`Encinas, Carlsbad, California 92008 believes that it would be damaged by the continued
`
`registration of the above-referenced registration, and hereby petitions to cancel the same.

`PARTIES AND STANDING

`On November 30, 2023, Vuori applied to register the trademark SEDONA
`
`(“Vuori’s SEDONA Mark”) claiming goods in Class 25 in the United States, and the filing has
`
`been assigned Serial Number 98293465 (the “Application”). True and correct printouts from the
`
`USPTO website showing the current status and title of the Application is attached hereto as Exhibit
`
`A.

`Registrant Eurostar, Inc. (the “Registrant”) is a Delaware corporation with an
`
`address of 879 W. 190th Street, 12th Fl., Gardena, California 90248.

`The Registrant is the owner of record of United States Registration Number
`
`3155840 (the “Registration”) for SEDONA (the “Registrant’s SEDONA Mark”) claiming Class
`
`25 “apparel, namely, shirts and tops” goods (the “Registrant’s Goods”). True and correct printouts

`On May 7, 2024, the USPTO issued an Office Action against the Application,
`
`which refused the Application under Section 2(d) for a likelihood of confusion with the
`
`Registration.

`Vuori has used Vuori’s SEDONA Mark in United States commerce since at least
`
`as early as August 1, 2022, and believes that it will be damaged by the continued registration of
`
`the Registration.
`
`GROUNDS FOR CANCELLATION

`Vuori hereby realleges and incorporates by reference the preceding allegations of
`
`this Petition for Cancellation.
`

`
`On information and belief, the Registrant has intentionally abandoned the
`
`Registrant’s SEDONA Mark in connection with the Registrant’s Goods and has no intent to
`
`resume use of the Registrant’s SEDONA Mark. As a result, the Registrant’s SEDONA Mark has
`
`lost all capacity as a source indicator for the Registrant’s Goods.
`

`On information and belief, the Registrant and its affiliated companies are no longer
`
`using Registrant’s SEDONA Mark in connection with Registrant’s Goods, and the Registrant has
`
`not used Registrant’s SEDONA Mark for at least more than three years with no intent to resume
`
`use.
`

`The Registrant is not using the Registrant’s SEDONA Mark in connection with the
`
`Registrant’s Goods or any goods or services in the United States, and there are no SEDONA
`
`

`branded products for any goods or services offered through the Registrant’s online or brick and
`
`mortar stores in the US.
`

`As of June 2024, the Registrant’s past and current representatives and employees
`
`have stated that there are no SEDONA branded products being offered by the Registrant in
`
`connection with the Registrant’s Goods or any goods or services in the United States.
`

`
`As of June 2024, the Registrant’s past and current representatives and employees
`
`have stated that Registrant’s SEDONA Mark has been discontinued in connection with the
`
`Registrant’s Goods for at least a couple of years, or even up to seven or eight years. Therefore,
`
`Registrant cannot be using Registrant’s SEDONA Mark in connection with the Registrant’s
`
`Goods.
`

`On information and belief, the Registrant and its affiliated companies are no longer
`
`using Registrant’s SEDONA Mark in connection with Registrant’s Goods and the Registrant has
`
`not used Registrant’s SEDONA Mark for more than three years.
`

`
`On information and belief, neither Registrant nor any of its affiliated companies
`
`currently manufacture, distribute, market, advertise, license, or otherwise offer Registrant’s Goods
`
`bearing Registrant’s SEDONA Mark.
`
`15.
`
`On information and belief, the Registrant and its affiliated companies have not
`
`manufactured, distributed, marketed, advertised, licensed, or otherwise offered the Registrant’s
`
`Goods bearing the Registrant’s SEDONA Mark for more than three years.
`

`
`On information and belief, the specimen submitted by the Registrant on April 17,
`
`2017 in support of its renewal filing for the Registration under Sections 8 & 9 was fraudulent and
`
`never used in connection with the Registrant’s Goods because the Registrant had already
`
`abandoned the Registrant’s SEDONA Mark at the time of this renewal filing. This is evidenced by
`
`the fact that the submitted specimen merely shows an image of a hangtag with zero additional
`
`
`

`evidence that the hangtag was in fact used in connection with a clothing product or Registrant’s
`
`Goods.
`
`17.
`
`On information and belief, the Registrant has discontinued all use of the
`
`Registrant’s SEDONA Mark in connection with the Registrant’s Goods for over three years with
`
`an intent not to resume use, causing the Registrant’s SEDONA Mark to lose its significance as an
`
`indicator of origin for the Registrant’s Goods.
`
`18.

`The continued registration of the Registration will result in damage to Vuori and to
`
`Vuori’s rights in Vuori’s SEDONA Mark and the Application pursuant to the allegations stated
`
`herein, specifically preventing Vuori from obtaining federal registration for Vuori’s SEDONA
`
`Mark.
`
`WHEREFORE, Vuori respectfully requests that this Petition for Cancellation be
`
`sustained and that Registrant’s Registration be canceled.
