`MEMORANDUM IN OPPOSITION TO PETITIONERS MOTION TO QUASH
`
`Pursuant to TBMP § 502.02(b) Respondent files this memorandum opposing
`
`Petitioner’s Motion to Quash. Pursuant to TBMP §§ 404.05, Respondent’s Civil
`
`Rule 30(b)(6) deposition was properly and timely noticed. Attorney correspondence
`
`in this proceeding shows that Petitioner’s objections to Respondent’s notice of
`
`deposition are improper and waived by Petitioner under TBMP § 404.08(a).
`
`Petitioner’s Motion to Quash should be denied.
`
`
`
`Respondent’s Notice of Deposition is proper and timely. “Prior to the taking
`
`of a discovery deposition on notice alone, the party seeking to take the deposition
`
`must give reasonable notice in writing to every adverse party.” TBMP § 404.05.
`
`1. On September 17, 2020, Respondent served its notice to take Petitioner’s
`
`Civil Rule 30(b)(6) deposition. Exhibits 1 and 2.
`
`2. On September 18, 2020, Petitioner’s counsel objected to an in-person
`
`deposition, and requested a remote deposition. Exhibit 3.
`
`
`
`3. On September 18, 2020, the undersigned agreed to a remote deposition via
`
`videoconference. The undersigned inquired whether Petitioner had any
`
`other issues with the Notice of Deposition and whether Petitioner
`
`required any technology to participate in the deposition. Exhibit 4.
`
`4. On September 21, 2020, Petitioner’s counsel advised that Petitioner has
`
`the technological ability to sit for the deposition. Exhibit 5.
`
`5. On September 22, 2020, Respondent served a First Amended Notice of
`
`Deposition to advise that the deposition would proceed via
`
`videoconference. Exhibit 6.
`
`6. On September 23, 2020, Respondent served a Second Amended Notice of
`
`Deposition to provide the Zoom-based meeting link and credentials for
`
`accessing the deposition video conference. Exhibit 7.
`
`Petitioner had two weeks’ notice to prepare for its deposition. The deposition
`
`was timely noticed, and Petitioner’s Motion to Quash should be denied.
`
`Petitioner’s objection to the technology of the remote deposition is waived.
`
`“Objections to errors and irregularities in a notice of the taking of a discovery
`
`deposition must be promptly served, in writing, on the party giving the notice; any
`
`such objections that are not promptly served are waived.” TBMP § 404.08(a). The
`
`demand for a remote deposition was the only objection raised by Petitioner. See
`
`Exhibits 3. Respondent overcame Petitioner’s objection by facilitating a deposition
`
`via videoconference. See Exhibit 4. Petitioner’s counsel advised the undersigned
`
`that Petitioner can meet the technological requirements to attend the deposition.
`

`See Exhibit 5. The videoconference platform is based on the Zoom engine. The
`
`interface is simple, intuitive, and used by thousands, including children. Petitioner
`
`requested the remote deposition, and Petitioner’s objection to the technology should
`
`be denied.
`
`Petitioner’s argument regarding settlement negotiations is unavailing.
`
`Respondent has maintained and continues to maintain that it does not stipulate to
`
`suspension of the proceeding unless the parties agree on salient settlement terms.
`
`The parties have not agreed on salient settlement terms.
`
`For the foregoing reasons, Respondent’s Motion to Quash should be denied
`
`and the Civil Rule 30(b)(6) deposition of Petitioner should proceed on Oct. 1 as
`
`noticed.
