserted
`
`claims of the patents in suit based on Blitzsafe’s disclosed and apparent claim constructions, or
`
`based on any other particular claim construction, the Defendants are not adopting Blitzsafe’s
`
`claim constructions, nor are the Defendants admitting to the accuracy of any particular claim
`
`construction. The Court has established separate deadlines for the parties’ proposed claim
`
`constructions, and the Defendants will disclose their proposed constructions according to those
`
`deadlines. For purposes of these Invalidity Contentions, the Defendants may adopt alternative,
`
`and even inconsistent, claim construction positions. The Defendants reserve all rights to amend
`
`these Invalidity Contentions after the Court issues its claim construction ruling, or if the Court
`
`permits Blitzsafe to amend its Infringement Contentions.
`
`The Defendants, however, do not concede that Blitzsafe’s Infringement Contentions meet
`
`the specificity required under the Patent Rules, and the Defendants provide these Invalidity
`
`Contentions without waiving any right to receive from Blitzsafe full and complete specific
`
`infringement contentions. Moreover, nothing herein admits in any way that any accused product,
`
`or any of the Defendants’ other products, infringes any of the Asserted Claims.

`The Defendants incorporate by reference all contentions, charts, prior art references, and

`to the Patents-in-Suit and by any party in any other past, present, and future litigation involving

`the Patents-in-Suit and patents related to the Patents-in-Suit, including those of defendants

`Volkswagen Group of America, Inc. and Volkswagen Group of America Chattanooga
`
`Operations, LLC in this consolidated action. The Defendants incorporate by reference all
`
`grounds of invalidity identified in any present or future reexamination, inter partes review,
`
`covered business method (CBM) patent review, or other post-issuance review by the Patent and
`
`Trademark Office of the Patents-in-Suit. The Defendants also incorporate by reference the
`
`production of documents associated with any grounds for invalidity for the Patents-in-Suit

`identified in this paragraph. The Defendants request that all such contentions from every case
`
`involving the ’786 patent or the ’342 patent be produced to the Defendants as soon as possible

`Ongoing Investigation
`
`The Defendants’ discovery and investigation in connection with this lawsuit is
`
`continuing, and thus, these Invalidity Contentions are based on information obtained to date.
`
`Among other things, discovery is still underway, neither Blitzsafe nor any third party witnesses
`
`have been deposed to date, and the Court has not yet construed the terms of the Asserted Claims.
`
`Accordingly, the Defendants’ Invalidity Contentions are subject to modification, amendment, or
`
`supplementation in accordance with the Court’s Docket Control Order, the Local and Patent
`
`

`Maximum PC Article in Appendices 9 and 10.

`With respect to the above-listed items, Defendants continue to investigate the identities of
`
`the individuals or entities involved in the first sale, offer for sale, or public use of the prior art
`
`systems listed below and the precise dates that these systems were first sold, offered for sale, or
`
`were publicly used, and the Defendants will produce additional documents relating to the
`
`invalidity of the Asserted Claims by those items as they become available. Upon information
`
`and belief, the above-listed items were publicly used or known or on sale more than a year prior
`
`to the filing date of the ’786 patent. Upon information and belief, TOY/PAN DMX V.1B and
`
`TOY/PAN DMX V.2B were made available for sale to users of Blitzsafe of America, Inc.’s
`
`(“Blitzsafe of America”) public website by February 2001 and no later than March 4, 2001, and
`
`1998 TOY/PAN V.2 interface was made available for sale no later than September 1998. A
`
`chart identifying how each of the above-listed items anticipates or renders obvious the claims of
`
`the ’786 patent can be found in Exhibit X of Appendix 6. Appendix 6 was a public filing in
`
`Marlowe Patent Holdings, LLC v. Ford Motor Co., No. 2:11-cv-07044 (D.N.J.), and together
`
`with all of its exhibits, it is expressly incorporated in these Invalidity Contentions by reference,
`
`as if fully set forth herein.
`
`Upon information and belief, the 1999 Toyota car stereos were made available for sale
`
`(e.g., with Toyota vehicles including the Corolla) and used more than a year prior to the filing
`
`date of the '786 patent. Appendix 7 includes bus traffic logs for various configurations of a 1999
`
`Toyota car stereo, the Blitzsafe prior art interfaces, and a 1998 Panasonic CD changer.
`
`Upon information and belief, the SoundGate KNTOY1, the SoundGate SDS1, and the
`
`SoundGate DOCKTOYO were made available for sale and/or publicly known or used by
`
`January 2000 and no later than January 2002. Appendix 8 describes these products, and is
`
`expressly incorporated in these Invalidity Contentions by reference, as if fully set forth herein.

`Prior Art Under 35 U.S.C. § 102(f)
`
`On information and belief, the Defendants contend that one or more of the Asserted
`
`Claims of the ’786 patent and the ’342 patent are invalid under 35 U.S.C. § 102(f) for failing to
`
`name one or more inventors of the subject matter claimed in the patents, including Edward
`
`Fischer. On information and belief, Mr. Fischer was previously employed by Blitzsafe of
`
`America, Inc. (“Blitzsafe of America”), a predecessor-in-interest of the ’786 patent. On
`
`information and belief, the TOY/PAN V.2 interface was offered for sale by Blitzsafe of America
`
`and/or publicly used or known more than one year before the filing date of the ’786 patent. On
`
`information and belief, the TOY/PAN V.2 interface practices several claims of the ‘786 patent.
`
`On information and belief, the TOY/PAN V.2 interface generated a signal in response to a
`
`regular polling signal from a Toyota stereo to maintain the car stereo in a state responsive to
`
`signals received and processed by the interface, which constitutes a “device presence signal”
`
`recited in both the ’786 patent and ’342 patents. On information and belief, Mr. Fischer wrote
`
`the source code and designed the circuit board for the TOY/PAN V.2 interface and other
`
`interfaces offered for sale by Blitzsafe of America. Mr. Fischer was improperly omitted as an
`
`inventor of the subject matter of the ’786 patent and ’342 patent.
`
`Further discovery on this issue is required, and the Defendants reserve the right to
`
`supplement their disclosure regarding the circumstances under which the claimed inventions
`
`were derived.
`
`B.
`
`Disclosures Pursuant to P. R. 3-3(b)
`
`
`
`With respect to P. R. 3-3(b), Appendix 9 specifically identifies prior art that anticipates
`
`each Asserted Claim of the ’786 patent and/or renders it obvious, and Appendix 10 specifically
`
`identifies prior art that anticipates each Asserted Claim of the ’342 patent and/or renders it
`

`obvious. In addition to the references specifically identified in Appendix 9 and Appendix 10, the
`
`Defendants also reserve the right to rely on any of the patents or publications deriving from
`
`applications in the respective claimed priority chains of Patents-in-Suit, the references cited on
`
`the face of the Patents-in-Suit and related patents, the admitted prior art references in the
`
`specifications of the Patents-in-Suit and related patents, the prosecution history of the Patents-in-
`
`Suit and related patents, the references cited in any USPTO (including PTAB) proceedings
`
`related to the Patents-in-Suit or related patents, and the references cited in any invalidity
`
`contentions submitted in any action or proceedings involving the Patents-in-Suit or related
`
`patents. The Defendants may also rely on expert testimony and any additional prior art located
`
`or developed during the course of discovery. Furthermore, the Def
