`Registrant, ROOKE, LLC, by its attorneys, moves this Court pursuant to Federal Rule of

`Civil Procedure 12(b)(6) to dismiss this matter on the basis of issue preclusion (also known as
`
`collateral estoppel), and in support therefore states:

`Petitioner seeks cancellation of Registrant’s above-identified trademark
`
`registration. Petitioner alleges that it “has been damaged and will continue to be damaged by
`
`continued registration of Registrant’s Mark for use in association with Registrant’s services in
`
`that continued registration of Registrant’s mark will give Registrant priority and the presumptive
`
`right to use the mark with its services throughout the United States, all to the detriment of
`
`Petitioner.” See Petition for Cancellation at ¶ 18 (Docket Entry 1).

`Petitioner, in the prayer for relief in this cancellation proceeding, “requests that
`
`U.S. Trademark Registration No. 4,680,433 be cancelled from the Register.” Id. at sixth
`
`unnumbered page (Docket Entry 1).
`

`Petitioner is barred by the principle of issue preclusion from seeking cancellation.
`

`
`Petitioner filed Civil Action No. 3:16-cv-00687, The Row, Inc. v. Rooke, LLC, in the United
`
`States District Court for the Middle District of Tennessee, seeking damages for trademark
`
`infringement and cancellation of the above-identified trademark registration. See Complaint,
`
`attached to this Motion as Exhibit A.
`

`Petitioner alleged in the ‘687 lawsuit “that it is being damaged and will continue
`
`to be damaged by the registration of the Whiskey Row Mark.” See Exhibit A at ¶ 38 (page 9 of
`
`the Complaint). Petitioner asked the district court in the ‘687 lawsuit, among other claims for
`
`relief, “That the Court enter an order cancelling the Defendant's trademark registration number
`
`4,680,433 . . . .”

`This claim for relief is identical to the claim for relief in the present cancellation
`
`matter.
`

`The district court in the ‘687 lawsuit entered summary judgment against
`
`Petitioner. See Order of December 19, 2017, stating that Petitioner’s “claim for trademark
`
`infringement and request for cancellation are hereby DISMISSED WITH PREJUDICE.”
`

`
`attached as Exhibit C.)

`The issue of whether Petitioner is entitled to cancellation of the subject
`
`registration in this matter is identical to the issue involved in the district court litigation. The
`
`same issue was raised, litigated, and actually adjudged in the prior litigation. The determination
`
`of the issue was necessary and essential to the resulting judgment by the district court. Petitioner
`
`was fully represented in the prior action and had an opportunity to make whatever arguments it
`
`wanted to make and to submit evidence in opposition to the district court’s ruling.

`Accordingly, the issue of whether Petitioner is entitled to judgment cancelling
`

`Registrant’s registration has been actually litigated. That issue was decided adversely to
`
`Petitioner by a valid and final judgment. Accordingly, the determination by the Middle District
`
`of Tennessee is conclusive in this subsequent action between the same parties.

`Petitioner has appealed the adverse judgment of the district court to the United
`
`States Court of Appeals for the Sixth Circuit. (The Notice of Appeal is attached as Exhibit D.)
`
`That appeal is pending as Appeal No. No. 18-5068. Petitioner, as Appellant, filed its Opening
`
`Brief on March 30, 2018. Petitioner is not entitled to go around the Sixth Circuit by attempting
`
`to present the exact same issues to this Board.
`

`Petitioner presents a Brief in support of this Motion.
