`Carolina Racing Supply, Inc. (hereinafter “Petitioner”) believes it is or will be

`damaged by registration on the principal register of Registration No. 2599292 for the mark
`
`TOMCAT, and therefore petitions to cancel the same. In support of this Petition to Cancel,
`
`Petitioner alleges the following:
`
`1.
`
`Petitioner – Carolina Racing Supply Inc. – is a North Carolina corporation
`
`located at 117 Magnolia Park Drive, Mooresville, North Carolina, 28117.
`
`2.
`
`According to current TSDR records, Respondent – China Manufacturers
`
`Alliance, LLC (hereinafter “Respondent”) – is a California corporation located at
`
`406 East Huntington Drive, Suite 200, Monrovia, California, 91016.
`
`Factual Background
`
`3.
`
`On or about October 2002, Petitioner began using the name TOMCAT and
`
`an associated logo
`
`(hereinafter “Petitioner’s Mark”) to market and sell a
`
`variety of high-performance auto racing products. Included in Petitioner’s product
`
`offerings under Petitioner’s Mark are metal fasteners such as bolts and nuts, engine
`
`components such as valve covers and distributors, vehicle suspension devices, axles,
`

`vehicle body panels, vehicle brake components, and vehicle steering systems. Full

`listings and descriptions of each of Petitioner’s individual products may be found on

`On or about November 22, 2022, Petitioner filed an application to register the
`
`TOMCAT Mark in logo form (
`
`- Application Serial No. 978688460,
`
`hereinafter “Petitioner’s Logo Application”) in conjunction with “Wholesale store
`
`services featuring chassis component parts for circle track racing builds. The chassis
`
`component parts not including tires.; On-line wholesale store services featuring
`
`chassis component parts for circle track racing builds. The chassis component parts
`
`not including tires” in Class 035.
`
`5.
`
`On or about September 5, 2023, Petitioner’s Logo Application was refused
`
`registration on the Principal Register on the grounds of likelihood of confusion with
`
`Respondent’s Registration No. 2599292 for the mark TOMCAT applied to “Tires”
`
`in International Class 012.
`
`6.
`
`On or about October 11, 2023, Petitioner filed an application to register the
`
`TOMCAT Mark in standard characters (Application Serial No. 98218242,
`
`hereinafter “Petitioner’s Name Application”) in conjunction with:
`
`a. “Hinges of metal; Metal fasteners, namely, bolts, nuts, washers, pins, clips,
`
`rivets; Metal mounting brackets for general use; Reservoirs of metal” in
`
`International Class 007;
`
`b. “Abrasive disks for power-operated grinders; Air filters for automobile
`
`engines; Automobile engine valve covers; Automobile oil pans; Belts for
`

`engines; Compressed air pumps; Distributors for vehicles; Engine exhaust
`
`tips; Engine mufflers; Fans for machine engines; Filter elements for fuel
`
`filters; Fuel filters; Internal combustion engines land vehicle parts, namely,
`
`distributor caps; Oil filter adapters; Power drill bits; Rivet guns; Spark plug
`
`ignition wires; Starter motors; Vehicle engine parts, namely, crankcase
`
`breathers; Water pumps for motors and engines” in International Class 007;
`
`and
`
`c. “Automobile suspension devices, namely, coilovers; Automobile suspension
`
`system components, namely, spring perches; Axles for vehicles; Bearings, as
`
`parts of vehicles; Belt pulleys for land vehicles; Body panels for vehicles;
`
`Brake calipers for land vehicles; Brake lines for vehicles; Brake rotors for
`
`land vehicles; Brakes for land vehicles; Caps for vehicle fuel tanks; Clutches
`
`for land vehicles; Gear shifts; Gears for vehicles; Hub caps for wheels; Main
`
`brake cylinders; Rear view mirrors; Spindles for land vehicles; Steering and
`
`suspension systems and parts for steering and suspension systems for
`
`vehicles, namely, upper ball joints, lower ball joints, ball joints with control
`
`arms, bushing kits, inner tie rod ends, outer tie rod ends, sleeves, idler arms,
`
`center links, stabilizer kits, inner sockets and pitman arms; Steering wheels
`
`for vehicles; Universal joints for land vehicles; Valve stems for vehicle tires;
`
`Vehicle bumpers” in International Class 012.

`On March 22, 2001, Respondent filed Application Serial No. 76228517 to
`
`register the mark “TOMCAT” for “Tires” in International Class 012 (hereinafter
`
`“Respondent’s Application”). Respondent’s Application was originally based on
`

`Respondent’s asserted intent
`
`to use the mark in interstate commerce under
`
`Trademark Act § 1(b).
`
`8.
`
`Respondent’s Application was approved, and a registration certificate was
`
`issued, on July 23, 2002 as United States Registration No. 2,599,292 (hereinafter
`
`“Respondent’s Registration”) with an asserted date of first use anywhere of October
`
`15, 2001, and an asserted date of first use in commerce of October 31, 2001.
`
`9.
`
`Most recently, on November 7, 2022, Respondent submitted a Combined
`
`Declaration of Use and/or Excusable Nonuse and Application for Renewal of
`
`Respondent’s Mark under Sections 8 & 9 of the Trademark Act along with a single
`
`specimen allegedly demonstrating use of Respondent’s TOMCAT trademark on a
`
`tire. The Office accepted Respondent’s Section 8 & 9 filing on May 25, 2023.
`
`Standing
`
`10.
`
`Petitioner has standing in this proceeding because it believes it is, and will
`
`continue to be, damaged by registration on the principal register of the TOMCAT
`
`Registration by virtue of being refused registration of Petitioner’s Logo Application
`
`on the basis of asserted likelihood of confusion with the Mark set forth in
`
`Respondent’s Registration.
`
`Claim One – Abandonment – Trademark Act § 14(3)
`
`11.
`
`Petitioner re-alleges and incorporates by reference Paragraphs 1 to 10.
`
`12.
`
`Assuming, arguendo, that Respondent at one time did utilize its TOMCAT
`
`trademark in United States commerce in connection with tires, such use has long
`
`since been abandoned by Respondent. Attached hereto as Exhibit A is the
`
`Investigator’s Report of Matthew Hewlett, a licensed investigator who conducted a
`

`complete and thorough search for any use of Respondent’s TOMCAT trademark in
`
`United States commerce in association with tires. According to Hewlett, “Our
`
`investigation … has produced no current use of [the Mark set forth in Respondent’s
`
`Registration] in the U.S. by [Respondent].”1
`
`13.
`
`Respondent has neither advertised nor sold the goods listed in Respondent’s
`
`Registration using the TOMCAT trademark in commerce in the U.S. in the three-
`
`year period before filing of this petition. Evidence of this includes:
`
`a. The lack of any use of the TOMCAT trademark on Respondent’s website,
`
`cmaintl.com.2
`
`b. The lack of any use of the TOMCAT trademark on Respondent’s social
`
`media channels – including LinkedIn3, Facebook4, and YouTube.5
`
`c. The lack of a DOT code 101 for Respondent’s TOMCAT tires.6
`
`d. The lack of any product descriptions listing the TOMCAT trademark in
`
`import records for Respondent.7
`
`14.
`
`In fact, Hewlett’s repeated attempts to contact Respondent and Respondent’s
`
`known suppliers to obtain information regarding available tires and tire brands for
`
`sale in the United States went unreturned.8
`
`15.
`
`In addition, Petitioner notes that, while a specimen of use was provided to the
`
`Office ostensibly showing use of Respondent’s TOMCAT mark in U.S. commerce
`

`on a tire on November 7, 2022, such specimen appears to be nothing more than a 3
`
`dimensional rendering of a tire with the word TOMCAT on the sidewall. That is to
`
`say that, at least as early as November 7, 2022, Respondent was not making use of –
`
`and had therefore abandoned – the TOMCAT trademark in association with tires
`
`such that no specimen of use in conjunction with actual tires was available to submit
`
`with Respondent’s Section 8 and 9 filing.
`
`16.
`
`Therefore, Respondent’s Registration should be cancelled on the basis of
`
`Respondent’s abandonment of the mark set forth therein under Trademark Act
`
`§ 14(3) with intent not to resume such use.
`
`Claim Two – Registration Was Obtained Fraudulently – Trademark Act § 14(3)
`
`17.
`
`Petitioner re-alleges and incorporates by reference Paragraphs 1 to 16.
`
`18.
`
`Petitioner further notes that the specimen of use included in Respondent’s
`
`November 7, 2022 Section 8 and 9 filing appears to be nothing more than a 3
`
`dimensional rendering of a tire with the word TOMCAT on the sidewall thereof.9
`
`That is to say that the specimen of use does not show actual use of the mark in
`
`commerce in conjunction with the registered goods.
`
`19.
`
`In the November 7, 2022 Section 8 and 9 filing, Respondent – via counsel
`
`Barry Scholl – made the following statements:
`
`Unless the owner has specifically claimed excusable nonuse,
`the mark is in use in commerce on or in connection with the
`goods/services or
`to indicate membership in the collective
`membership organization identified above, as evidenced by the
`attached specimen(s). (emphasis added).
`
`and
`

`Unless the owner has specifically claimed excusable nonuse,
`the specimen(s) shows the mark as currently used in commerce
`on or in connection with the goods/services/collective membership
`organization (emphasis added)
`
`Such statements were signed by Respondent’s counsel, under penalty for false
`
`statement or fine or imprisonment, or both. Specifically, it contained the following
`
`declaration, in part:
`
`The signatory being warned that willful false statements and
`the like are punishable by fine or imprisonment, or both, under
`18 U.S.C. § 1001, and that such willful false statements and the like
`may jeopardize the validity of this submission and the registration,
`declares that all statements made of his/her own knowledge are true
`and all statements made on information and belief are believed to be
`true. (emphasis added)
`
`Upon information and belief, such information and belief likely to be confirmed via
`
`information obtained through discovery and/or further investigation, upon signing the
`
`Section 8 and 9 filing, Respondent – through counsel – was aware of the serious
`
`consequences of making a false statement therein. Thus, upon information and belief,
`
`such information and belief likely to be confirmed via information obtained through
`
`discovery and/or further investigation, Respondent’s alleged false statements (related
`
`to continued use of the mark and the specimen submitted as evidence thereof) were,
`
`as a consequence, made knowingly with the intent to deceive the USPTO and/or were
`
`made in reckless disregard of the truth or falsity of those statements.
`

`
`Further, upon information and belief, such information and belief likely to be
`
`confirmed via information obtained through discovery and/or further investigation,
`
`but for Respondent’s alleged false statement in the Section 8 and 9 filing on
`
`November 7, 2022, Respondent would not have been awarded renewal of
`

`Respondent’s Registration. Thus, Respondent’s alleged false statements were
`
`necessarily statements of material fact.
`
`21.
`
`Thus, based on the foregoing, upon information and belief, such information
`
`and belief likely to be confirmed via information obtained through discovery and/or
`
`further investigation, in falsely declaring use of Respondent’s TOMCAT trademark
`
`in United States commerce in the Section 8 and 9 when it did not have such use,
`
`Respondent committed fraud on the USPTO by making knowingly false statements
`
`of material fact with the intent to deceive the USPTO and/or in reckless disregard of
`
`the truth or falsity of those statements.
`
`22.
`
`Therefore, Respondent’s Registration should be cancelled under Trademark
`
`Act § 14(3) on the basis of Respondent having fraudulently renewed Respondent’s
`
`Registration.
`
`Relief Sought
`
`For the foregoing reasons, this petition should be sustained, and Registration No.
`
`2599292 should be cancelled from the Principal Register.
`
`The required fee accompanies this Petition to Cancel. Should this fee be found
`
`insufficient for any reason, please charge any additional fees to Deposit Account No. 50-
`
`3651. Please direct all correspondence to counsel for Petitioners at the address indicated

`On October 24, 2023, I located a Press Release dated 06/15/2020 indicating Double Coin and
`CMA, a leading tire manufacturer and marketer, was pleased to announce its new strategic
`partnership with the Independent Tire Dealer Group (ITDG). According to the press release,
`Double Coin tires are supplied by CMA, LLC, which is based in Monrovia, California and is a
`subsidiary of Shanghai Huayi Group Corporation Ltd. [See Attachment #6]

`Between October 24, 2023 and November 10, 2023, using a suitable approach, I made numerous

`response has been received to my inquiries.
`
`Also between October 24, 2023 and November 10, 2023, using a suitable approach, I placed
`numerous call to Double Coin in the U.S., Tel: 877-573-3545 and left my contact details regarding
`purchasing tires. I also submitted an inquiry via the website contact form for doublecointires.com
`regarding available tire brands. To date, no responses have been received to my inquiries.
`
`CONCLUSION
`Our investigation to date has produced no current use of the TOMCAT mark [USPTO Reg.
`2599292] in the U.S. by China Manufacturers Alliance, LLC of Monrovia, CA. No reference to
`TOMCAT tires was located on websites or social media pages for China Manufacturers Alliance,
`LLC or related entities, Huayi Group (Thailand) Company Limited and Double Coin Holdings, Ltd.
`
`Jeffrey Banyas has been updated with the above information and this investigation will continue
`only at his request.
