`(“Petitioner”) believes that it is damaged by Registration No. 5,885,351 for the mark
`
`LUCHADORES LEGALES (the “Junior Mark”) filed by JT LEGAL GROUP, APC, having a
`
`correspondence address of 801 N. Brand Boulevard, Suite 1130, Glendale, California 91203
`
`(“Registrant”), and therefore petitions to cancel the same under the provisions of 15 U.S.C.
`
`1064(1).

`As grounds for cancellation, it is alleged:
`

`On April 17, 2019, Registrant filed an application to register the Junior Mark,
`
`LUCHADORES LEGALES, as a standard character mark under Section 1(a) of the Lanham Act,
`
`15 U.S.C. § 1051(a) (the “Junior Mark Application”). In the Junior Mark Application, Registrant
`
`alleged a first use and a first use in commerce date of March 1, 2019. Based on this Junior Mark
`

`Application, Registrant obtained U.S. Registration No. 5,885,351, which issued on October 15,
`
`2019 for the term LUCHADORES LEGALES used on “legal services.”

`Since at least 2013, long before Registrant’s first use of the Junior Mark, Petitioner
`
`has been, and still is, engaged in legal services, and in particular personal injury legal services,
`
`including for complex and serious injury cases, under the mark 1-800-LUCHADOR (the “Senior
`
`Mark”). Petitioner has owned the domain www.1800luchador.com, as well as, the toll-free
`
`telephone number 800-LUCHADOR since 2013. See EXHIBIT A.
`

`Since at least before Registrant’s first use of the Junior Mark, Petitioner has
`
`continuously used and promoted its Senior Mark. Petitioner’s Senior Mark is the subject of
`
`substantial and continuous marketing and promotion by Petitioner in connection with its legal
`
`services. Petitioner has and continues to widely market and promote its Senior Mark in the industry
`
`and to consumers by, for example, displaying the Senior Mark extensively in multimedia
`
`advertisements, including radio; on apparel and other merchandise; on promotional and point of
`
`sale materials, including postcards, mugs, magnets, reusable grocery totes, and pens; in magazines
`
`and other industry publications; on the yaglaw.com website, and other Internet websites and social
`
`media sites, such as Facebook®; and at trade shows and live events. See EXHIBIT B for a sample
`
`of Petitioner’s promotion of the Senior Mark. In addition, the Senior Mark is promoted through
`
`unsolicited recognitions awarded to individuals employed by Registrant and providing outstanding
`
`services under the Senior Mark, including, for example, Super Lawyers®, Super Lawyers Rising
`
`Stars, The National Trial Lawyers Top 40 Under 40, and an Avvo Rating of 10.0 Superb as “Top
`
`Attorney Personal Injury.”

`By virtue of Petitioner’s continuous and substantial use of the Senior Mark, the
`
`Senior Mark has become a famous identifier of Petitioner such that consumers have come to
`

`recognize the Senior Mark with which Petitioner markets and sells its services. As one example,
`
`on Facebook® alone, thousands recognize the Senior Mark as being associated with Petitioner. As
`
`a result, Petitioner has built up, at great expense and effort, valuable goodwill in its Senior Mark
`
`and has developed strong common law rights in Petitioner’s Senior Mark. Petitioner relies on its
`
`common law rights in its Senior Mark, which rights predate Registrant’s first use of the Junior
`
`Mark.

`In addition to Petitioner’s common law rights, Petitioner owns and relies on U.S.
`
`Trademark Application Serial No. 88736099 (the “Senior Mark Application”) for the mark 1-800-
`
`LUCHADOR for “legal services” in International Class 045, filed on December 20, 2019 and
`
`asserting a first use and a first use in commerce date of October 1, 2013. The first use and first use
`
`in commerce date of Petitioner’s Senior Mark Application is prior to the first use and first use in
`
`commerce date of Registrant’s Junior Mark Application. True and correct copies of the specifics
`
`of the Senior Mark Application obtained from the United States Patent and Trademark Office’s
`
`(“USPTO”) Trademark Status and Document Retrieval (TSDR) database is attached hereto as
`
`EXHIBIT C and made of record.

`Since at least before Registrant’s first use of the Junior Mark, Petitioner has
`
`continuously used and promoted the Senior Mark in interstate commerce in connection with its
`
`services, including the services identified in the Senior Mark Application. In addition, Petitioner’s
`
`Senior Mark was well-established and famous long before Registrant first used the Junior Mark or
`
`filed its Junior Mark Application for registration of the Junior Mark.

`Petitioner has been and will continue to be damaged by the Junior Mark’s
`
`registration because the Junior Mark so resembles Petitioner’s Senior Mark, including as applied
`
`for registration in the USPTO, and in which Petitioner owns common law trademark rights, as to
`

`be likely, when used on or in connection with the services as they are identified in the Junior Mark
`
`Application, as to cause confusion, or to cause mistake, or to deceive within the meaning of Section
`
`2(d) of the Trademark Act, 15 U.S.C. § 1053(d). Indeed, in view of the highly similar sight, sound
`
`and meaning between Registrant’s Junior Mark and Petitioner’s Senior Mark, the identical nature
`
`of the respective services of Registrant and Petitioner associated with Registrant’s Junior Mark
`
`and Petitioner’s Senior Mark, and the similarity of the channels of trade and customer base for
`
`Registrant’s services and Petitioner’s services make it inevitable that Registrant’s Junior Mark is
`
`likely to cause confusion, and/or to cause mistake, and/or to deceive.

`Petitioner has been using the Senior Mark in commerce in connection with legal
`
`services for at least five (5) years prior to Registrant’s alleged use of the Junior Mark in connection
`
`with legal services. As a relative newcomer, Registrant had a legal duty to select a mark which is
`
`totally dissimilar to trademarks already being used in the field.

`Registrant’s Junior Mark, as used on the services identified in the Junior Mark
`
`Application, does and will continue to dilute, or be likely to dilute, the distinctiveness of
`
`Petitioner’s Senior Mark, resulting in damage to Petitioner, its goodwill, and the strength and value

`of its Senior Mark, pursuant to 15 U.S.C. § 1125(c).

`In view of Petitioner’s prior rights in its Senior Mark, Registrant is not entitled to

`federal registration of the Junior Mark pursuant to Section 2(d) of the Trademark Act, 15 U.S.C.
