`(“Respondent”) U.S. Registration Nos. 5,668,754 and 5,668,753 for the mark LATINAS

`POWER and hereby petitions to cancel said registration based on the following grounds.

`1. Petitioner is the owner of U.S. Trademark Application No. 98/319,782 for the mark
`
`LATINAS & POWER for the following services:
`
`Business training in the field of leadership, business, and entrepreneurship;
`Conducting of symposiums in the field of leadership, business, and
`entrepreneurship; Consultancy relating to arranging and conducting of
`symposiums; Consultancy relating to arranging and conducting of training
`workshops; Consulting services in the field of leadership, business, and
`entrepreneurship training; Educational services, namely, conducting classes,

`in International Class 41. Said Application is hereinafter referred to as “Petitioner’s

`Application” and the goods are hereinafter referred to as “Petitioner’s Services”. A

`copy of the USPTO trademark database record of Petitioner’s Application is attached
`
`as Exhibit A.

`2. At all times relevant herein, Petitioner was continuously using the LATINAS &
`
`POWER Mark in United States commerce in relation to Petitioner’s Services since at
`
`least as early as 2004.
`
`3. Upon information and belief, Respondent is an individual with an address of 555 NE
`
`34th, Apt #1409 Miami, FL 33137.
`
`4. Upon information and belief, Respondent also owns and operates Latinas Power,
`
`Inc., which is registered as Florida profit corporation since April 11, 2017.
`
`5. Respondent is the owner of U.S. Registration Nos. 5,668,754 and 5,668,753 for the
`
`mark LATINAS POWER for the following services:
`
`Administering discount group purchasing programs, namely, negotiating
`contracts with providers of travel and entertainment to enable participant
`members of Latin and Hispanic women population to obtain discounts on the
`purchase of their goods or services; Analyzing and compiling business data;
`Arranging and conducting business congresses; Business management and
`organization consultancy; Charitable services, namely, promoting issues
`affecting the Latino and Hispanic community for others; Confirming scheduled
`appointments for others; Membership club services providing discounts and
`administrative processing of rebates for the services of others; On-line retail
`store services featuring subscription boxes containing clothing, cosmetics,
`jewelry, and home goods; Organizing business networking events in the field of
`Latin and Hispanic women population; Organizing chapters of a Latina and

`In International Class 41 (hereinafter “Respondent’s Registration”). A copy of the

`USPTO trademark database record and registration certificates of Respondent’s
`
`Registrations are attached as Exhibit B.

`6. Respondent’s Registrations were filed on February 10, 2018, pursuant to Section
`
`1(a) of the Trademark Act, claiming a date of first use and first use in commerce for
`
`both classes of February 27, 2015. See Exhibit B.
`
`7. Respondent’s Registration is not incontestable as it has been registered for less than
`
`five years and accordingly can be challenged for any grounds recited in 15 U.S.C.
`
`§1064.
`
`CLAIM FOR CANCELLATION

`8. Petitioner realleges and incorporates by reference the preceding allegations of its
`
`Petition for Cancellation.

`9. Petitioner’s use of the LATINAS & POWER Mark in relation to Petitioner’s Services
`
`has been valid and continuous in the United States since at least as early as 2004
`
`and has not been abandoned.
`
`10. Pursuant to its application filed on February 10, 2018, Respondent’s date of first use
`
`in commerce of the LATINAS POWER Mark is February 27, 2015. See Exhibit B.
`
`11. Upon information and belief, Petitioner’s first use of the LATINAS & POWER Mark
`
`precedes Respondent’s first use, first use in commerce and/or its priority of the
`
`LATINAS POWER Mark in the United States.

`Mark in that the prima facie effect of registration would tend to impair Petitioner’s

`
`Mark in that the prima facie effect of registration would tend to impair Petitioner’s

`right to register its LATINAS & POWER Mark with the USPTO.

`14. Respondent’s Registration is not incontestable as it has been registered for less than
`
`five years and accordingly can be challenged for any grounds recited in 15 U.S.C.

`for U.S. Registration Nos. 5,668,754 and 5,668,753 for the mark LATINAS POWER

`under the personal name of Padin Zulmarie.

`17. Upon in formation and belief, U.S. Registration Nos. 5,668,754 and 5,668,753
`
`identify the incorrect owner and should have been filed in the corporate name
`
`Latinas Power, Inc., a Florida profit corporation.
`
`18. Latinas Power, Inc. was created and established in Florida on April 11, 2017.
`
`19. Pursuant to TMEP §1201.02(c), where a president or owner of a corporation is
`
`identified when in fact the corporation owns the mark, the application is void as
`
`filed because Padin Zulmarie is not the owner of the mark.
`
`20. Upon information and belief, Latinas Power, Inc. at all times relevant herein is the
`
`correct owner of U.S. Registration Nos. 5,668,754 and 5,668,753, not Padin
`
`Zulmarie. As a result, said registrations are void.
