`Rust-Oleum Corporation (“Petitioner”), an Illinois Corporation having a principal place
`
`of business at 11 Hawthorn Parkway, Vernon Hills, Illinois 60061, believes that it would be
`
`damaged by the continued registration of the mark TINTABLE on the Principal Register, as
`
`shown in Registration No. 3,970,111 (the “’ 1 11 Registration”) registered by Dayton Deetz and
`
`allegedly assigned to Deetz Family, LLC (collectively, “Registrant”), and accordingly petitions
`
`to cancel registration of the mark under 15 U.S.C. § 1064.
`
`The grounds for the petition are as follows:
`
`1.
`
`For decades, Petitioner and/or its predecessors—in—interest have manufactured
`
`protective paints and coatings for home and industrial use. Since at least as early as 1999,
`
`Petitioner and/or its predecessors-in-interest have manufactured and sold “tintable” paint, primer,
`
`or other coating products, which can be tinted to a different color, including the following:
`
`0 Zinsser BIN Primer Sealer, since at least 1999;
`
`0 Zinsser Bulls Eye 123 Primer Sealer, marketed and sold since at least 1999;

`Attached hereto as Exhibit A are true and correct printouts of examples of Petitioner’s tintable
`
`products.

`The term “tintable,” as shown in numerous online dictionary definitions, attached
`
`hereto as Exhibit B, means “that can be tinted.”
`

`In addition to Petitioner, third parties frequently use the term “tintable” in
`
`connection with paints and/or primers to inform consumers that color of the paint or primer can
`
`be tinted. True and correct printouts of examples of such third-party use are attached hereto as
`
`Exhibit C.
`

`Indeed, the descriptive term “tintable” was used in this descriptive manner by
`
`Registrant in its original goods description for the TINTABLE trademark application, filed with
`
`the USPTO on October 1, 2010, which listed “Coatings in the nature of namely tintable paint
`
`and writing surface paints; House paint; Interior paint; Mixed paints; Paint for use in the
`
`manufacture of wallcoveringsg Paints; Paints for arts and crafts; Paints for tinting, for use
`
`consisting of chalkboard and writing surface” (emphasis added). Attached hereto as Exhibit D
`
`is a true a correct copy of the original trademark application obtained from the TSDR.

`The specimen of use submitted in connection with Registrant’s TINTABLE
`
`trademark application, included in Exhibit E and shown below, also demonstrates the
`
`descriptive and/or generic nature of the term “tintable,” and does not show use of TINTABLE as
`
`an indicator of source.

`Moreover, the website www.magnamagic.com which, on information and belief,
`
`is owned and/or managed by Registrant, evidences that “tintable” is descriptive in connection
`
`with goods covered in the ‘ 1 11 Registration, to wit: “Our tintable chalkboard paint is a clear
`
`(neutral) base. It should match any formula for a neutral base using universal tints. For pastel
`
`tints, add white first, and then gradually add the other colors. Most paint stores will tint our
`
`chalkboard paint ....” True and correct printouts from the wWw.mag_namagic.com website, and
`
`the domain registration identifying Dayton Deetz as a responsible party, are attached hereto as
`
`Exhibit F.
`

`Due to Widespread use of the term “tintable” to describe a characteristic or quality
`
`of a specific type of paints, primers and other coating products that are capable of being tinted,
`
`the term “tintable” is not distinctive of the goods of any one entity, including Registrant; is not
`
`capable of becoming distinctive of any one entity’s goods; and there is no consumer recognition
`
`of this term as referring to or identifying Registrant.

`Since at least August, 2012, Registrant has threatened to enforce the ‘ 1 11
`
`Registration against Petitioner. See, e. g. , Exhibit G attached hereto.
`

`On April 28, 2016, Registrant filed a Complaint against Petitioner for, inter alia,
`
`trademark infringement in the U.S. District Court for the District of Massachusetts, (the
`
`“Lawsuit”) claiming that Petitioner’s use of the term “tintable” in connection With its products
`
`infringed the ‘1 11 Registration. A copy of the Complaint is attached hereto as Exhibit H.
`

`
`Registrant claims in the Lawsuit that Petitioner’s use of the term “tintable” is
`
`likely to cause confusion, mistake or deception as to the sponsorship and/or affiliation of
`
`products labeled with that term.
`
`11.
`
`The continued maintenance of the ‘ 1 11 Registration will cause irreparable harm
`
`to Petitioner, and will unjustly inhibit Petitioner’s and other third-parties’ ability to accurately
`
`describe or refer to a specific type or feature of their paint and coating products.
`
`FIRST CAUSE OF ACTION
`
`CANCELLATION FOR DESCRIPTIVENESS, 15 USC § 1052(e)

`“Tintable” is merely descriptive of a quality or characteristic of the goods listed in

`The term “tintable” is necessary to accurately describe Petitioner’s and other third
`
`parties’ goods.

`The term “tintable” has not acquired distinctiveness with respect to Registrants’
`
`goods described in recited in the ‘ll 1 Registration.

`If Registrant is allowed to continue to maintain its registration for TINTABLE,
`
`Registrant would be able to improperly obstruct Petitioner’s and other third parties’ descriptive
`
`use of the term “tintable.”

`Because the term “tintable” is merely descriptive of the goods listed in the ‘ l 11
`
`Registration, the ‘ll 1 Registration should be cancelled pursuant to Section 2(e)(2) of the
`
`Trademark Act, 15 U.S.C. § l052(e)(2).

`SECOND CAUSE OF ACTION
`
`REGISTRANT’S TINTABLE REGISTRATION SHOULD BE CANCELLED BECAUSE
`THE TERM “TINTABLE” IS GENERIC

`Consumers do not use or understand that the term “tintable,” when used in

`connection with the goods listed in the ‘1 11 Registration, refers to Registrant. Rather, consumers

`The term “tintable” is necessary for Petitioner and third parties to accurately
`
`describe and refer to any paint, primer or coating product capable of being tinted.
`

`Petitioner and other third parties have the right to use the term “tintable” in
`
`connection with describing and referring to any paint, primer or coating product capable of being
`
`tinted.
`

`
`If Registrant is allowed to continue to maintain its registration for TINTABLE,
`
`Registrant would be able to improperly obstruct Petitioner’s and other third parties’ use of the
`
`term “tintable” to describe or refer to any paint, primer or coating product capable of being
`

`Because the term “tintable” primarily signifies to consumers a type of paint,

`primer or other coating product, it is is incapable of serving as an indicator of source in
`
`connection with the goods listed in the ‘l 1 1 Registration, and as a result the ‘ 1 11 Registration

`should be cancelled on grounds of genericness.

`Registrant’s use of the term “Tintable” in connection with the goods listed in the
`
`‘1 11 Registration does not function to identify Registrant’s goods, nor to distinguish them from
`
`the goods offered by others, and therefore does not function as a trademark as required by
`
`Sections 1, 2 and 45 of the Trademark Act, 15 U.S.C. §§ 1051, 5052, and 1127. Rather,
`
`Registrant’s use of the term “tintable” merely describes the type of product and/or a feature
`
`thereof, as demonstrated in the specimen submitted with Registrant’s original application. See
`
`Exhibit E.

`Because the term “tintable” was not in lawful use by Registrant in commerce in
`
`connection with the goods listed in the ‘1 11 Registration prior to the application date and is, in
`
`fact, incapable of distinguishing Registrant’s goods under 15 U.S.C. § 1091(a), the ‘ 1 11
`
`Registration should be cancelled.
`
`WHEREFORE, Petitioner believes that it is being, and will continue to be, damaged by
