`
`RODRIGUEZ v. COCA-COLA COMPANY
`
`The court previously construed submissions received
`
`on May 20, 2020, June 26, 2020, and June 29, 2020, ECF
`Nos. 16, 17, and 18, collectively as a petition for rehearing
`of the court’s May 20, 2020 order granting the Coca-Cola
`Company’s motion to dismiss this appeal from a non-final
`decision of the Trademark Trial and Appeal Board. The
`court’s July 6, 2020 order denied that petition for rehear-
`ing.
`
`The court’s rules do not contemplate multiple petitions
`for panel rehearing. Moreover, to the extent the court con-
`siders the merits of ECF No. 20, the petition provides no
`basis for rehearing. This court has explained that it lacks
`jurisdiction here because the order from which Mr. Rodri-
`guez appeals is not final. Mr. Rodriguez now argues that
`he “can petition for writ of mandamus,” ECF No. 20 at 3,
`but no such petition has been filed. Mr. Rodriguez also con-
`tends that the court’s May 20, 2020 order states errone-
`ously that he had not “timely responded to either the show
`cause order or the motion” to dismiss. Id. at ii and Appx10.
`Timely responses were due May 12, 2020 and May 4, 2020,
`respectively, and Mr. Rodriguez does not point to any such
`response having been received by the court. In any event,
`the court has explained that all matters have been dock-
`eted and before the court for consideration.
`
`Accordingly,
`
`IT IS ORDERED THAT:
`
`The petition is dismissed.
