`Applicant’s request for reconsideration is denied. See 37 C.F.R. §2.63(b)(3). The trademark
`examining attorney has carefully reviewed applicant’s request and determined the request did not: (1)
`raise a new issue, (2) resolve all the outstanding issue(s), (3) provide any new or compelling evidence
`with regard to the outstanding issue(s), or (4) present analysis and arguments that were persuasive or
`shed new light on the outstanding issue. TMEP §§715.03(a)(ii)(B), 715.04(a). In addition, applicant's
`amendment of its identification to the following is ACCEPTABLE: "Fertilizers for use in the field of
`commercial agriculture" in Class 1.
`
`Accordingly, the following refusal made final in the Office action dated January 17, 2023
`is CONTINUED AND MAINTAINED:

`Section 2(d) Refusal--Likelihood of Confusion
`
`
`See TMEP §§715.03(a)(ii)(B), 715.04(a).
`
`In particular, applicant argues that the words SBC and SOBEC distinguish the marks by changing the
`overall commercial impression of the applied-for mark, noting the differences in the goods and arguing
`that the term SOBEC is distinctive. As an initial matter, applicant admits that the wording SBC may
`be considered a house mark, and as explained in the Final Office Action, a house mark does not obviate
`a refusal for likelihood of confusion. Moreover, the word SOBEC does not distinguish the marks
`

`
`either. Even though SOBEC is a registered mark, the fact that it is registered does not confer a status
`upon it such that it can be used to distinguish marks automatically. Even assuming that the term
`SOBEC is arbitrary or fanciful, registrant's mark CLUTCH is itself a distinctive term when used in
`relation to fertilizers and insecticides, and the entirety of that distinctive mark is incorporated into the
`applied-for mark. See https://www.merriam-webster.com/dictionary/clutch (defining CLUTCH as
`"successful in a crucial situation," among other definitions). When comparing marks, “[t]he proper test
`is not a side-by-side comparison of the marks, but instead whether the marks are sufficiently similar in
`terms of their commercial impression such that [consumers] who encounter the marks would be likely
`to assume a connection between the parties.” Cai v. Diamond Hong, Inc., 901 F.3d 1367, 1373, 127
`USPQ2d 1797, 1801 (Fed. Cir. 2018) (quoting Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d
`1356, 1368, 101 USPQ2d 1713, 1721 (Fed. Cir. 2012)); TMEP §1207.01(b). The proper focus is on the
`recollection of the average purchaser, who retains a general rather than specific impression of
`trademarks. In re Ox Paperboard, LLC, 2020 USPQ2d 10878, at *4 (TTAB 2020) (citing In re Bay
`State Brewing Co., 117 USPQ2d 1958, 1960 (TTAB 2016)); In re Inn at St. John’s, LLC, 126 USPQ2d
`1742, 1746 (TTAB 2018); TMEP §1207.01(b); see In re St. Helena Hosp., 774 F.3d 747, 750-51, 113
`USPQ2d 1082, 1085 (Fed. Cir. 2014). Here, closely related goods are being offered for sale under
`marks that share the distinctive term CLUTCH.
`
`Adding a term to a registered mark generally does not obviate the similarity between the compared
`marks, as in the present case, nor does it overcome a likelihood of confusion under Section 2(d). See
`Coca-Cola Bottling Co. v. Jos. E. Seagram & Sons, Inc., 526 F.2d 556, 557, 188 USPQ 105, 106
`(C.C.P.A. 1975) (holding BENGAL and BENGAL LANCER and design confusingly similar); In re
`Toshiba Med. Sys. Corp., 91 USPQ2d 1266, 1269 (TTAB 2009) (holding TITAN and VANTAGE
`TITAN confusingly similar); In re El Torito Rests., Inc., 9 USPQ2d 2002, 2004 (TTAB 1988) (holding
`MACHO and MACHO COMBOS confusingly similar); TMEP §1207.01(b)(iii). When used in
`association with highly related goods, the distinctive mark CLUTCH will likely be mistakenly
`perceived as identifying the same brand as SBC SOBEC CLUTCH--that is, consumers will likely
`believe that the mark SBC SOBEC CLUTCH merely attaches the house mark SBC to the same brand,
`and that the SBC SOBEC CLUTCH brand merely identifies another product from the previously
`anonymous source of CLUTCH agricultural products in the nature of insecticides.
`
`Applicant argues that CLUTCH is an "everyday" word with a common meaning. However, there is no
`evidence in the record that CLUTCH is commonly used in association with fertilizers or insecticides.
`Rather, when used in marketing in connection with the goods, it conveys the distinctive impression of
`being relied on to operate successfully in crucial situations.
`
`Applicant further argues that SBC may be perceived as identifying the previously anonymous source of
`SOBEC products, not CLUTCH products. However, identifying the previously unknown source of
`SOBEC does not preclude SBC from being perceived as identifying the previously unknown source of
`CLUTCH products.
`
`Additionally, applicant argues that the examining attorney improperly dismissed the cases cited by
`applicant. However, while certain cases may be binding as precedent with respect to their holdings, the
`marks and goods at issue in those cases are different from the present case, as are the records and
`evidence.
`
`Applicant also argues that the goods are not sufficiently related, stating "Fertilizers and insecticides are
`clearly not the same," and attaching a declaration from an employee of applicant, which is likely self-
`serving. However, t he fact that the goods of the parties differ is not controlling in determining
`
`
`
`likelihood of confusion. The issue is not likelihood of confusion between particular goods, but
`likelihood of confusion as to the source or sponsorship of those goods. In re Majestic Distilling Co.,
`315 F.3d 1311, 1316, 65 USPQ2d 1201, 1205 (Fed. Cir. 2003); In re Shell Oil Co., 992 F.2d 1204,
`1208, 26 USPQ2d 1687, 1689 (Fed. Cir. 1993); TMEP §1207.01. Here, there is more than ample
`evidence in the record showing that fertilizers and insecticides are commonly sold by the same sources
`under the same mark, and targeted at the same customers. The examining attorney attaches additional
`evidence of sources providing both applicant's and registrant's goods (continuing the numbering
`scheme from the Final Office Action):

`Furthermore, the examining attorney attaches additional evidence from the USPTO’s X-Search
`database consisting of a number of third-party marks registered for use in connection with the same or
`similar goods as those of both applicant and registrant in this case. The attached and previously
`attached 40 third-party registrations show that the goods listed therein are of a kind that may emanate
`from a single source under a single mark. The registrations encompass fertilizers for commercial
`agriculture and are therefore relevant to show relatedness of applicant's goods to registrant's.
`
`Applicant additionally argues that consumers are sophisticated and would check the fertilizer label,
`have a complete understanding of the pesticide, and take care in purchasing the goods. However, t he
`fact that purchasers are sophisticated or knowledgeable in a particular field does not necessarily mean
`that they are sophisticated or knowledgeable in the field of trademarks or immune from source
`confusion. TMEP §1207.01(d)(vii); see, e.g., Stone Lion Capital Partners, LP v. Lion Capital LLP, 746
`F.3d. 1317, 1325, 110 USPQ2d 1157, 1163-64 (Fed. Cir. 2014); Top Tobacco LP v. N. Atl. Operating
`Co., 101 USPQ2d 1163, 1170 (TTAB 2011). Further, where the purchasers consist of both
`professionals and the public, the standard of care for purchasing the goods is that of the least
`sophisticated potential purchaser. In re FCA US LLC, 126 USPQ2d 1214, 1222 (TTAB 2018) (citing
`Stone Lion Capital Partners, LP v. Lion Capital LLP, 746 F.3d. at 1325, 110 USPQ2d at 1163), aff’d
`per curiam, 777 F. App’x 516, 2019 BL 375518 (Fed. Cir. 2019).
`
`Applicant also argues that the trade channels are different except for suppliers of commercial
`agricultural products. However, the above-referenced and previously attached internet evidence shows
`that the same sources market the products on the same company websites and target the same
`consumers. In addition, registrant's identification encompasses insecticides for commercial agricultural
`use, and applicant admits that it shares a trade channel with registrant.
`
`Applicant also argues that fewer sources provide both fertilizers and insecticides than either product
`alone. However, a pplicant has only submitted a list of registrations to support its argument. The mere
`

`
`submission of a list of registrations or a copy of a private company search report does not make such
`registrations part of the record. See In re Peace Love World Live, LLC, 127 USPQ2d 1400, 1405 n.17
`(TTAB 2018) (citing In re 1st USA Realty Prof’ls, 84 USPQ2d 1581, 1583 (TTAB 2007); In re
`Duofold Inc., 184 USPQ 638, 640 (TTAB 1974)); TBMP §1208.02; TMEP §710.03.
`
`To make third party registrations part of the record, an applicant must submit copies of the
`registrations, or the complete electronic equivalent from the USPTO’s automated systems, prior to
`appeal. In re Star Belly Stitcher, Inc., 107 USPQ2d 2059, 2064 (TTAB 2013); TBMP §1208.02; TMEP
`§710.03. Accordingly, these registrations will not be considered.
`
`In any event, the above- and previously-referenced evidence demonstrates that fertilizers for
`commercial agriculture and insecticides for agriculture are commonly offered by the same sources
`under the same mark to the same consumers and are therefore closely related.
`
`The overriding concern is not only to prevent buyer confusion as to the source of the goods, but to
`protect the registrant from adverse commercial impact due to use of a similar mark by a newcomer. See
`In re Shell Oil Co., 992 F.2d 1204, 1208, 26 USPQ2d 1687, 1690 (Fed. Cir. 1993). Therefore, any
`doubt regarding a likelihood of confusion determination is resolved in favor of the registrant. TMEP
`§1207.01(d)(i); see Hewlett-Packard Co. v. Packard Press, Inc., 281 F.3d 1261, 1265, 62 USPQ2d
`1001, 1003 (Fed. Cir. 2002); In re Hyper Shoppes (Ohio), Inc., 837 F.2d 463, 464-65, 6 USPQ2d 1025,
`1026 (Fed. Cir. 1988).
`
`Therefore, the refusal under Section 2(d) is continued and maintained, and the Request for
`Reconsideration is denied.
`
`If applicant has already filed an appeal with the Trademark Trial and Appeal Board, the Board will
`be notified to resume the appeal. See TMEP §715.04(a).
`
`If applicant has not filed an appeal and time remains in the response period for the final Office
`action, applicant has the remainder of that time to (1) file another request for reconsideration that
`complies with and/or overcomes any outstanding final requirement(s) and/or refusal(s), and/or (2) file a
`notice of appeal to the Board. TMEP §715.03(a)(ii)(B).

`Rate Recommendations
`Unless otherwise specified, use recommended rates in the following water volumes
`based on application method . Use sufficient spray volume to insure thorough coverage
`and wetting needed for optimum results .
`Dilute: Greater than 100 gal/acre .
`Concentrate: 10-100 gal/acre .
`Aerial: 5-20 gal/acre .
`Fertigation: Apply this product at rates necessary to provide the desired levels of
`nutrients . Finish application at least one-half hour before end of irrigation schedule .
`
`BRANDT 10-16-38 MICRO is recommended for use on (but not limited to) the following
`crops . Rates other than those suggested below may be applied depending on crop
`conditions and cultural practices .
`Field and Vegetable Crops (such as alfalfa, beans, broccoli, carrots, cauliflower, corn,
`cotton, cucumbers, lettuce, onions, peas, peppers, sorghum, sugarbeets, tomatoes and
`wheat): Apply 5-10 lb/acre when plants are 3 to 4 weeks old and repeat as needed .
`Fruit and Nut Crops (such as almonds, apples, apricots, avocados, cherries, citrus,
`nectarines, peaches, pears, pecans, plums, prunes and walnuts): Apply 5-10 lb/acre early
`in the growing season when leaves have emerged and repeat as needed . Do not use in
`late season sprays where fruit color and maturity is delayed by nitrogen applications . Do
`not use on Golden Delicious apples during slow drying conditions .
`Vine and Berry Crops (such as bush berries, caneberries, grapes, hops and
`strawberries): Apply 5-10 lb/acre in early spring or when deficiency symptoms first
`appear and repeat as needed .
`Nursery, Greenhouse,Turf (For Professional Use Only) and Landscape Plantings:
`For general use as a foliar spray, soil drench or transplant solution, apply 2-4 lb per
`100 gal of water as needed . For constant feeding, apply 4-12 oz per 100 gal of water .

`General Information
`Foliar applications are used as a supplemental method of feeding to help correct
`nutrient deficiencies and to enhance crop quality and are not intended to replace
`a complete fertility program . Applications to actively growing plants produce the
`best results . Avoid foliar applications of this product when plants are suffering from
`moisture stress or during periods of high temperature and low humidity .
`Mixing and Handling Instructions
`Compatibility: BRANDT 10-16-38 MICRO may be applied separately or in conjunction
`with most pesticides and with other fertilizers . The addition of wetting agents often
`enhances nutrient uptake . DO NOT use with basic metal sulfates, strongly alkaline
`materials (such as hydrated lime and lime sulfur), or spray oils . A compatibility test
`is recommended if the desired combination has not been previously used . Tank
`mixtures with copper-based products can be phytotoxic due to increased solubility
`of copper . Before general applications, apply the spray solution to a small test area
`of the foliage to determine any undesirable phytotoxic effects .
`Mixing: Dissolve the recommended amount of this product into approximately one half
`the required water . Note: 2 lb of this product per 100 gal equals 1 oz/3 gal or 1 tbsp/1
`gal . Slowly add the remaining water while maintaining constant agitation . Water quality
`and temperature will determine maximum solubility . Warmer water temperatures increase
`solubility and shorten dissolving time . As this product goes into solution, the water
`temperature will drop . Therefore it is important when preparing concentrated solutions
`to allow for this temperature drop to insure that the fertilizer is completely dissolved .

`Do not apply near water, storm drains, or drainage ditches . Do not apply if heavy rain
`is expected . Apply this product only to your lawn/garden, and sweep any product that
`lands on the driveway, sidewalk, or street, back onto your lawn/garden . Check with
`your local Cooperative Extension Agency to obtain specific information on local turf
`best management practices .
`In Virginia, this lawn fertilizer, which contains phosphorous, is intended only for
`nonagricultural use on (i) turf during its first growing season, (ii) turf areas being
`repaired or renovated, and (iii) turf where a soil test performed within the last 3 years
`indicates a phosphorous deficiency . This fertilizer is not intended for the routine
`maintenance of turf .

`get medical attention . If on skin: Wash with plenty of water . Take off contaminated clothing
`and wash before reuse . If skin irritation occurs, get medical attention . If swallowed: Rinse
`mouth . Call a poison center/doctor if you feel unwell . If exposed or concerned, get medical
`attention . In case of fire: Use appropriate media to extinguish . Storage and Disposal: Do
`not contaminate water, food or feed by storage or disposal . Keep out of reach of children .
