`REQUEST FOR RECONSIDERATION AFTER FINAL ACTION DENIED

`Applicant’s request for reconsideration is denied.   See 37 C.F.R. §2.63(b)(3).  The trademark
`examining attorney has carefully reviewed applicant’s request and determined the request did not:  (1)
`raise a new issue, (2) resolve all the outstanding issue(s), (3) provide any new or compelling evidence
`with regard to the outstanding issue(s), or (4) present analysis and arguments that were persuasive or
`shed new light on the outstanding issue(s).  TMEP §§715.03(a)(ii)(B), 715.04(a).  
`
`Applicant continues to argue there is no likelihood of confusion between its mark and cited registration
`because the marks differ in "sight and sound" and "meaning and commercial impression."  Applicant
`also alleges registrant's mark is weak and therefore entitled to a narrow scope of protection, and
`therefore applicant's mark presents no likelihood of confusion.  These arguments are not persuasive,
`and will be further addressed in turn.
`
`Applicant alleges the examining attorney has engaged in an improper dissection of the marks in finding
`the marks similar.  Applicant's characterization of the examining attorney's comparison of the marks is
`exaggerated and incorrect.  It is admitted that applicant's "GOLDEN BAKE" and registrant's
`"GOLDBAKING" have slight differences in appearance and sound.  These differences were
`appropriately noted and explained in the March 1 final Office action.  In comparing the marks in their
`entireties, however, they bear many more similarities than they do differences, and the differences are
`not such to render the marks dissimilar.  Both marks comprise two words - in the case of applicant's
`mark, these words are separated by a space, and in the case of registrant's mark, they are compounded
`together to appear as one term.  Structurally, the marks present similar terms in the same sequence. 
`That is, the word "GOLDEN" precedes the word "BAKE" in applicant's mark, and the word "GOLD"
`precedes the word "BAKING" in registrant's mark.  Furthermore, as previously noted, applicant's
`"GOLDEN" and registrant's "GOLD" are nearly identical in both sound and structure, and per the
`previously provided dictionary evidence, have nearly the same meaning.  Similarly, applicant's
`"BAKE" and registrant's "BAKING" terms are also nearly identical in both sound and structure, these
`terms too having virtually identical meanings.  On balance, the slight differences between the marks
`with respect to sound and structure do not come close to outweighing their similarities, especially when
`the proper focus is on the recollection of the average purchaser, who retains a general rather than
`specific impression of trademarks. In re Ox Paperboard, LLC, 2020 USPQ2d 10878, at *4 (TTAB
`2020) (citing In re Bay State Brewing Co., 117 USPQ2d 1958, 1960 (TTAB 2016)); In re Inn at St.
`John’s, LLC, 126 USPQ2d 1742, 1746 (TTAB 2018); TMEP §1207.01(b); see In re St. Helena Hosp.,
`774 F.3d 747, 750-51, 113 USPQ2d 1082, 1085 (Fed. Cir. 2014).   The general impressions of
`"GOLDEN BAKE" to "GOLDBAKING" are so similar as to result in a likelihood of confusion.
`
`Applicant also quibbles over the examining attorney's observation that the term "GOLDEN" in
`applicant's mark is derived from the root word "GOLD", which appears in registrant's mark, and the
`word "BAKE" in applicant's mark is the root word "BAKING" in registrant's mark.  The newly
`attached etymological evidence from etymonline.com and dictionary.com shows that the examining
`attorney's finding was not speculative or mere argument.  This fact, however, was not relied upon by
`the examining attorney to "dissect" the marks in finding them to be similar or argue that consumers
`would understand what a "root term" is and understand "GOLDEN" being derived from "GOLD" or
`"BAKING" from the word "BAKE".  Rather, the examining attorney demonstrated that the use of these
`

`similar terms in the same sequence results in the marks having highly similar overall commercial
`impressions.   
`
`Applicant's continues to allege there is a divergent commercial impression between its mark and
`registrant's.  As applicant's mark is for use with "bakeware," applicant argues its GOLDEN BAKE
`mark may suggest to consumers its goods are "heated to create 'golden' or well-cooked foods."  But,
`according to applicant, because registrant's mark is used with goods "which include but are not limited
`to bakeware," its commercial impression relates to a "gold standard" or "gold label."  This argument is
`entirely speculative and has no factual basis.  The newly cited evidence below demonstrates the terms
`"GOLD" and "GOLDEN" having the same exact meaning with respect to baking.  Specifically, the
`evidence demonstrates consumers perceive "GOLD" and "GOLDEN" as relating to the desired color of
`food.

`Applicant request for reconsideration also includes a list of thirteen third-party registrations for marks
`including the component "GOLD" to show that this portion of the mark in the cited registration is
`inherently or conceptually weak and should not be afforded a broad scope of protection.  See Spireon,
`Inc. v. Flex Ltd., 71 F.4th 1355, 1363, 2023 USPQ2d 737, at *4-5 (Fed. Cir. 2023) (quoting Jack
`Wolfskin Ausrustung Fur Draussen Gmbh v. New Millennium Sports, SLU, 797 F.3d 1363, 1374, 116
`USPQ2d 1129, 1136 (Fed. Cir. 2015)); Juice Generation, Inc. v. GS Enters. LLC, 794 F.3d 1334, 1339,
`115 USPQ2d 1671, 1675 (Fed. Cir. 2015); TMEP §1207.01(d)(iii).   
`
`At this point, the examining attorney seeks to clarify portions of the record.  Applicant's request for
`reconsideration indicates "Exhibit A" consists of a "TSDR Printout of Record [sic]."  Applicant also
`indicates that "Exhibit B" consists of "TSDR Printouts of Records and Corresponding Evidence of Use
`in Commerce."  Exhibit A, however, only contains TSDR screenshots of the thirteen third-party
`

`registrations listed in its argument included with the request for reconsideration, along with eleven
`additional third-party registrations which were not included in applicant's list and were not discussed or
`referenced anywhere else
`in applicant's argument.  Those registrations
`include Registration
`Nos.  634581, 3503805, 7256535, 6077376, 6315071, 6334710, 6475052, 6530258, 7013103, 6601576,
`and 6912136.  Because these third-party registrations were included but never referenced or discussed,
`they will not be addressed.  Furthermore, "Exhibit B" was not included or provided in applicant's
`response, nor was any "Corresponding Evidence of Use in Commerce," and therefore these references
`will also not be discussed.
`

` large number of active use-based third-party registrations including the same or similar term or mark
`segment for the same or similar goods may be relevant to prove, in the same way dictionaries are used,
`that a term or mark segment has “a normally understood and well-recognized descriptive or suggestive
`meaning, leading to the conclusion that that segment is relatively weak” and entitled to only a narrow
`scope of protection.  Spireon, Inc. v. Flex Ltd., 71 F.4th 1355, 1364, 2023 USPQ2d 737, at *5-6 (Fed.
`Cir. 2023) (quoting 2 J. Thomas McCarthy, McCarthy on Trademarks & Unfair Competition §11:90
`(5th ed. 2023)): Jack Wolfskin Ausrustung Fur Draussen Gmbh v. New Millennium Sports, SLU, 797
`F.3d at 1374, 116 USPQ2d at 1136 (quoting Juice Generation, Inc. v. GS Enters. LLC, 794 F.3d at
`1339, 115 USPQ2d at 1675).   Registrations that are not based on use in commerce (i.e., third-party
`Registration No. 7256535, which was included by applicant but not discussed), such as those registered
`under Trademark Act Section 66(a) or solely under Section 44, and for which no Section 8 or 71
`affidavits or declarations of continuing use have been filed, have “very little, if any, persuasive value.” 
`TMEP §1207.01(d)(iii) (citing In re Info. Builders Inc., 2020 USPQ2d 10444, at *6 n.19 (TTAB
`2020)).
`
`Evidence comprising only a small number of active use-based third-party registrations including the
`same or similar component is generally entitled to little weight in determining the strength of a mark. 
`See In re i.am.symbolic, llc, 866 F.3d 1315, 1328-29, 123 USPQ2d 1744, 1751-52 (Fed. Cir. 2017);
`AMF Inc. v. Am. Leisure Prods., Inc., 474 F.2d 1403, 1406, 177 USPQ 268, 269 (C.C.P.A. 1973).   That
`is especially so where, as here, the marks in those registrations are not as similar in format or
`commercial impression as registrant’s and applicant’s marks are to each other.  See Specialty Brands,
`Inc. v. Coffee Bean Distribs., Inc., 748 F.2d 669, 675, 223 USPQ 1281, 1284-85 (Fed. Cir. 1984)
`(noting none of the five registrations of marks shown to be in use had the same format or conveyed a
`commercial impression similar to the applicant’s and cited registered mark).  The only similarity the
`cited third-party registrations have is that they contain the word "GOLD".  None include the word
`"BAKE" or "BAKING".  These few registrations are “not evidence of what happens in the market place
`or that customers are familiar with them.”  Sock It To Me, Inc. v. Aiping Fan, 2020 USPQ2d 10611, at
`*9 (TTAB 2020) (quoting AMF Inc. v. Am. Leisure Prods., Inc., 474 F.2d at 1406, 177 USPQ at 269). 
`Thus, the few use-based third-party registrations submitted by applicant are insufficient to establish that
`the mark or portion of the mark is inherently or conceptually weak. 
`
`Further, assessing conceptual strength is “based on the nature of the [component] itself,” that is, its
`level of distinctiveness in relation to the specified goods and/or services.  Bell’s Brewery, Inc. v.
`Innovation Brewing, 125 USPQ2d 1340, 1345 (TTAB 2017) (citing  Couch⸝Braunsdorf Affinity, Inc.
`v. 12 Interactive, LLC, 110 USPQ2d 1458, 1476 (TTAB 2014)).  Evidence comprising third-party
`registrations of similar marks for different or unrelated goods has “no bearing on the strength of the
`term in the context relevant to this case.”   See Tao Licensing, LLC v. Bender Consulting Ltd., 125
`USPQ2d at 1058 (citing In re i.am.symbolic, llc, 866 F.3d at 1328, 123 USPQ2d at 1751).  Many of
`applicant's third-party registrations appear to be for goods that are predominantly different from or
`unrelated to those identified in the cited registration and applicant’s application.  For example,
`

`Registration No. 3350894 recites "candle holder" goods and accessories, Registration No. 4307788
`recites "paper plates," and Registration No. 5447516 recites "compost containers for household use." 
`Thus, these third-party registrations submitted by applicant are not probative on whether a portion or all
`of the mark is inherently or conceptually weak.
`
`For these reasons, applicant's arguments concerning the "dilution" or commercial or conceptual
`weakness of registrant's mark is not persuasive.  None of the cited third-party include the word
`"BAKING" or "BAKE" and are not probative to establish any weakness with respect to the words
`selected registrant as its mark. 
`
`Accordingly, the following refusal made final in the Office action dated March 1, 2024 is  maintained
`and continued:

`The adjective golden is obviously a compound ofthe noun geld andthe suffix —en, which is used to
`form adjectives of source or material from nouns. The odd thing about golden is that itis first
`recorded only about 1300. Golden is a Middle English re-formation of go/d and —en that replaced
`earlier Middle English gu/den, gilden, gelden, gylden “madeoforconsisting of gold,” from Old English
`gylden, gilden “golden.”
`Golden age occurs in The Works and Days ofthe Greek didactic poet Hesiod (c700 b.c.) and has
`persisted throughout Westernliterature. Golden mean“the perfect moderate courseor position that
`avoids extremes” entered English in the 1540s. Golden mean wasalso formerly called the golden
`mediocrity, a literal translation of Horace’s aurea mediocritas (Odes 2.10). The golden mean as an
`ethical principle is usually associated with Aristotelian ethics, it being a virtue, the midpoint between
`two opposite extremes, as, for example, the virtue of courage being the golden mean between the
`two opposite vices of cowardice and foolhardiness_

`Clairee: That’s so easy you don’t haveto write it down. Cup offlour, cup ofsugar,
`cupoffruit cocktail with thejuice. Mix it up and bakeat350 ‘til gold and bubbly.
`Truvy: Sounds awfully rich.
`Clairee:It is. So I serve it over ice cream to cut the sweetness.
`
`In the movie versionof “Steel Magnolias,” Truvyis credited with the Cuppa Cuppa
`Cupparecipe,butin the play, that honor belongsto theformerfirst ladyof
`ChinquapinParish, Clairee. This summer, I hadthepleasureofplaying herin the
`River Campus’ SummerArts Festival productionofthe sentimental Southern comedy.
`While certain films andplays are associated with specific foods (tea and cakein “The
`Importanceof Being Earnest,” spaghetti and meatballs in “Lady and The Tramp,”
`“Leave the gun;take the cannoli" in “The Godfather”) rarelyis a whole recipe given. I
`decided I neededto see if anybody had madeit. It turnsout “The Pioneer Woman,”
`Ree Drummondofinternet and FoodTVfame,had!
`I followed her recipe, since it provided just a bit more detail than Clairee’s — including
`a cook timeof45 minutes, since I wasn’t sure howlong it would take to get “gold and
`bubbly.” Theresultis sticky, sweet and definitely comfort food. The Pioneer Woman
`
`suggests serving it with unsweetened whippedcream,but I found that Clairee’s
`

`encouragementto serveIt over ice cream was right on. Withall the tresh blueberries
`wecurrentlyhave available, and with apples about to comeinto season, you might not
`need this recipe right now, but come winter,if you are craving a super simple and
`comforting dessert, those sassy gals from Truvy’s beauty shop have you covered.

`Cuppa Cuppa Cuppa “Cake”
`* 1 cup self-rising flour
`* 1 cup sugar
`* 1canfruit cocktail with juice
`* Softened butter,for pan
`* Unsweetened whipped cream(orice cream)for serving
`Preheat oven to 350 degrees. Grease 8-inch square baking dish with butter.
`Stir togetherflour, sugar and fruit cocktail with juice until just combined.
`Pourinto buttered panand bakeuntil gold and bubbly(45 minutes).
