`Reliance Vitamin Company Inc. (“Petitioner”) is currently, and will continue to be,
`
`damaged by the existence of U.S. Trademark Registration No. 4,976,071 (“Registrant’s
`
`Registration”) for the word mark “BIO-ENHANCED” (“Registrant’s Mark”), and hereby
`
`petitions to cancel Registrant’s Registration. Registrant’s Registration is owned by GeroNova
`
`Research Inc. (“Registrant”). The grounds for cancellation are as follows:
`
`1.
`
`Petitioner is a corporation having its principal place of business at 3775 Park
`
`Avenue, Edison, New Jersey 08820.
`
`2.
`
`On information and belief, Registrant, GeroNova Research Inc., is a corporation
`
`having its principal place of business at 156 Mauu Place, Haiku, Hawaii 96708.
`

`Registrant’s Registration was issued on June 14, 2016, from application serial
`
`number 86/547,686, which was filed on February 26, 2015, for “dietary supplements, nutritional
`
`supplements, herbs and herbal extracts for use as dietary supplements, plant enzymes for use as
`
`dietary supplements, vitamins and minerals for use as dietary supplements that are highly bio-
`
`available and readily absorbed into the human body” in International Class 005 (“Registrant’s
`
`Application”).

`On July 15, 2015, in response to an Office Action issued on June 9, 2015 by the
`
`United States Patent and Trademark Office, Registrant amended its application to include the
`
`filing basis of Section 1(a) of the Trademark Act. Additionally, Registrant filed a specimen,
`
`showing use of Registrant’s Mark and described the specimen as “GeroNova brand bottled
`
`products with their labels that are currently used in commerce with the Bio-Enhanced mark,”
`
`stating a first use date of July 15, 2006.
`

`
`Petitioner manufactures and sells a 35 Billion Probiotic product that includes a
`
`BEAR acronym, wherein BEAR stands for “bio enhanced acid resistant strain” (“Product”). See
`
`Exhibit A, pg. 1. Petitioner sells the Product to AlcePharma International (“Customer”), who lists
`
`the Product for sale on, and distributes the product through, Amazon.
`

`On or about March 12, 2024, Customer received a notice from Amazon informing
`
`Customer that the Amazon listing of the Product was removed due to Registrant’s accusations
`
`that Customer infringed upon Registrant’s Registration. Customer’s Amazon listing of the
`
`Product has yet to be restored.
`

`
`Consequently, Petitioner is entitled to bring a statutory cause of action under
`
`Section 14 of the Lanham Act because it is currently, and will continue to be, damaged by
`
`Registrant’s Registration due to Customer’s inability to sell its product, which directly damages
`
`Petitioner’s ability to sell the Product directly, to Customer, and to other customers.
`
`FIRST GROUND FOR CANCELLATION – GENERICNESS
`

`The term “bio-enhanced” is defined by Wiktionary as a simple past and past
`
`participle of the verb “bioenhance,” which is defined as “to biologically or biochemically
`
`enhance.” See Exhibit B, pg. 1. It is in wide use in connection with goods and services in the
`
`field of dietary and nutritional supplements. The primary significance of the word “bio-
`
`
`

`enhanced” to the relevant consuming public is merely as a generic term that refers not to a
`
`particular source of goods, but to the genus of goods that have been biologically or
`
`biochemically enhanced, because it identifies a key aspect of those goods.
`

`Registrant itself uses the word “Bio-Enhanced” to merely indicate that it is a
`
`species in the genus of goods that are biologically or biochemically enhanced – not as an
`
`indication of source. For example, a search of Registrant’s Amazon product listing for “Na R-
`
`Lipoic Acid 115mg” shows that the Registrant uses the Registrant’s Mark alongside the term
`
`“Stabilized,” in the bottom of the label and separate and away from its trademark of Geranova
`
`Research, to merely describe properties of Registrant’s product (i.e., stabilized and bio-
`
`enhanced). The positioning of the term “Bio-Enhanced” indicates that it serves as a description
`
`of a genus of goods (i.e., supplements) that has been biologically or biochemically enhanced,
`
`rather than an indication as to source. See Exhibit C, pg. 1.
`

`
`Registrant’s advertising of its product further evidences that “Bio-Enhanced” is a
`
`generic term that is merely used to describe the genus of goods. Registrant’s Amazon product
`
`listing also displays Registrant’s Mark alongside terms like “Stabilized,” “Water Soluble,”
`
`“Antioxidant,” and “Anti-Aging” in a chart describing features of Registrant’s product. See
`
`Exhibit C, pg. 3. By seeing “Bio-Enhanced” next to the aforementioned terms, consumers are
`
`likely to understand that “Bio-Enhanced” is a characteristic of its product akin to whether the
`
`product is stabilized, water soluble, or has antioxidant and anti-aging properties.
`

`Additionally, Registrant’s homepage, geronova.com, states that Registrant’s
`
`product, “Bio-Enhanced R-Lipoic Acid,” is biologically enhanced, which further shows that the
`
`term “Bio-Enhanced” merely indicates a function or quality of the product. Registrant states on
`
`its homepage that its “Bio-Enhanced® R-Lipoic Acid” product “is formulated using a unique
`
`
`

`stabilization process that ensures maximum absorption” and “GeroNova's Bio-Enhanced® R-
`
`Lipoic Acid has been shown to provide superior bioavailability, stability, and potency compared
`
`to other forms of Lipoic Acid providing a range of health benefits. This is because we convert
`
`the biologically active "R" form of Lipoic Acid to Sodium R-Lipoic Acid (Na RLA), which
`
`can achieve 10-30 times higher peak blood levels than pure, unstabilized R-Lipoic Acid (RLA).”
`
`See Exhibit D, pg. 3 (emphasis added).
`

`Other sellers of supplements regularly use the term “Bio-Enhanced” to describe a
`
`characteristic of its products. For example, Natural Factors sells supplements under its Whole
`
`Earth & Sea brand named “Vegan Bioenhanced Vitamin D3.” See Exhibit E, pg. 1. Another
`
`supplement seller, BetaHealth, also uses the term to name its product, “Orthoplex White
`
`BioEnhanced Methyl B.” See Exhibit F, pg. 1.
`

`Additionally, the term “Bio-Enhanced” is used in the fertilizer industry to describe
`
`whether the fertilizer is enhanced with supplements. For example, a fertilizer sold by Nature’s
`
`Lawn & Gardens, Inc. sells “16-4-8 Natural Liquid Fertilizer for Lawns Trees Shrubs Gardens
`
`with Humic & Fulvic Acid Kelp Molasses – Bio-Enhanced – Nature’s Lawn & Garden.” See
`
`Exhibit G, pg. 1. The seller describes this product as being “supplemented (Bio-Enhanced) with
`
`Nature’s Magic, [a] natural nutrient package.” See Exhibit G, pg. 1. The term “Bio-Enhanced”
`
`used in this context indicates a genus of goods (i.e., fertilizer) that has been biologically or
`
`biochemically enhanced with additional nutrients and does not indicate the source of the
`
`fertilizer.
`

`Furthermore, the term “Bio-Enhanced” is regularly used in other scientific
`
`literature to describe scientific processes, supplements and drugs. For example, on September 2,
`
`2013, almost two years before the application date of Registrant’s Registration, a scientific
`
`
`

`article by R.K. Pathak and R.A. Ram, entitled “Bio-enhancers: A potential tool to improve soil
`
`fertility, plant health in organic production of horticultural crops,” also defines “bio enhancers”
`
`as “organic preparations, obtained by active fermentation of animal and plant residues over a
`
`specific duration,” See Exhibit H, pg. 2. This shows that the term “bio enhancers” and its
`
`derivatives (i.e., “Bio-Enhanced”) are defined terms that were used in the scientific journals well
`
`before the application date of Registrant’s Registration.
`

`Similarly, authors Eria A. Seagren, David J. Hollander, David A. Stahl, and Bruce
`
`E. Rittmann, published an article entitled “[a]n integrated evaluation of bioenhanced in situ
`
`LNAPL dissolution.” See Exhibit I, pg. 1. In the Journal of Clinical Gastroenterology, an article
`
`was published entitled “Bioenhanced curcumin may induce remission in ulcerative colitis.” See
`
`Exhibit J, pg. 1. Authors Doaa Ahmed El-Setouhy, Emad B Basalious, and Nevine Shawky
`
`Abdelmalak published an article entitled “Bioenhanced sublingual tablet of drug with limited
`
`permeability using novel surfactant binder and microencapsulated polysorbate: In vitro/in vivo
`
`evaluation.” See Exhibit K, pg. 1. Authors Prashant P. Mande, Sagar S. Bachhav, and Padma V.
`
`Devarajan published an article entitled “Bioenhanced advanced third generation solid dispersion
`
`of tadalafil: Repurposing with improved therapy in pyelonephritis.” See Exhibit L, pg. 1. Authors
`
`Rupa Banerjee, Partha Pal, Amulya Penmetsa, Pradip Kathi, Ganesh Girish, Idan Goren, and D
`
`Nageshwar Reddy published an article entitled “Novel Bioenhanced Curcumin with Mesalamine
`
`for Induction of Clinical and Endoscopic Remission in Mild-to-Moderate Ulcerative Colitis: A
`
`Randomized Double-Blind Placebo-controlled Pilot Study.” See Exhibit M, pg. 1. Such use of
`
`the term “Bio-Enhanced” in these articles further evidences that the term is merely used to
`
`describe something as being “biologically or biochemically enhanced.”
`

`As such, the Wiktionary definition of the term “bioenhanced,” as well as the
`
`term’s use in the health supplement industries, fertilizer industries, and scientific literature
`
`illustrates that the term “Bio-Enhanced” does not identify the source of any goods. Rather, it is a
`
`common term that describes a characteristic of a product. Additionally, Registrant’s packaging
`
`and advertising of Registrant’s product further reveals that Registrant’s use of “BIO-
`
`ENHANCED” in connection with Registrant’s goods in Class 005 is merely to describe a key
`
`aspect of the Class 005 goods as something that was “biologically or biochemically enhanced.”
`
`17.
`
`In sum, “bioenhanced” is a generic term for goods in the field of dietary and
`
`nutritional supplements because it refers to a key aspect of that genus and is therefore not
`
`registrable as a trademark or service mark.
`
`18.
`
`Consequently, Registrant’s Registration should be cancelled.
`
`CONCLUSION
`

`If Registrant’s Registration is permitted to remain on the Principal Register with
`
`all the rights and privileges conferred on it by its status as a Principal Registration, Petitioner will
`
`be damaged, including its loss of sales and damaged reputation, and Registrant will enjoy
`
`unlawful gain and advantage to which it is not entitled under the Lanham Act, 15 U.S.C. §§ 1051
`
`et seq.
`
`
`
`WHEREFORE, Petitioner respectfully requests that this Petition be granted and that the
`
`Registrant’s Registration be cancelled.
