`headquarters and principal place of business at 4905 Dickens Road, Suite 100,

`Richmond, Virginia 23230.

`Leading Edge Filings, Inc. (“Respondent”) is an Illinois corporation with
`
`its principal place of business at 2054 Parkside Drive, Park Ridge, Illinois 60068, which
`
`is cited in United States Patent and Trademark Office (“USPTO”) records as the address
`
`of record for the trademark registrations at issue, trademark registration nos. 3,629,166
`
`and 3,765,736.

`Petitioner’s Mark

`Petitioner owns and uses the mark LEADING-EDGE LAW GROUP, PLC
`
`(“Petitioner’s Mark”). This mark is the subject of Petitioner’s pending federal mark
`
`registration application (USPTO serial no. 85,224,962) for the following services (at
`
`present) in Class 45: “intellectual property legal services.” (These are “Petitioner’s
`
`Services”) As requested by the examining attorney, these services will be amended to the
`
`following description: “Providing information in the field of intellectual property legal
`
`services; legal services, namely, intellectual property consulting services in the field of
`
`invention, identification, strategy, and analytics.” (This application is “Petitioner’s Mark
`
`Registration Application”; a copy of the USPTO’s electronic record of it is attached
`
`hereto as Exhibit 1.)

`In addition to this registration application, Petitioner owns a valid, in-force
`
`Virginia state mark registration for Petitioner’s Mark, which registration was issued on
`
`June 9, 2004 and renewed in 2009. (A copy of this registration is attached hereto as
`
`Exhibit 2.)
`

`Also, as detailed below, Petitioner has had continuous, common-law rights
`
`in Petitioner’s Mark since at least as early as July 1, 2002.
`

`
`Petitioner’s Mark is inherently distinctive because it is suggestive.
`
`Petitioner’s Senior, Prolonged Trademark Use
`
`7.
`
`Since at least as early as July 1, 2002, Petitioner continuously has used
`
`Petitioner’s Mark in interstate commerce to promote the sale of Petitioner’s Services.
`

`
`During that time, while using Petitioner’s Mark to identify the source of
`
`its services, Petitioner has performed intellectual property legal services for over 200
`

`clients (close to 300). These clients have included some large, publicly traded companies
`
`and many privately held companies and some private individuals. These clients have
`
`included companies from many different states in the United States and fiom foreign
`
`countries. Petitioner has earned at least several million dollars in gross fee payments by
`
`doing business under Petitioner’s Mark during that time.
`

`Petitioner has earned substantial market recognition for Petitioner’s Mark.
`
`Chambers USA has recognized Petitioner as one of the best intellectual property law
`
`practices in Virginia every year since and including 2005. Petitioner’s lawyers have
`
`earned substantial professional recognition while practicing intellectual property law
`
`under Petitioner’s Mark, such as individual rankings in Chambers USA, Best Lawyers in
`
`America and Super Lawyers, in addition to “AV” ratings from Martz’na’aZe—Hubbell. One
`
`of Petitioner’s lawyers has written a newspaper column that identifies the author as being
`
`an attorney with the Petitioner (thus, using Petitioner’s Mark), that concerns principally
`
`intellectual property and technology law, and that has been published on a monthly basis
`
`in the Richmond Times-Dispatch (the dominant newspaper for the Richmond, Virginia
`
`metropolitan area) for well over a decade.
`

`As a result of Petitioner’s prevalent use of the Petitioner’s Mark, its efforts
`
`and expenditures for promotional activities, and by virtue of the high quality of its
`
`services, the legal industry and the public have come to associate the Petitioner’s Mark
`
`with Petitioner, as indicating that the services identified and marketed by the Petitioner’s
`
`Mark originate with Petitioner.

`Respondent’s Mark Registrations

`Respondent is the owner of the federal mark registrations for the mark
`
`LEADING EDGE FILINGS (“Respondent’s Mark Registrations”) as follows:

`(A)
`
`LEADING EDGE FILINGS (words-only mark) for “Providing
`
`legal document preparation services via a website on a global computer network;
`
`providing legal information in the field of intellectual property via a website on a global
`
`computer network; legal research in the field of intellectual property; public document
`
`filing services via a website on a global computer network.” (USPTO registration no.
`
`3,629,166.) The application to register this mark was filed on April 21, 2008, and issued
`
`on June 2, 2009. In its application to register this mark, Respondent declared that its dates
`
`of first use and first use in commerce both were June 16, 2006.
`
`(B)
`
`LEADING EDGE FILINGS (words-only mark) for “Preparing and
`
`filing incorporation papers.” (USPTO registration no. 3,765,736.) The application to
`
`register this mark was filed on November 10, 2008, and issued on March 30, 2010. In its
`
`application to register this mark, Respondent declared that its dates of first use and first
`
`use in commerce both were July 1, 2006.
`
`Ground for Cancellation — Likelihood of Confusion
`

`
`Petitioner incorporates here by reference all of the preceding paragraphs.
`

`
`For the following reasons, the continued existence of Respondent’s Mark
`
`Registrations on the Principal Register (i) is contrary to and/or in violation of the
`
`provisions of 15 U.S.C. §§ 1051 e_t fig (ii) will result in damage to Petitioner and the
`
`public; and (iii) should be cancelled pursuant to 15 U.S.C. § 1064.

`Respondent’s Mark (LEADING EDGE FILINGS) so resembles
`
`Petitioner’s Mark (LEADING-EDGE LAW GROUP, PLC) as to be likely, when applied
`
`to Respondent’s Services, to deceive the public, to falsely suggest a connection of the
`
`Respondent with the Petitioner, and to create a likelihood of confusion with Petitioner
`
`and Petitioner’s Mark, with consequent injury to Petitioner, to Petitioner’s Mark and to
`
`the goodwill associated with it, to the trade, and to the public.
`

`
`Petitioner applied on January 24, 2011, to the USPTO to register on the
`
`Principal Register Petitioner’s Mark (USPTO serial number 85,224,962). On December
`
`5, 2012, the USPTO’s trademark examining attorney issued a final office action rejecting
`
`Petitioner’s Mark Registration Application on the basis of likelihood of confusion with
`
`Respondent’s Mark Registrations. (A copy of this office action is attached as Exhibit 3.)
`
`16.
`
`Petitioner has Written to Respondent in an effort to see if a mark-
`
`coexistence agreement would be possible — one that would permit the granting of
`
`Petitioner’s Mark Registration Application despite the existence of Respondent’s Mark
`
`Registrations. Respondent wrote back in a letter dated November 7, 2011, rejecting
`
`Petitioner’s request. Respondent wrote that Petitioner’s Mark and Respondent’s Mark are
`
`in “direct conflict.” Respondent also wrote that its first date of use of Respondent’s Mark
`
`in interstate commerce of its mark was in 2006. (A copy of this letter is attached as
`
`Exhibit 4.)

`Thus, both the USPTO examining attorney and Respondent have taken the
`
`Written position that there is a likelihood of confusion between Petitioner’s Mark and
`
`Respondent’s Mark.

`Petitioner has seniority of usage (and usage in commerce) of Petitioner’s
`
`Mark over Respondent’s use (and usage in commerce) of Respondent’s Mark.
`

`
`Petitioner’s Services are so closely related to Respondent’s Services that
`
`prospective customers would be likely to be confused, to be deceived, and to assume
`
`erroneously that Respondent’s Services are those of Petitioner, or that Respondent has
`
`been licensed to use Petitioner’s Mark by Petitioner, or that Respondent is in some way
`
`connected With, or sponsored by, Petitioner.
`

`Usage of Respondent’s Mark would lessen the capacity of Petitioner’s
`
`Mark to identify and distinguish Petitioner’s services. Use by Respondent of
`
`Respondent’s Mark would cause the distinctiveness of Petitioner’s Mark to be diminished
`
`and would thereby damage Petitioner, and would cause damage to the goodwill
`
`associated with Petitioner’s Mark.
`
`21.
`
`The likelihood of damage to Petitioner’s goodwill in Petitioner’s Mark is
`
`enhanced because prospective customers who encounter poor performance of
`
`Respondent’s Services would be likely to attribute those shortcomings to Petitioner.
`
`22.
`
`Overall, Petitioner would be damaged by the continued registration of
`
`Respondent’s Mark because such registration would support and assist Respondent in the
`
`confusing and misleading use of Respondent’s Mark, and such continued registration
`
`would give color of exclusive statutory rights to Respondent in violation and derogation
`
`of the prior, superior and exclusive rights of Petitioner.
`
`WHEREFORE, Petitioner respectfully requests that this petition to cancel be
`
`sustained and that Registration nos. 3,629,166 and 3,765,736 be cancelled as requested in
`
`this petition.
