`14 of the Trademark Act of 1946 (15 U.S.C. § 1064). As grounds for cancellation, it is alleged
`
`that:
`
`1.
`
`Petitioner VPR is a national and international distributor of electronic cigarettes,
`

`vaping supplies, and accessories therefor.
`
`2.
`
`VPR is a market leader and pioneer engaged in product development for the
`
`vaping market, including e-liquids, vaporizers, and electronic cigarettes (also known as e-
`
`cigarettes) which are devices that deliver nicotine, cannabis or other substances through
`
`atomization or vaping, and without smoke and other chemical constituents typically found in
`
`traditional products.
`
`3.
`
`VPR is in the business of creating, designing, and distributing innovative
`
`electronic cigarette technologies and other related technologies. VPR is also in the business of
`
`creating valuable e-cigarette brands.
`
`4.
`
`VPR has been successful in building valuable intellectual property due, at least in
`
`part, to the extensive experience of CEO Kevin Frija’s extensive experience in the e-cigarette
`
`industry. Frija began working in the e-cigarette business in 2008. In 2009, Frija became the
`
`President and Chief Executive Officer of Vapor Corp., one of the first U.S. importers and first
`
`publicly traded electronic cigarette companies. Frija helped grow Vapor Corp. into one of the
`
`largest and most recognized electronic cigarette companies at the time.
`

`
`Beginning on November 24, 2017, VPR began marketing a line of electronic
`
`cigarettes and electronic cigarette accessories under the ELF brand name and logo. On
`
`November 24, 2017, VPR first used the ELF mark in commerce in connection with VPR’s sale
`
`of electronic cigarettes and accessories.

`On June 5, 2018, VPR obtained the United States Trademark Registration No.
`
`5,486,616 for ELF in International Class 34 for use in connection with “Electronic cigarette
`
`lighters; Electronic cigarettes; Smokeless cigarette vaporizer pipe.” (the “ELF Mark” or “’616
`
`Registration”).
`
`7.
`
`VPR’s ELF Mark is entitled to a presumption of validity. 15 U.S.C. § 1057(b); 15
`
`U.S.C. § 1115(a); see also Welding Servs., Inc. v. Forman, 509 F.3d 1351, 1357 n.3 (11th Cir.
`
`2007) (“Registration establishes a rebuttable presumption that the marks are protectable or
`
`‘distinctive.’”).
`
`8.
`
`ELF is an arbitrary mark that had no significance in the electronic cigarette
`
`business prior to VPR’s usage of the mark. Because the ELF Mark is an arbitrary mark it
`
`deserves greater trademark protection.
`
`9.
`
`VPR currently markets two product lines under the ELF brand. One product line
`
`consists of the ELF Original Auto Draw Conceal Kit products. The ELF Original Auto Draw
`
`Conceal Kit is a reusable (non-disposable) bar-shaped e-cigarette featuring a buttonless design,
`
`high-capacity battery, and a high-end aluminum body in a variety of colors. The ELF Original
`
`Auto Draw Conceal Kit is compatible with all industry standard refillable 510 mouthpieces.
`
`10.
`
`Registrant IMIRACLE (HK) LIMITED (“iMiracle”) is a Hong Kong Limited
`
`Liability Company that has its principal place of business in Hong Kong.
`
`11.
`
`iMiracle is an affiliated entity to Shenzhen Weiboli Technology Co. Ltd.
`
`(“Weiboli”) which is a Chinese Limited Company with its principal place of business at CHINA
`
`RM 312, Tianshuzuo, No. 6099 Bao'an Avenue, Bao'an District, Shenzhen, CHINA 518000.
`

`iMiracle and Weiboli are manufacturers or distributors of e-cigarettes.

`iMiracle is the listed owner of the ‘255 Registration, for use in connection with
`
`“Cigarettes; Cigarette holders; Devices for heating tobacco for the purpose of inhalation;
`
`Electronic cigarette cases; Electronic cigarette liquid (e-liquid) comprised of flavorings in liquid
`
`form, other than essential oils, used to refill electronic cigarette cartridges; Electronic cigarettes;
`
`Electronic cigarettes for use as an alternative to traditional cigarettes; Flavourings, other than
`
`essential oils, for use in electronic cigarettes; Liquid nicotine solutions for use in electronic
`
`cigarettes; Oral vaporizers for smokers; Electronic cigarette refill cartridges sold empty” in
`
`International Class 34.
`
`14.
`
`iMiracle sold ELFBAR disposable electronic cigarettes to its distributor and retail
`
`customers nationwide.
`
`15.
`
`iMiracle has asserted the ‘255 Registration in numerous trademark infringement
`
`actions against sellers and distributors of ELFBAR products in cases in the Southern and Middle
`
`Districts of Florida. (See Exhibit 1).
`
`16.
`
`In all the trademark infringement cases that iMiracle filed listed in Exhibit 1,
`
`iMiracle claimed that the logo mark shown above that is the subject of the ‘255 Registration was
`
`being infringed alongside and with an unregistered name ELFBAR. The complaints filed by
`
`iMiracle in all of its cases refer to the ‘255 Registration above as the ELFBAR mark. iMiracle
`
`uses the logo mark that is the subject of the ‘255 Registration alongside and concurrently with
`
`the unregistered name ELFBAR and DESIGNED BY ELFBAR. (See Exhibit 2).
`
`17.
`
`The judicial admissions made by iMiracle in all the complaints for trademark
`
`infringement filed in the Southern and Middle Districts of Florida demonstrate that iMiracle
`
`knows and expects that consumers use the electronic cigarettes sold with the logo mark that is
`
`the subject of the ‘255 Registration above for the consumption of nicotine. For example, iMiracle
`

`asserts that it “has worked to distinguish the ELFBAR brand as the premier manufacturer of
`
`disposable E-cigarette Vapes by emphasizing the brand’s unwavering use of quality materials
`
`and focusing on scientific principles which facilitate a superior smoking experience. It is
`
`precisely because of the unyielding quest for quality and unsurpassed innovation that ELFBAR
`
`branded products have a significant following and appreciation among consumers in the United
`
`States and internationally. As a result of the continuous and extensive use of the trademark
`
`“ELFBAR,” IMIRACLE was granted both valid and subsisting federal statutory and common
`
`law rights to the ELFBAR trademark.” ELFBAR products are extremely popular and, according
`
`to iMiracle and Weiboli, they account for a substantial portion of those companies’ overall
`
`profits. (See Exhibit 2).
`
`18.
`
`On October 13, 2022, VPR filed a complaint in the Southern District of Florida,
`
`Case No. 9:22-cv-81576-AMC, for trademark infringement, unfair competition, and patent
`
`infringement against eight defendants (the “Litigation”). The defendants include the
`
`manufacturer of ELFBAR products, and seven distributors of ELFBAR products. Petitioner
`
`claimed, among other claims, that defendants infringe Petitioner’s Registration No. 5,486,616 for
`
`ELF for “Electronic cigarette lighters; Electronic cigarettes; Smokeless cigarette vaporizer pipe”
`
`in International Class 34.
`
`19.
`
`October 14, 2022, VPR filed a motion for preliminary injunction in the Litigation.
`
`On February 23, 2023, District Judge Aileen Cannon issued an order granting Registrant’s
`
`motion for preliminary injunction. (See Exhibit 3).
`
`20.
`
`iMiracle is currently a defendant in a related trademark infringement case in the
`
`Southern District of Florida for infringement of VPR’s ELF ‘616 Mark. (See Exhibit 4).

`21.
`
`In the trademark infringement case pending in the Southern District of Florida,
`
`VPR filed a motion for preliminary injunction. (See Exhibit 5).
`
`22.
`
`The actions of iMiracle are causing significant harm to VPR.
`
`23.
`
`iMiracle’s use of the logo mark that is the subject of the ‘255 Registration
`
`alongside and in connection with the unregistered and infringing ELFBAR name and on the
`
`ELFBAR and related products has caused VPR harm because iMiracle should not be permitted
`
`to use the ‘255 Registration in connection with unlawful uses in commerce.
`
`24.
`
`Thus, Petitioner is being damaged by Registrant’s ‘255 Registration, thereby
`
`establishing standing to bring this proceeding.
`
`25.
`
`On March 7, 2021, Registrant filed U.S. Application Serial No. 90564668 under
`
`Section 1(a) of the Lanham Act, seeking to register the logo mark shown above (“Registrant’s
`
`Mark”) for “Cigarettes; Cigarette holders; Devices for heating tobacco for the purpose of
`
`inhalation; Electronic cigarette cases; Electronic cigarette liquid (e-liquid) comprised of
`
`flavorings in liquid form, other than essential oils, used to refill electronic cigarette cartridges;
`
`Electronic cigarettes; Electronic cigarettes for use as an alternative to traditional cigarettes;
`
`Flavourings, other than essential oils, for use in electronic cigarettes; Liquid nicotine solutions
`
`for use in electronic cigarettes; Oral vaporizers for smokers; Electronic cigarette refill cartridges
`
`sold empty” in International Class 34, alleging a date of first use of July 8, 2020 (the “‘668
`
`Application”).
`
`26.
`
`In the ‘668 Application, Registrant’s President provided a sworn declaration that
`
`“[t]he mark is in use in commerce in connection with all of the goods/services” listed in the ‘668
`
`Application, that willful false statements “may jeopardize the validity of the application or
`
`submission or any registrations resulting therefrom,” and “that all statements made of his/her
`

`own knowledge are true and that all statements made on information and belief are believed to be
`
`true.”
`
`27.
`
`The ‘668 Application matured into the ‘255 Registration on November 9, 2021.
`
`28.
`
`iMiracle has marketed numerous products using the logo mark and the ELFBAR
`
`name concurrently.
`
`29.
`
`All of iMiracle’s products using the logo mark and ELFBAR name are vaporizers
`
`sold with nicotine containing e-liquid.
`
`30.
`
`The United States Patent and Trademark Office requires that trademark owners
`
`comply with other laws when selling goods under trademarks for which a party seeks federal
`
`registration, i.e., the sale must be “lawful.”
`
`31.
`
`Under this rule, the USPTO, and in turn the TTAB, is empowered to refuse
`
`registration, or to cancel registrations, based on other laws that fall outside of the purview of the
`
`Lanham Act.
`
`32.
`
`Electronic cigarettes, also known as “e-cigarettes,” “vapor products,” and
`
`“electronic nicotine delivery systems” or “ENDS,” are regulated by the U.S. Food and Drug
`
`Administration (“FDA”) under the Federal Food, Drug and Cosmetic Act (“FDCA”). See
`
`Nicopure Labs, LLC v. FDA, 944 F.3d 267, 273 n.1 (D.C. Cir. 2019).
`
`33.
`
` In 2009, Congress modified the FDCA to grant FDA authority over tobacco
`
`products for the first time by enacting the Family Smoking Prevention and Tobacco Control Act
`
`of 2009 (“TCA”), Pub. L. No 111-31, 123 Stat. 1776 (2009).
`
`34.
`
`The TCA, as originally enacted, defined a “tobacco product” in relevant part as
`
`“any product made or derived from tobacco that is intended for human consumption, including
`
`any component, part, or accessory of a tobacco product.” 21 U.S.C. § 321(rr) (2009).
`

`35.
`
`Under Section 901 of the FDCA, the TCA’s requirements applied only to
`
`cigarettes, cigarette tobacco, roll-your-own tobacco, and smokeless tobacco. 21 U.S.C. §
`
`387a(b).
`
`36.
`
`The TCA’s requirements would only apply to other products satisfying the
`
`statutory definition of a “tobacco product” if the Secretary of Health and Human Services “by
`
`regulation deem[ed]” such products to be “tobacco products.” 21 U.S.C. § 387a(b).
`
`37.
`
`Seven years later, FDA finalized its so-called “Deeming Rule” that, for the first
`
`time, deemed electronic cigarette products containing or intended to be used with nicotine
`
`derived from tobacco plants to be “tobacco products.” See FDA, Deeming Tobacco Products To
`
`Be Subject to the Federal Food, Drug, and Cosmetic Act, as Amended by the Family Smoking
`
`Prevention and Tobacco Control Act; Regulations on the Sale and Distribution of Tobacco
`
`Products and Required Warning Statements for Tobacco Products, 81 Fed. Reg. 28973 (May 10,
`
`2016) (codified at 21 C.F.R. § 1143.1).
`
`38.
`
`The Deeming Rule took effect on August 8, 2016, and since that date, all
`
`electronic cigarettes, including devices that are sold without any nicotine-containing solution, or
`
`“e-liquid,” are subject to the requirements of the FDCA. See 21 C.F.R. § 1140.3.
`
`39.
`
` Among these requirements, Section 910 of the FDCA requires that any tobacco
`
`product that was not commercially marketed as of February 15, 2007, receive a marketing
`
`authorization order from FDA prior to being commercially marketed in the United States. 21
`
`U.S.C. § 387j.
`
`40.
`
`To obtain a marketing authorization order, manufacturers of electronic cigarette
`
`products are required to submit a premarket tobacco product application (“PMTA”). See 81 Fed.
`
`Reg. 28990-97.
`

`41.
`
`However, because thousands, if not millions, of electronic cigarette products were
`
`already commercially marketed in the United States as of the Deeming Rule’s effective date, in
`
`the Deeming Rule’s preamble, FDA introduced a discretionary enforcement policy that allowed
`
`for delayed compliance periods for electronic cigarettes. See id. at 29009-15.
`
`42.
`
`Under this discretionary enforcement policy, PMTA submissions were originally
`
`required to be filed in 24 months, or by August 8, 2018. Id. at 28977-78, 29011.
`
`43.
`
`Although they were technically “adulterated” under the FDCA upon the effective
`
`date of the Deeming Rule because they lacked marketing authorization, 21 U.S.C. § 387b(6)(A),
`
`electronic cigarettes already on the U.S. market would not be subject to FDA enforcement action
`
`in the meantime or while a timely submitted PMTA was pending FDA review. Id.
`
`44.
`
`FDA’s deadline for the submission of PMTAs under its discretionary enforcement
`
`policy changed multiple times over the succeeding years, but ultimately FDA specified that
`
`electronic cigarette products for which a PMTA was submitted by September 9, 2020, could
`
`continue to be commercially marketed for a period of up to one year after September 9, 2020,
`
`provided that the PMTA remained pending. See Vapor Technology Ass’n v. FDA, 977 F.3d 496,
`
`497-502 (6th Cir. 2020).
`
`45.
`
`FDA requires a marketing authorization order for electronic cigarettes.
`
`46.
`
`If an electronic cigarette, subject to the Deeming Rule came on the market after
`
`August 8, 2016, it was required to obtain marketing authorization from FDA prior to being sold.
`
`21 U.S.C. § 387j.
`
`Count 1 - ILLEGALITY
`
`47.
`
`Petitioner incorporates by reference the allegations of Paragraphs 1 - 46 as if fully
`
`set forth herein.

`Under the “lawful use in commerce” doctrine, the sale of goods in violation of a
`
`federal statute or regulation renders a federally registered trademark unenforceable.
`
`49.
`
`Ownership of a legally protectable trademark requires lawful use of the
`
`trademark; only lawful use of a trademark can establish trademark priority and enforceable
`
`trademark rights.
`
`50.
`
`A per se violation of a statute regulating the sale of a party’s goods constitutes
`
`sufficient grounds for finding unlawful use.
`
`51.
`
`Pursuant to iMiracle’s own judicial admissions in connection with its filings for
`
`trademark infringement in the Southern and Middle District of Florida, iMiracle knows and
`
`expects that consumers have used and will use ELFBAR products sold with the logo shown
`
`above that is the subject of the ‘255 Registration for the consumption of nicotine.
`
`52.
`
`Accordingly, iMiracle’s electronic cigarettes sold with the logo shown above that
`
`is the subject of the ‘255 Registration fall within the definition of “tobacco product” and are
`
`subject to the FDCA and FDA regulation.
`
`53.
`
`Because iMiracle’s electronic cigarettes sold with the logo shown above that is
`
`the subject of the ‘255 Registration were not sold in the United States until well after the
`
`effective date of the Deeming Rule, they required a marketing authorization order from FDA
`
`before they could be sold and are not subject to the FDA’s deferred enforcement policy.
`
`54.
`
`iMiracle’s electronic cigarettes sold with the logo shown above that is the subject
`
`of the ‘255 Registration have not been the subject of an application for marketing authorization
`
`and have not obtained a marketing authorization order.
`
`55.
`
`iMiracle’s electronic cigarettes sold with the logo shown above that is the subject
`
`of the ‘255 Registration are adulterated and unlawfully marketed in violation of the FDCA
`

`because they are not subject to FDA’s deferred enforcement policy and iMiracle did not obtain
`
`marketing authorization before their sale in the United States, nor has iMiracle applied for
`
`marketing authorization for the products from FDA.
`
`56.
`
`Because iMiracle introduced its electronic cigarette products bearing the logo
`
`shown above that is the subject of the ‘255 Registration well after August 8, 2016, and they have
`
`no FDA marketing authorization order, the goods sold by Registrant under the logo shown above
`
`that is the subject of the ‘255 Registration are “adulterated” under the FDCA, 21 U.S.C. §
`
`387b(6)(A), and their introduction or delivery into commerce is prohibited, 21 U.S.C. § 331(a).
`
`57.
`
`iMiracle’s electronic cigarettes sold with the logo shown above that is the subject
`
`of the ‘255 Registration is a per se violation of the FDCA.
`
`58.
`
`Because iMiracle’s sale of electronic cigarettes with the logo shown above that is
`
`the subject of the ‘255 Registration a per se violation of the FDCA, iMiracle has no lawful and
`
`enforcement trademark rights in the logo shown above that is the subject of the ‘255
`
`Registration, and consequently the ‘255 Registration should be cancelled.
`
`Count 2 - FRAUD ON THE USPTO
`
`59.
`
`Petitioner incorporates by reference the allegations of Paragraphs 1-58 as if fully
`
`set forth herein.
`
`60.
`
`Registrant attested in Sworn Declarations in connection with the ‘668 Application
`
`that Registrant’s Mark was in used in connection with all of the goods identified in the ‘668
`
`Application, and that it was the lawful owner of that mark.
`
`61.
`
`Registrant did not disclose to the USPTO that at the time it made those
`
`declarations it was not using the logo shown above that is the subject of the ‘255 Registration in
`
`a lawful manner, and thus was not entitled to a trademark registration therefor.

`Registrant knew at the time it submitted these sworn declarations that Registrant’s
`
`Mark had not been used in United States commerce in connection with lawfully marketed goods.
`
`63.
`
`Registrant knew the materiality of this omitted fact.
`
`64.
`
`Upon information and belief, Registrant’s false statements and omissions were
`
`made knowingly, with the intent to procure and maintain a registration to which Registrant was
`
`not entitled, and Registrant was successful in procuring and maintaining such registration, and
`
`the USPTO relied on these misstatements by omission.
`
`65.
`
`Petitioner has been damaged as a consequence of the foregoing.
`
`66.
`
`Consequently, the Registrant’s Registration for the logo shown above that is the
`
`subject of the ‘255 Registration should be cancelled pursuant to Section 14(3) of the Lanham
`
`Act, 15 U.S.C. § 1064(3).
`
`Count 3 - LACK OF BONA FIDE USE
`
`67.

`Petitioner hereby incorporates by reference the allegations of Paragraphs 1-66 as

`if fully set forth herein.

` Registrant repeatedly attested in Sworn Declarations in connection with the ‘668

`Application that the Registered Mark had been used in connection with all of the goods cited
`
`therein as of November 21, 2017.

`Petitioner is being damaged by the registration of Registrant’s mark because

`with the unregistered name ELFBAR that infringes upon VPR’s ELF Mark, and it has failed to

`distinguish between the ‘255 Registration and the infringing use of VPR’s ELF mark.
