`Robert John Ward (“Petitioner”), an individual with an address of 12 Alpha Grove London,

`United Kingdom E148PG, believes that it will be damaged by Hatchbeauty Agency, LLC
`
`(“Respondent”) continued registration of U.S. Trademark Registration No. 5,423,653 for the mark
`
`WILDER in connection with health and beauty products, namely, skin care preparations and body
`
`care preparations in International Class 003 (the “Respondent Registration”), and hereby petitions
`
`for cancellation of same on grounds of likelihood of confusion, dilution, and non-use, pursuant to
`
`Section 14 of the Lanham Trademark Act of 1946 ("Lanham Act"), 15 U.S.C. § 1064. As grounds
`
`for cancellation, Petitioner alleges as follows:
`

`Petitioner is and has been in the retailing business. In connection with this business,
`
`Petitioner offers and sells various types of body creams, facial creams and other cosmetic creams.
`
`Attached as Exhibit A is one of the facial creams sold by Petitioner.

`Upon belief and information, Respondent is a Delaware Corporation with a
`
`business address of 10951 Pico Boulevard, Suite 300, Los Angeles, California 90064.
`

`Petitioner has used the mark WILDER’S TRUSTED BY MEN in commerce in
`
`connection with various cosmetic creams as early as March 03, 2020. As a result of this use, and
`
`Respondent’s non-use of the WILDER mark, consumers in the United States have come to
`
`associate the WILDER’S TRUSTED BY MEN mark, as used in connection with various types of
`
`body creams, facial creams and other cosmetic creams, with Petitioner and Petitioner’s goods.
`
`Petitioner therefore is the owner of common law rights in the WILDER’S TRUSTED BY MEN
`
`mark in connection with these goods. Attached as Exhibit B is a true and correct screen capture of
`
`one of Petitioner’s products on Amazon supporting the notion that consumers associate
`
`WILDER’S TRUSTED BY MEN mark with Petitioner and Petitioner’s goods. Based on current
`
`use in commerce, as shown in Exhibit B, Petitioner filed trademark application for WILDER’S
`
`TRUSTED BY MEN under class 003 for “Cosmetics; Anti-aging creams; Anti-wrinkle creams;
`
`Beauty creams; Body creams; Cosmetic creams; Facial creams; Hand creams; Moisturizing
`
`creams; Non-medicated cosmetics; Skin creams.” Attached as Exhibit C is a true and correct copy
`
`of Petitioner’s trademark application—Serial No. 88862668—therefor.

`Because Petitioner is in the business of selling the goods which may be identified
`
`in the Respondent Registration, skin care preparations, and is using the WILDER’S TRUSTED
`
`BY MEN in connection with various types of body creams, facial creams and other cosmetic
`
`creams, and because Petitioner already filed a trademark application for WILDER’S TRUSTED
`
`BY MEN under the same International Class as identified in the Respondent Registration, the
`
`continued validity of Respondent Registration interferes with the Petitioner’s current business
`

`activity. Petitioner therefore has a real interest in seeking cancellation of the Respondent
`
`Registration and standing to bring this action.

`On July 09, 2014, Respondent filed Application Serial No. 86332721 (the
`
`“Respondent Application”) to register the WILDER mark in International Class 003 in connection
`
`with health and beauty products, namely, skin care preparations and body care preparations, which
`
`was the basis for the Respondent Registration at issue in this proceeding. Respondent filed the
`
`Respondent Application based on its alleged use of the WILDER mark in commerce under Section
`
`1(a) of the Lanham Act, 15 U.S.C. §1051(a). Attached as Exhibit D is a true and correct printout
`
`from the United States Patent and Trademark Office ("USPTO") database reflecting Respondent’s
`
`Trademark Application.

`On March 13, 2018, Respondent was issued U.S. Trademark Registration No.
`
`5,423,653 for the mark WILDER. A true and correct copy of this registration is attached hereto as
`
`Exhibit E.
`
`
`
`FIRST GROUND FOR CANCELLATION – ABANDONMENT
`

`Petitioner realleges and incorporates by reference the allegations in paragraphs 1
`
`through 6, as if set forth fully herein.
`

`Upon belief and information, as a basis for cancellation, Respondent is not using
`
`the WILDER mark in connection with health and beauty products, namely, skin care preparations
`
`and body care preparations. Respondent, a Delaware Corporation, does not list any brands
`
`associated with the WILDER mark on its website. Attached as Exhibit F is a true and correct
`
`printout from Respondent’s website1 showcasing their brands.

`Upon belief and information, the underlying website in the screen capture which
`
`Respondent provided to the USPTO in its statement of use displaying Respondent’s goods has
`
`expired. Attached as Exhibit G is a true and correct copy of the alleged website2 Respondent
`
`provided to the USPTO displaying “Website Expired.” Attached as Exhibit H is a true and correct
`
`of the screen capture Respondent provided to the USPTO. Attached as Exhibit I is a set of screen
`
`captures to support Petitioner’s belief that the underlying website Respondent provided to the
`
`USPTO is as Petitioner alleges3.
`
`10. Whereas Petitioner is and has been actively using the WILDER’S TRUSTED BY
`
`MEN mark and consumers associate WILDER’S TRUSTED BY MEN mark with Petitioner and
`
`Petitioner’s goods4.

`Based on these allegations, the Respondent Registration should be cancelled in its
`
`entirety.

`SECOND GROUND FOR CANCELLATION – NON-USE

`Upon belief and information, Respondent is not using the mark in commerce in

`connection with health and beauty products, namely, skin care preparations and body care

`preparations as discussed above.

`14. Whereas Petitioner is and has been actively using the WILDER’S TRUSTED BY

`MEN mark in commerce and consumers associate WILDER’S TRUSTED BY MEN mark with
`
`Petitioner and Petitioner’s goods.
`

`Therefore, the mark is abandoned, and the Respondent Registration should be
`
`cancelled in its entirety.

`THIRD GROUND FOR CANCELLATION – LIKELIHOOD OF CONFUSION
`

`Petitioner realleges and incorporates by reference the allegations in paragraphs 1
`
`through 15, as if set forth fully herein.
`

`
`Petitioner has used the WILDER’S TRUSTED BY MEN mark in interstate
`
`commerce in the United States continuously since on or before March 03, 2020, in connection with
`
`offering for sale, marketing, advertising, and promotion of various skin creams.
`

`

`
`Petitioner established the WILDER’S TRUSTED BY MEN brand in 2015.
`
`Upon belief and information, on the other hand, Respondent is not using the
`
`WILDER mark in commerce.
`
`20.
`
`As a result of its widespread, continuous, and exclusive use of WILDER’S
`
`TRUSTED BY MEN mark to identify its goods and Petitioner as their source, Petitioner owns
`
`valid and subsisting common law rights to the WILDER’S TRUSTED BY MEN.
`
`21.
`
`Petitioner’s WILDER’S TRUSTED BY MEN is distinctive to both the consuming
`
`public and Petitioner’s trade.
`

`
`Petitioner has expended substantial time, money, and resources marketing,
`
`advertising, and promoting the various skin creams sold under the WILDER’S TRUSTED BY
`
`MEN mark including through Petitioner's marketing, advertising, and promotional efforts and
`

`channels, including but not limited to Petitioner’s own website5, Amazon page6, and ranking of
`
`Petitioner’s website on Google, for goods under WILDER’S TRUSTED BY MEN mark.

`Because of the high quality of Petitioner’s skin creams under Petitioner’s
`
`WILDER’S TRUSTED BY MEN mark, the skin creams have garnered thousands of positive
`
`reviews on Amazon. All the products listed on Amazon under the WILDER’S TRUSTED BY
`
`MEN mark have a rating of 4.6 or more on a scale of 5.
`

`
`As a result of its distinctiveness and widespread use and promotion throughout the
`
`United States, Petitioner's WILDER’S TRUSTED BY MEN mark is a famous trademark within
`
`the meaning of Section 43(c) of the Lanham Act, 15 U.S.C. § 1125(c), and became famous prior
`
`to the filing date of Respondent's application for Registration No. 5,423,653 or any other priority
`
`date on which Respondent may rely.
`

`Upon belief and information, Respondent first used the WILDER mark on October
`
`23, 2017. Whereas Petitioner established the WILDER’S TRUSTED BY MEN brand in 2015.
`

`
`The goods covered by Respondent’s Trademark Registration No. 5,423,653 are
`
`health and beauty products, namely, skin care preparations and body care preparations, which may
`
`overlap to Petitioner’s goods under WILDER’S TRUSTED BY MEN mark.
`
`27.
`
`Respondent’s Registration No. 5,423,653 is unrestricted as to consumers and trade
`
`channels. As such, it is presumed that Respondent’s goods identified in the challenged registration
`
`might be sold to all ordinary consumers, including consumers of Petitioner’s goods, and travel in
`
`all ordinary trade channels, including Petitioner’s channels such as Amazon, through which
`
`Petitioner sells its goods under Petitioner’s WILDER’S TRUSTED BY MEN mark.
`

`Therefore, Respondent’s registration should be cancelled because it consists of or
`
`comprises a mark which so resembles Petitioner’s WILDER’S TRUSTED BY MEN mark as to
`
`be likely, when used in connection with Respondent’s goods, to cause confusion, mistake or
`
`deception within the meaning of 15 U.S.C. § 1052(d), and to cause damage to Petitioner thereby.
`

`FOURTH GROUND FOR CANCELLATION – DILUTION
`

`Petitioner realleges and incorporates by reference the allegations in paragraphs 1
`
`through 28, as if set forth fully herein.
`

`Petitioner's WILDER'S TRUSTED BY MEN mark is distinctive and a "famous
`
`mark" within the meaning of Section 43(c) of the Lanham Act, 15 U.S.C. § 1125(c).

`Petitioner established the WILDER’S TRUSTED BY MEN brand in 2015.
`
`Petitioner's WILDER'S TRUSTED BY MEN mark became distinctive and famous
`
`prior to the filing date of Respondent's application for Registration No. 5,423,653 or any other date
`
`on which the Respondent may rely for purposes of priority.
`
`33.

`Respondent's Registration No. 5,423,653 impairs the distinctiveness and causes
`
`dilution by blurring of, and thereby damages, Petitioner's famous WILDER’S TRUSTED BY
`
`MEN in violation of 15 U.S.C. § 1125(c). Accordingly, pursuant to 15 U.S.C. § 1063, Respondent's
`
`Registration No. 5,423,653 should be cancelled.
`

`WHEREFORE, Petitioner respectfully prays that Respondent’s Registration No. 5,423,653

`be cancelled it its entirety.

`I have been using a face cream for a while but was reading about Hyaluronic Acid and wanted to try a cream With
`that ingredient as it is supposed to aid moisture retention in the skirt Pricewise this type of cream is more
`expensive and this brand is mid range. there are cheaper brands but plenty of more expensive ones. Many products
`come in 1.7o2 jars, here you will get a full 2oz. It is still a small jar, the picture on Amazon makes it look large. The
`cream is not scented and has no smell that I could noticeihe consistency is a bit thicker man my normal cream
`and it doesn't absorb as quickly but I have been trying half my face With the old cream and half with this. What I
`notice is that later in the day my skin with Wilders still feels fully moisturized wh
