`On April 24, 2024, the Board issued an order addressing several of the parties’
`
`recent submissions. At the end of that order, the Board acknowledged the filing of
`
`Petitioner’s motion to suspend pending other Board proceedings and suspended this
`
`case pending disposition of that motion. Moreover, the Board stated that “[w]ith the
`
`exception of the submission of Respondent’s amended answer and counterclaims (and
`
`the requisite fees), the parties should not file any papers that are not germane to the
`
`motion to suspend.” (31 TTABVUE 14).
`
`Notwithstanding the foregoing, it appears from the docket that while the Board’s
`
`April 24, 2024 order was in the process of posting to TTABVUE, three new
`
`submissions were filed: (i) Petitioner’s public-facing motion to compel; (ii) Petitioner’s
`
`confidential motion to compel; and (iii) Respondent’s response in opposition to
`
`Petitioner’s previously-filed “Motion For Default Judgment.”

`In view of the Board’s April 24, 2024 order, Respondent’s opposition to Petitioner’s
`
`“Motion For Default Judgment” is moot and will receive no consideration.
`
`Furthermore, because proceedings are now suspended pending disposition of
`
`Petitioner’s motion to suspend, Petitioner’s motion to compel is denied without
`
`prejudice to Petitioner’s ability to renew its motion, if appropriate, upon resumption.1
`
`Proceedings remain suspended pending disposition of Petitioner’s motion to
`
`suspend. With the exception of the submission of Respondent’s amended answer and
`
`counterclaims (and the requisite fees), the parties should not file any papers that
`
`are not germane to the motion to suspend.
`
`
`1 As stated in the Board’s April 24, 2024 order, the Board will reach out to the parties via
`email to schedule a telephone conference to address the confidentiality issue related to
`Respondent’s motion for leave to amend.
