`
`Donelson, Bearman, Caldwell and Berkowitz, P.C., and hereby responds to Petitioner Jeffrey
`
`Kaplan's ("Kaplan") First Set of Written Interrogatories to Registrant.
`
`GENERAL OBJECTIONS
`
`1.
`
`Insight’s responses and objections are made solely for the purpose of this action.
`
`Each response is subject to all objections as to competence, relevance, materiality, propriety and
`
`admissibility, and any and all other objections and grounds that would require the exclusion of
`
`any statement contained herein if made by any witness present and testifying in court or
`
`arbitration. All such objections and grounds are reserved and may be interposed at the time of
`
`trial or arbitration.
`
`2.
`
`The following responses are based upon infonnation presently available to Insight
`
`based upon a reasonably diligent investigation. Except for explicit facts admitted herein, no

`
`incidental or implied admissions are intended hereby. The fact that Insight has answered all or
`
`part of any interrogatory is not intended and shall not be construed to be a waiver of any
`
`objection to any interrogatory.
`
`Insight reserves the right
`
`to supplement or modify these
`
`responses based upon the discovery of additional or different information.
`
`3.
`

`
`Insight does not agree to abide by any such additional instructions or requirements.
`
`4.
`
`5.
`

`
`Insight objects to any interrogatory to the extent that it seeks information and/or
`
`documents protected by the attomey-client privilege and/or the work product doctrine.
`
`6.
`
`Insight objects to these interrogatories in their entirety to the extent that they seek
`
`infonnation and/or documents not in the possession, custody, or control of Insight on the grounds
`
`that such interrogatories are overly broad and unduly burdensome, and constitute annoyance,
`
`harassment, and oppression.
`
`7.
`
`Insight conducted the search for infonnation and documentation in connection
`
`with Petitioner's First Set of Written Interrogatories with the necessary degree of diligence to
`
`locate responsive information and documents,

`
`RESPONSES TO INTERROGATORIES
`
`Subject to and without waiving its General Objections, Registrant provides the following
`
`responses:
`
`1.
`
`Identify the person or persons who created the name ASPERGUM.
`
`RESPONSE NO. 1:
`
`Insight objects to this Interrogatory as seeking information that is
`
`neither relevant nor likely to lead to the discovery of admissible evidence. The identity of the
`
`person or persons that created the trademark ASPERGUM has absolutely no bearing on issue in
`
`this case. The U.S. Registration for ASPERGUM is valid and incontestable.
`
`2.
`Identify the date and from whom if applicable, Registrant acquired the trademark
`rights to ASPERGUM.
`.
`
`RESPONSE NO. 2:
`
`Insight objects to this Interrogatory as seeking information that is
`
`neither relevant nor likely to lead to the discovery of admissible evidence. The date Registrant
`
`acquired the trademark rights is not relevant to any issue in this case. Further such information is
`
`readily available to Kaplan from public domain sources — namely, the USPTO website.
`
`3.
`
`Identify the total number of units or cases by year that were manufactured and/or
`
`co-packed for and sold by Registrant that used the mark ASPERGUM for the following years:
`
`2006, 2007, 2008, 2009 and 2010 in interstate commerce.
`
`RESPONSE NO. 3:
`
`Insight objects to this Interrogatory as overly broad, unduly
`
`burdensome, and seeking information that is neither relevant not likely to lead to the discovery
`
`of admissible evidence. Further, Insight objects to this lnterrogatory as vague and ambiguous in
`
`its use of the word “co-packed." Subject to and without waiving any of its general or specific

`objections, and pursuant to Fed. R. Civ. P. 33(d), Registrant attaches hereto as Exhibit A
`
`business records showing its sales and credits for the years 2005 through 2010.
`
`4.
`
`In regard to each item identified in your response to Interrogatory 3 state:
`
`a.
`
`The wholesale dollars valuation of total sales by each year.
`
`RESPONSE N0. 4: Registrant objects to this Interrogatory as vague, ambiguous, overly
`
`broad, unduly burdensome, and seeking infonnation that is neither relevant not likely to lead to
`
`the discovery of admissible evidence. Further, Insight objects to this Interrogatory as vague and
`
`ambiguous based on its use of “wholesale dollars valuation." Subject to andlwithout waiving
`
`any of its general or specific objections, and pursuant to Fed. R. Civ. P. 33(d), Registrant
`
`attaches hereto as Exhibit A business records showing its sales and credits for the years 2005
`
`through 2010.
`
`5.
`
`Identify the person or persons employed by Registrant who had primary
`
`responsibility in the ongoing research, development and manufacturing of each of the products
`
`that used the mark ASPERGUM for the following years: 2006, 2007, 2008, 2009 and 2010.
`
`RESPONSE NO. 5:
`
`Insight objects to this lnterrogatory as vague, ambiguous, overly
`
`broad, unduly burdensome, and seeking infonnation that is neither relevant nor likely to lead to
`
`the discovery of admissible evidence.
`
`Subject to Registrant’s General Objections and the
`
`foregoing objections, Dennis Kinsey, who is employed by Registrant and may be contacted only
`
`through Registrant’s counsel.
`
`6.
`
`Identify those persons employed by Registrant who it reasonably believes to have

`and 2010.
`
`RESPONSE NO. 6: Insight objects to this Interrogatory as overly broad. Subject to the
`
`foregoing and its General Objections, Insight states that Mike Tukdarian has information
`
`concerning the sales, marketing and channels of distribution for products sold under the
`
`ASPERGUM mark for the years 2006-2010.
`
`7.
`

`
`the discovery of admissible evidence. Subject to and without waiving any of its general or

`specific objections, Registrant states that it did maintain a web page on www.insightpharma.com,
`
`prior to October 2010, for promoting and advertising products bearing the mark ASPERGUM.
`
`8.
`
`Identify the Registrant's intemet web page and or URL address that informs the

`public that their product named ASPERGUM will be re—launched or re-introduced to the general
`
`public for the years: 2006, 2007, 2008, 2009 and 2010.
