`Plaintiff, InProcessOut, LLC dba Flynoceros, is a Texas Limited Liability Company
`
`with its principle place of business at 1424 N Walnut Ave, New Braunfels TX 78130.
`

`Upon information and belief, Defendant, World Tech Toys, Inc., is a California
`
`Corporation with its principal place of business at 28904 Avenue Paine, Valencia CA
`
`91355.
`

`
`Defendant, World Tech Toys, Inc., maintains a Registered Agent in the State of
`
`Texas and may be served at its Registered Agent and CEO, Kevork Kouyoumjian, 28904
`
`Avenue Paine, Valencia CA 91355.

`This is an action for Federal trademark infringement, unfair competition, and false
`
`Jurisdiction
`
`designation of origin.
`

`
`This is also an action for Texas Common Law trademark Infringement, Texas
`
`Common Law Unfair Competition, Texas Common Law Misappropriation, and Texas
`
`Common Law Unjust enrichment, all under the common law of the State of Texas.
`

`
`The claim for Federal trademark infringement arises under 15 U.S.C. § 1114.
`
`The claim for Federal unfair competition and false designation of origin arises
`
`under 15 U.S.C. § 1125(a).
`
`8.
`
`The claims for Texas Common Law Trademark Infringement, Texas Common Law
`
`Unfair Competition, Texas Common Law Misappropriation, and Texas Common Law
`
`Unjust Enrichment arise under the common law of the State of Texas.
`
`9.
`
`The Court has jurisdiction over the lawsuit under 28 U.S.C. §§ 1331 and 1338.
`
`10.
`
`The Court has jurisdiction over the lawsuit under 15 U.S.C. § 1121(a).
`
`11.
`
`The Court has supplemental jurisdiction over the State of Texas claims in the
`
`lawsuit under 28 U.S.C. § 1367(a).
`
`12. Defendant regularly transacts and solicits business, engages in other persistent
`
`course of conduct, and/or derives substantial revenue from products and/or services
`
`provided to individuals in this District and in the State of Texas.
`
`13. Defendant has purposefully established substantial, systematic and continuous
`
`contacts in this District and in the State of Texas and expects or should reasonably expect
`
`to be subjected to this Court’s jurisdiction.

`retailers and others), sells or offers for sale the infringing products in this District and in
`
`the State of Texas.

`(ii) Elite Mini Orion 2.4GHz 4.5CH Live-View Camera RC Drone (Product Code:

`33884), a photo of which is attached as Exhibit D.
`
`(iii) Elite Mini Orion Glow-In-The-Dark 2.4GHz 4.5CH HD RC Camera Drone
`
`(Product Code: 33775), a photo of which is attached as Exhibit E.
`
`(iv) Elite Orion Glow-In-The-Dark 1-Axis Gimbal 2.4GHz 4.5CH RC HD Camera
`
`Drone (Product Code: 33773-GLO), a photo of which is attached as Exhibit F.
`
`(v) Mini Orion Glow-in-the-Dark 2.4GHz 4.5CH Live Feed Camera RC Drone
`
`(Product Code: 33819), a photo of which is attached as Exhibit G.
`
`(vi) Orion 1-Axis Gimbal 2.4GHz 4.5CH RC HD Camera Drone (Product Code:
`
`33773), a photo of which is attached as Exhibit H.
`
`21. Exhibit I is an image of the Elite Mini Orion 2.4GHz 4.5CH Live-View Camera RC
`
`Drone (Product Code: 33884) product of Defendant that was purchased through Amazon
`
`and delivered to an address located in the District.
`
`Plaintiff's Facts
`
`22. Plaintiff is in the business of building and selling complete drones and components
`
`for drones.
`
`23. Plaintiff is the owner of the federally registered ORION trademark and has
`
`continuously used that mark in connection with drones since at least as early as January
`
`2016.

`24. Plaintiff’s trademark is inherently distinctive as a name for Plaintiff’s above goods
`
`and/or services as the mark neither describes the goods and/or services, nor describes
`
`any quality, characteristic, or ingredient of the above goods and/or service.
`
`25. Plaintiff has used and promoted its trademark on the Internet. Representative
`
`specimens of some of these materials are attached as Exhibit B.
`
`26. As a result of the extensive use and promotion, Plaintiff’s trademark has acquired
`
`a favorable reputation to consumers as an identifier and symbol of Plaintiff and its
`
`products, services, and goodwill. Accordingly, the trademark is strong and entitled to
`
`broad protection.
`
`27. Plaintiff continues to invest substantial time and money in promoting its goods
`
`and/or services offered under the trademark.
`
`Defendant's Allegations
`
`28. Defendant is in the business of radio controlled drones, helicopters, cars, trucks,
`
`and other toys.
`
`29. Defendant sells or promotes drones using the above identified trademark of
`
`Plaintiff, without authorization to do so.
`
`30. Representative specimens of some of these materials are attached as Exhibits C-
`
`I.
`
`31. Despite the limitless other marks that Defendant could have chosen, it wrongfully
`
`appropriated a trademark identical and confusingly similar to Plaintiff’s trademark without
`
`Plaintiff’s permission.
`
`32. Defendant chose a trademark identical and confusingly similar to Plaintiff’s
`
`trademark even though the most rudimentary internet and/or trademark search would
`
`have revealed Plaintiff’s federal registration and/or because Defendant wanted to falsely
`

`indicate to consumers that its goods and/or services originated from, are approved by,
`
`are sponsored by, are licensed by, or are affiliated with Plaintiff or are otherwise
`
`associated with Plaintiff’s goods and/or services.

`33. Defendant had notice of the infringing use at least as early as the service of this
`
`lawsuit.
`
`Count 1
`
`Federal Trademark Infringement
`
`
`34. Defendant’s unauthorized use of Plaintiff’s trademark falsely indicates to
`
`consumers that Defendant’s goods and/or services originated from, are approved by, are
`
`sponsored by, are licensed by, or are affiliated with Plaintiff or are otherwise associated
`
`with Plaintiff’s goods and/or services.
`
`35. Defendant’s unauthorized use of Plaintiff’s trademark in the manner described
`
`above is likely to cause confusion, to cause mistake, or to deceive customers and
`
`potential customers of the parties by suggesting some affiliation, connection, or
`
`association of Defendant with Plaintiff.
`
`36. Defendant’s actions, as described above, constitute Trademark Infringement in
`
`violation of 15 U.S.C § 1114(1).
`

`Federal Unfair Competition and False Designation of Origin
`
`37. Defendant’s actions, as described above, constitute Unfair Competition and False
`
`Designation of Origin in violation of 15 U.S.C. § 1125(a).
`

`
`Texas Common Law Unfair Competition
`
`38. Defendant’s actions, as described above, constitute unfair competition in violation
`
`of the common law of the State of Texas.

`Misappropriation in violation of the common law of the State of Texas.

`Texas Common Law Unjust Enrichment

`41. Defendant’s actions, as described above, constitute Common Law Unjust

`Enrichment in violation of the common law of the State of Texas.

`42. Plaintiff requests a trial by jury on all triable issues.

`employees, distributors, attorneys and all others acting in privity or through them,
`
`be preliminarily and permanently enjoined from competing unfairly with Plaintiff’s
`
`Intellectual Property as described above.

`
`The Court order Defendant, together with any and all parent or affiliated
`
`companies or corporations, and all officers, directors, agents, servants,
`
`employees, distributors, attorneys and all others acting in privity or through them,
`
`to deliver for destruction, or show proof of destruction of all products, labels, signs,
`
`prints, packages, wrappers, receptacles, and advertisements, and any other
`
`materials in their possession or control that depict or reference Plaintiff's
`
`Intellectual Property or any other confusingly or substantially similar mark(s), and
`
`all materials or articles used for making or producing same.
`

`The Court issue an order against Defendant for an accounting of profits in
`
`respect of the infringement.

`
`Plaintiff recover all damages it has sustained as a result of Defendant's

`infringement and unfair competition, increased as the Court determines is
`
`appropriate to the circumstances of this case.

`Plaintiff recover Defendant's profits resulting from their infringement and
