`Crawford Ventures, Inc., a New York corporation with a place of business in New
`
`York City, New York (“Crawford Ventures” or “Petitioner”) believes that it is being
`
`damaged by the continued registration of the mark THE CRAWFORD SOLUTION, U.S.
`
`Registration No. 4,928,053 (“Respondent’s Mark” or “Registration ‘053”) for, in
`
`pertinent part, “employee recruiting and placement services; personnel management
`
`consultancy; business risk management consultancy relating to the administration of
`
`employee benefit plans and management of medical leave of absence” in Class 35
`
`(“Respondent’s Employee Services”), and hereby seeks to partially cancel the registration
`
`for Respondent’s Mark, namely in connection with Respondent’s Employee Services.

`As grounds for this partial cancellation, Petitioner hereby alleges:

`Respondent’s THE CRAWFORD SOLUTION Registration

`
`Upon information and belief, Respondent is a Georgia corporation,
`
`with a place of business at 1001 Summit Boulevard, Atlanta, Georgia 30319.
`
`
`

`
`On April 1, 2014, Respondent filed U.S. Trademark Application
`
`Serial No. 86/238,832 with the United States Patent and Trademark Office (“USPTO”)
`
`for the mark THE CRAWFORD SOLUTION based upon an intent to use the mark in
`
`commerce.
`
`
`
`3.
`
`On June 16, 2015, Respondent submitted to the USPTO a
`
`Statement of Use along with specimens, stating that it has used this mark in commerce in
`
`connection with the following services since at least as early as April 2014 :
`
`• Class 35: Insurance claims auditing services and medical cost management
`services; business process outsourcing services in the field of insurance;
`consulting in the field of business process outsourcing; analysis and evaluation for
`others of statistics relating to insurance claims; medical billing processing service;
`promotion of contractor network services; promotion of managed network of
`restoration providers; business services, namely, management of network
`members' compliance in order to establish program guidelines in providing
`estimation and restoration services for residential and building repairs; contractor
`credentialing services namely, registering, screening and verifying the credentials
`of third-party vendors, suppliers and contractors on behalf of others; Business
`evaluation of contractor estimates; customer service, namely, responding to
`customers inquiries for others in the field of contractor management services;
`contractor performance monitoring and program reporting, namely, screening and
`credentialing contractors; business management consultancy in the areas of
`medical bill review, medical utilization management and review, medical
`practitioner and health care utilization review services; employee recruiting and
`placement
`services; personnel management consultancy; business
`risk
`management consultancy relating to the administration of employee benefit plans
`and management of medical leave of absence; forensic accounting services;
`business advisory services in the field of cargo and transportation logistics
`management services related to insurance claims; operation of telephone call
`centers for others;
`• Class 36: Financial risk management services, namely, management and control
`of costs arising from casualty and property damage occurrences and related
`contingencies; financial administration of class action settlements; insurance
`claims administration; insurance claims processing; insurance consultation;

`insurance subrogation and salvage service;
`processing services provided to insurers, reinsurers, insured entities, self-insured
`employers, insurance brokers and workers' compensation and insurance agents
`supporting the administration and management of insurance claims, namely,
`claims relating to workers' compensation and disability, motor, general liability,
`product liability, employer's liability, uninsured loss recovery, property, travel,
`personal injury and rehabilitation; tracking and monitoring insurance compliance;
`insurance claims administration services for the mitigation of medical costs
`through a customized preferred provider organization network strategy; providing
`an online computer database of workers' compensation insurance information to
`insurers, reinsurers, insured entities, self-insured employers, insurance brokers
`and
`insurance agents; advisory services
`relating
`to
`insurance claims
`administration and processing; appraisal services, namely, conducting pre-risk
`underwriting and pre-risk shipment surveys of real property to assess condition
`and risks associated with the property and assess adequacy of sums insured;
`providing financial assessments of damages after a disaster or catastrophic event;
`
`• Class 41: Educational services, namely, developing online training programs in
`the field of insurance and risk management; arranging and conducting business
`seminars in the fields of risk management, financial risk management, insurance,
`and insurance claim adjustment; providing online training programs for others in
`the fields of risk management, financial risk management, insurance, and
`insurance claim adjustment; and
`
`• Class 42: Investigation services related to insurance claims; litigation support
`services; consultancy and advice related to laws and regulations, legal research,
`providing information on laws, consultancy regarding legal services; safety
`management and consultation services relating to the workplace safety needs of
`commercial and industrial companies; case management services, namely,
`personal services for coordination of medical services and vocational services for
`persons injured at work who require long-term care.

`(collectively “Respondent’s Services”) A true and correct copy of this Statement of Use,

`as well as the specimens submitted, are collectively attached hereto as Exhibit A.

`On January 28, 2016, Respondent responded to an Office Action
`
`issued by the USPTO requesting additional specimens to demonstrate use in connection
`
`with the services in Classes 41, 42, and 45. A true and correct copy of this response, as
`
`well as the specimens submitted, are collectively attached hereto as Exhibit B.
`

`On March 29, 2016, Respondent was issued Registration ’053 for
`
`
`

`the mark THE CRAWFORD SOLUTION in connection with Respondent’s Services. A
`
`true and correct copy of this registration is attached hereto as Exhibit C.
`
`Petitioner’s CRAWFORD Marks
`
`
`

`Petitioner owns U.S. Trademark Registration No. 6,280,658 for the
`
`mark CRAWFORD VENTURES for use in connection with the following services:
`
`• Class 35: Business consulting services relating to the operation of companies;
`design, planning and execution of business; arranging and conducting business
`conferences featuring topics in the fields of finance, investing, recruiting and
`hiring, advertising and sales; employment counseling and recruiting; personnel
`search and placement services for permanent, contract and temporary positions;
`
`• Class 36: Investment advisory services; and
`
`• Class 41: Providing on-line non-downloadable electronic newsletters delivered by
`email in the fields of business and finance; providing educational conferences in
`the fields of business and finance.
`
`Petitioner’s first use in commerce of its CRAWFORD VENTURES mark in connection
`
`with the services in Class 35 was at least as early as April 30, 2003, its first use in
`
`commerce in connection with services in Class 36 was at least as early as January 31,
`
`2020, and its first use in commerce in connection with services in Class 41 was as least as
`
`early as February 28, 2013. This registration contains a disclaimer of the term
`
`“VENTURES” apart from the mark as a whole.

`Petitioner also is the owner of U.S. Trademark Application Serial
`
`No. 88/945,278 for the mark CRAWFORD TALENT SOLUTIONS for use in connection
`
`with “employment counseling and recruiting; search and placement services for
`
`permanent, contract and temporary positions” in Class 35. Petitioner’s first use of this
`
`mark in connection with these services was February 29, 2020.

` On September 16, 2020, the USPTO issued an Office Action for
`
`Petitioner’s CRAWFORD TALENT SOLUTIONS application, refusing registration
`
`under Section 2(d) of the U.S. Trademark Act because of an asserted likelihood of
`
`confusion with Respondent’s Mark.
`
`FIRST GROUNDS FOR PARTIAL CANCELLATION
`(LACK OF USE WHEN STATEMENT OF USE WAS FILED)
`
`Petitioner re-alleges the allegations contained in Paragraphs 1
`
`9.
`
`
`
`through 8 of this Petition for Partial Cancellation as if fully set forth herein.
`
`
`

` Respondent’s aforementioned Statement of Use contained a
`
`verified statement that it was using its THE CRAWFORD SOLUTION mark in
`
`commerce in connection with all of Respondent’s Services.
`
`
`
`11.
`
`However, on information and belief, Respondent did not use its
`
`THE CRAWFORD SOLUTION mark in commerce for Respondent’s Employee Services
`
`when it filed its aforementioned Statement of Use. Thus, Respondent’s Statement of Use
`
`did not comply with 15 U.S.C. 1051(d), and Registration ’053 therefore should not have
`
`issued with respect to Respondent’s Employee Services.
`

`The continued existence of Registration
`
`‘053
`
`for THE
`
`CRAWFORD SOLUTION in connection with Respondent’s Employee Services, is
`
`unlawful, because, on information and belief, Respondent did not use its THE
`
`CRAWFORD SOLUTION mark in commerce in connection with Respondent’s
`
`Employee Services, at least as of the date it filed its verified Statement of Use, which are
`
`among the services specified in Registration ‘053.
`

`Petitioner is being damaged by the existence of Registration ‘053,
`
`
`

`because this Registration is the basis for denial of Petitioner’s application for

`CRAWFORD TALENT SOLUTIONS.

`make use of its THE CRAWFORD SOLUTION mark in commerce in connection with

`Respondent’s Employee Services.
