`Glock, Inc. (“Petitioner”), a Georgia corporation having its principal place of business at
`6000 Highlands Parkway Smyrna, Georgia 30082, hereby petitions to cancel Registration No.
`3,828,065 (the “Registration”) registered to Da Wuster Corp. (“Registrant”), a corporation
`registered in the State of Nevada, with its principal place of business at 500 North Rainbow
`
`Boulevard #300A, Las Vegas, Nevada 89107 on grounds that the Registration was obtained
`through fraud on the United States Patent and Trademark Office (“USPTO”), has been, and
`continues to be, used in bad faith with the intent to dilute, and caused and will continue to cause a
`likelihood of confusion of Petitioner’s famous trademarks.
`
`
`As grounds for cancellation, Petitioner asserts that:
`
`1. Since 1982, Petitioner has marketed and sold firearms and firearms accessories.
`2. Petitioner’s pistols are globally recognized as the leading polymer-frame semi-automatic
`pistol used worldwide by law enforcement and military, and have been featured in hundreds of
`
`television shows and films.
`
`3. Petitioner manufactures and offers for sale a complete family of pistols, including the
`
`Model 17, Model 17L, Model 18, Model 19, Model 20, Model 21, Model 22, Model 23, Model
`
`
`

`24, Model 25, Model 26, Model 27, Model 28, Model 29, Model 30, Model 31, Model 32, Model
`
`33, Model 34, Model 35, Model 36, Model 37, Model 38, Model 39, Model 41, Model 42 and
`Model 43 (hereinafter referred to as the “G Pistol Family”).
`4. Petitioner has numerous trademarks registered with the USPTO for the GLOCK name
`and logo, as well as for its trade dress (hereinafter referred to as the “GLOCK Marks”).
`Specifically, Petitioner holds two trademarks in IC 028 (Reg. Nos. 3425078, 4192851), the very
`
`class Registrant applied in. The world famous GLOCK Marks are inherently distinctive and have
`
`achieved secondary meaning due to their widespread popularity with law enforcement agencies
`
`and civilians throughout the United States and the world.
`
`5. In addition to its valid Common Law rights in the G Pistol Family, Petitioner holds two
`
`trademark registrations (Reg. Nos. 2993223, 3042540) for G37 and G38, which were obtained on
`
`September 6, 2005 and January 10, 2006, respectively. Petitioner also has two trademarks, which
`
`have been published for opposition for G17 and G18 (Serial Nos. 86416038, 86416412). These
`
`marks correspond with the GLOCK Model 37 and GLOCK Model 38 pistols as well as the
`
`GLOCK Model 17 and GLOCK Model 18 pistols.
`
`6. G19 refers to the GLOCK Model 19 pistol, manufactured and sold by Petitioner.
`
`Petitioner has advertised and sold its pistol as the G19 since the first production of the pistol in
`1988. A true and correct copy of Petitioner’s heritage timeline is attached as Exhibit A. Petitioner
`has used and continues to use G19 and other similar abbreviations, such as G17 and G18, to
`
`describe the G Pistol Family on its official website us.glock.com, in magazines and in product
`manuals. True and correct copies of images from Petitioner’s website are attached as Exhibit B; a
`true and correct copy of Petitioner’s magazines and product manual are attached as Exhibit C.
`7. The name and address of the current owner of the Registration is: Da Wuster, Corp. d/b/a
`
`Airsplat.com, 500 North Rainbow Boulevard #300A, Las Vegas, Nevada 89107.
`
`8. Da Wuster, Corp. is owned by Kent Wu, an individual who also operates an airsoft retail
`
`company, AirSplat. AirSplat has physical stores in California and Washington and also operates
`
`its business through airsplat.com.
`9. Airsplat.com proclaims to be the “Nation’s Largest Airsoft Retailer.” Airsplat.com offers
`for sale airsoft pistol, including numerous airsoft pistol models that violate Petitioner’s intellectual
`property rights. Registrant has consistently used Petitioner’s trademarks and trade dress for its
`commercial profit and for its advertisement and marketing of airsoft products. These violations are
`

`the subject of a pending lawsuit filed against The Wuster, a separate entity owned by Kent Wu.
`
`This action is in the Northern District of Georgia and was filed on February 26, 2014, Case No.
`
`1:14-cv-00568. Among the numerous claims Petitioner has asserted against The Wuster are trade
`
`dress infringement, trademark infringement and patent infringement.
`
`10. Through fact based jurisdictional discovery conducted in the above-captioned case, Da
`
`Wuster, Corp. has admitted that it has no involvement with the importation, storage, shipment,
`
`advertising/marketing and/or sale/transfer of airsoft guns. As such, Petitioner finds it suspicious
`
`that Da Wuster, Corp. would have registered its G19 trademark for an airsoft gun. Accordingly,
`
`upon information and belief, Petitioner believes Registrant has licensed the use of G19 to The
`
`Wuster and/or airsplat.com to be used on airsoft products.
`
`11. Through its actions, Registrant has continuously engaged in unfair competition and
`deceptive trade practices by copying and using Petitioner’s distinctive trade dress and trademarks
`to market and sell unlicensed and unauthorized replica airsoft pistols, which violate GLOCK’s
`trade dress, through its AirSplat business.
`
`12. To further its business of marketing and selling counterfeit goods, Registrant filed an
`
`application for Registration No. 3,828,065 in IC 028 on December 31, 2009. Registrant filed for
`registration on the Principal Register for the mark “G19” (hereinafter referred to as the “G19
`Mark”) for paintball guns and toy guns.
`13. As part of its application, Registrant submitted a trademark specimen. This digital
`specimen depicted cardboard packaging typically used to sell Registrant’s airsoft pistols. This
`particular box displayed an image of an airsoft pistol and the description “Railed Frame G19.”
`True and correct copies of Registrant’s specimen are attached as Exhibit D. The airsoft pistol
`displayed on the box was not in fact the actual “G19” offered for sale by Registrant. The KWA
`G19, a replica airsoft pistol, was the actual pistol Registrant was using its mark on. True and correct
`
`copies of the KWA G19 offered for sale by Registrant are attached as Exhibit E. The photo on the
`airsoft box submitted as Registrant’s specimen was photo shopped by Registrant to instead depict
`the non-infringing “UHC USP Gas Airsoft non-blowback” also offered for sale on airsplat.com.
`True and correct copies of the UHC airsoft pistol offered on Registrant’s website at the time of
`registration, is attached as Exhibit F. The G19 Mark was later registered on August 3, 2010.
`
`14. The KWA G19 pistol is now offered for sale as the KSC G19 on airsplat.com. True and
`correct copies of images from Registrant’s website are attached as Exhibit G. KSC is a Japanese
`
`

`company that focuses on Research and Design in the Japanese airsoft market, and KWA is a
`
`Taiwanese company that was the Original Equipment Manufacturer for KSC. As such, the two
`
`companies are intertwined and products are often sold under either interchangeable name. The
`
`KWA/KSC G19 constitutes counterfeit merchandise. It violated and still violates the trademark
`
`and trade dress registrations of Petitioner.
`
`
`
`First Basis for Cancellation-Fraud
`
`
`
`15. Registrant intentionally and knowingly submitted a fraudulent specimen to the USPTO
`
`with the intent to induce authorized USPTO agents to grant its registration.
`
`16. In an effort to deceive the Examining Attorney, Registrant fabricated its submitted
`specimen; digitally replacing a replica “GLOCK 19” airsoft pistol image on the cover of the “G19”
`airsoft box with a non-infringing pistol. For comparison, a true and correct copy of the actual
`“Railed Frame G19” airsoft pistol box, manufactured by KWA and offered for sale by Registrant
`as the KWA G19 is attached as Exhibit H. Registrant not only deceptively changed the pistol
`photograph for its specimen, but also concealed the “KWA” manufacturer information by placing
`a customer warning label over their name.
`
`17. Registrant knew that if it submitted the actual KWA box which it shipped to customers
`
`with a counterfeit pistol on the cover of the box, that the Examining Attorney would likely have
`
`raised questions such as whether Registrant was affiliated with or endorsed by Petitioner and
`
`whether it had the authority or any possible licenses, which would allow it to sell a GLOCK replica
`airsoft pistol with GLOCK’s federally registered trademarks.
`18. On December 30, 2009, Registrant filed a sworn declaration, signed under penalty of
`
`perjury by Mr. Kent Wu, with the USPTO. In his declaration, Mr. Wu swore that Registrant
`believed “no other person, firm, corporation, or association has the right to use the mark in
`commerce, either in the identical form thereof or in such near resemblance thereto as to be likely,
`
`when used on or in connection with the goods/services of such other person, to cause confusion,
`or to cause mistake, or to deceive.” Given the widespread use of G19 by Petitioner prior to 2009,
`and the fact that AirSplat was intentionally and wrongfully associating several models of airsoft
`
`pistols it sold with GLOCK pistols, such statements were undoubtedly false at the time that they
`
`were made.
`

`19. It is inconceivable that Registrant was unaware at the time of registration that Petitioner
`manufactured authentic firearms, namely, the G19. Not only is Petitioner’s G19 pistol the firearm
`of choice for law enforcement and military, but it has been featured in dozens of television shows
`
`and movies dating back to The Hard Way in 1991, and more recently highlighted on Law and
`
`Order, The Bourne Legacy and No Country for Old Men. True and correct copies of images from
`the Internet Movie Firearms Database website are attached as Exhibit I. Registrant’s trademark
`registration was fraudulently obtained and therefore should be canceled.
`
`20. It is a principal of law that he who first affixes a trademark upon his own goods is the
`
`owner of the trademark. Transclean Corp. v. Bridgewood Services, Inc., 77 F.Supp 2d 1045, 1093
`(1999). Despite Registrant’s conniving attempt to deceive the USPTO, Registrant does not itself
`manufacture any goods with the G19 Mark. The G19 airsoft pistols and all GLOCK counterfeit
`
`pistols that Registrant sells are manufactured by third parties in Asia, namely in Hong Kong and
`
`Taiwan.
`21. Therefore, for the above reasons, Registrant’s actions constitute fraud, and therefore its
`registration should be cancelled.
`
`
`
`Second Basis for Cancellation -Likelihood of Confusion
`
`
`
`22. Registrant’s G19 Mark is essentially an arbitrary arrangement of letters and numbers
`except for its relation to Petitioner’s pistol model. As an arbitrary mark, Petitioner is entitled to the
`widest ambit of protection for G19.
`
`23. The marks are identical when comparing the overall impression created by the designation,
`
`pronunciation, and meaning.
`
`24. Both Petitioner and Registrant use G19 for similar goods.
`25. Petitioner’s goods and Registrant’s category of goods are both offered for retail sale to
`consumers in some sporting goods stores. For example, Petitioner’s G19 pistol is offered for sale
`at Bass Pro Shop, a retailer which also offers airsoft pistols for sale. True and correct copies of
`images from Bass Pro Shop’s website are attached as Exhibit J.
`26. Registrant’s G19 Mark is identical to Petitioner’s use of the same mark to describe its
`pistol, and is likely, when applied to Registrant’s advertised goods, to cause confusion or mistake
`or to deceive by creating the erroneous impression that Registrant’s advertised goods originate
`
`

`with or are associated with Petitioner, or that Registrant’s goods are authorized or sponsored by
`Petitioner.
`
`27. Registrant has attempted, as a junior user of the mark, to exploit and capitalize on the
`
`goodwill and reputation of Petitioner with the intent to create confusion between the two
`companies’ products.
`28. Registrant has imitated Petitioner’s trademark and has succeeded in creating confusion as
`evidenced by reviews of the KSC G19 on airsplat.com, which refer to the pistol as a “KSC/KWA
`GLOCK.” True and correct copies of images from Registrant’s website are attached as Exhibit K.
`29. Registrant expects and welcomes confusion and resultant profit from its illegal activity
`and continuous infringement, and has purposefully traded on Petitioner’s goodwill by using the
`same mark to advertise and sell its products.
`30. Therefore, for the above reasons, Registrant’s G19 Mark is likely to cause confusion.
`
`
`Third Basis for Cancellation –Dilution
`
`
`
`31. Petitioner is, and will continue to be, damaged by the existence of Registration No.
`3,828,065 because said registration is so deceptively identical to Petitioner’s famous trademark so
`as to dilute the G19 mark and harm Petitioner’s reputation.
`32. Cancellation of Registrant’s G19 Mark should be granted pursuant to Section 43(c) of the
`Lanham Act, 15 U.S.C. §1125(a)-(d) on the grounds that Petitioner is, and will continue to be,
`
`damaged by said registration because the registration dilutes the distinctive and famous quality of
`Petitioner’s mark.
`33. Cancellation of Registrant’s G19 Mark should be granted pursuant to Section 2(a) of the
`Lanham Act, 15 U.S.C. §1052(a) on the grounds that Respondent’s use of said registration
`intentionally and falsely suggests a connection between Registrant and Petitioner, resulting in
`damage to Petitioner’s reputation.
`34. Registrant’s use of G19 to identify other sources of goods besides Petitioners makes it
`difficult for Petitioner to clearly identify and distinguish its famous mark.
`35. Therefore, for the above reasons, Registrant’s G19 Mark dilutes the distinctive quality of
`Petitioner’s famous trademark.

`Fourth Basis for Cancellation-Bad Faith
`
`
`
`36. Registrant knew and consciously disregarded the fact that at the time of its registration,
`
`Petitioner manufactured, advertised and offered for sale a GLOCK 19 Model pistol, referred to as
`
`the G19 in product materials, including product manuals, advertising and marketing materials both
`
`in print and online. Registrant is aware of the fact that airsoft manufacturers use G19 and other
`models from the G Pistol Family in order to create an association in consumers’ minds of airsoft
`pistols with GLOCK pistols.
`37. When typing “GLOCK” into the airsplat.com search engine, numerous infringing airsoft
`pistols are offered for sale besides the KSC G19 Pistol. The WE G19 pistol is another G19 pistol
`offered by Registrant. This counterfeit G19 pistol also utilizes Petitioner’s federally registered
`trade dress (Reg. Nos. 2807747, 280774). The pistol displays the federally protected GLOCK logo
`(Reg. Nos. 4038822, 2856646, 1755206), the number “19” and the word “Austria” along the side
`of the pistol slide. True and correct copies of images from Registrant’s website are attached as
`Exhibit L.
`
`38. Petitioner purchased a KSC G19 pistol offered for sale on airsplat.com. The pistol arrived
`
`in a plain unmarked cardboard box. All advertisements related to the pistol were concealed on the
`
`interior of the box. Upon information and belief, Registrant purposefully uses reversible boxes in
`
`shipping its airsoft pistols so as to deceive Customs and Border Protection (CBP). The KSC G19
`had a piece of removable electrical tape, which masked the “G” and “19” at the front of the pistol
`slide. Upon information and belief, this misleading packaging and obscuring of the products’
`marking is employed by Registrant as a way to deceive CBP, so that the inevitable connection
`
`between the counterfeit pistols and GLOCK pistols cannot be made. True and correct images of
`
`the KSC G19 are attached as Exhibit M.
`
`39. Registrant had the opportunity to choose any mark and without coincidence, chose a mark
`confusingly similar to Petitioner’s with the intent that the public might fail to distinguish between
`the two.
`40. Due to Petitioner’s well-known and strong trademark, and the identical format of the
`G19 Mark used by Registrant, Registrant carries the burden of explanation and persuasion as to its
`
`motive in adopting the mark.

`41. The continued registration of U.S. Registration No. 3,828,065 is contrary to 15 U.S.C.
`1052(d) and violates and diminishes Petitioner’s prior and superior rights in G19.
`42. Petitioner has been damaged and will continue to be damaged by Registrant’s G19 Mark.
`This registration provides false notice to the public that Registrant is associated with, endorsed by,
`
`sponsored by or affiliated with Petitioner, which it is not.
`43. Registrant’s G19 Mark was obtained in and motivated by bad faith, and without license,
`authorization or permission from Petitioner to promote the sale of replicas and counterfeit airsoft
`
`pistols.
`
`
`
`WHEREFORE, Petitioner prays that this Petition for Cancellation be granted, that U.S.
`
`Registration No. 3,828,065 be cancelled, and for any and all other relief the Trademark Trial and
`
`Appeal Board may deem just and proper.
`
