`respectfully makes to Respondent Akaso Tech LLC (“Respondent”) its pretrial disclosures based

`upon its current knowledge and after a good faith search for information. In making these
`
`disclosures, Petitioner does not waive any applicable privileges.

`numerous invoices for products sold under Petitioner’s mark that were sent to customers in the

`United States.

`The foregoing is relevant to the DuPont likelihood of confusion factors of similarity of
`
`the marks, relatedness of the goods, and similarity of trade channels, as well as to
`
`
`
`Petitioner’s use of its mark in commerce, Petitioner’s priority of use, and the date of Petitioner’s
`
`first use of Petitioner’s Mark in commerce.
