`Ogee, Inc., a Delaware corporation, with an address at 1 Lawson Lane, Suite 130,

`Burlington, Vermont 05401 (hereinafter, “Opposer”), believes that it will be damaged by the
`
`registration of the LIQUID GOLD mark, which is set forth in Application Serial No. 98176558,
`
`filed by Liquid Gold Hair LLC, a North Carolina limited liability company, having an address at
`
`8350 Univ Executive Park Dr. Ste 350, Charlotte, North Carolina 28262 (hereinafter,
`
`“Applicant”), and hereby opposes registration of the same.
`
`As grounds for opposition, Opposer alleges as follows:
`
`1.
`
`Opposer has been engaged in the manufacture and sale of cosmetics since at least
`
`as early as 2016.
`
`2.
`
`Opposer has manufactured and sold a “liquid gold” cleansing oil in the United
`
`States since as early as November 2018. Opposer needs to be able to use this designation in
`
`connection with the promotion and sale of its cleansing oil. Attached as Exhibit A is a true and

` The term “liquid gold” has been used by the public and numerous cosmetics
`
`manufacturers to describe a key characteristic of cosmetic products. For example, the following
`

`register “liquid gold” as a trademark with the United States Patent and Trademark Office in
`
`connection with a variety of cosmetic products and related retail services of cosmetics, without
`
`disclaiming any portion of the alleged mark or claiming acquired distinctiveness.
`

`On June 11, 2024, the USPTO approved publication of Application Serial
`
`No. 98176558 for, inter alia, the following goods and services:
`
`Class 3: Cosmetics; Perfume; Bar soap; Body butter; Body wash; Carrier oils for cosmetic
`purposes; Cosmetic creams; Cosmetic creams for skin care; Cosmetic preparations for

`The entirety of Applicant’s mark describes an appearance and characteristic of the
`
`goods, in that “liquid gold” describes fluid cosmetic products with a yellow hue, especially those
`
`that are valuable.
`
`24.
`
`The wording “liquid gold” is so laudatory and descriptive of Applicant’s goods
`
`and services as to be incapable of acquiring distinctiveness as a trademark.
`
`25.
`
`Thus, Applicant’s alleged mark is not registerable on the Principal Register or
`
`Supplemental Register. See In re Gabriel Sezanayev, Serial No. 90641384, 2024 WL 3507624, at
`
`*4 (TTAB July 8, 2024) (the Board affirmed a decision to refuse registration of the “the original
`
`pineapple” for alcoholic beverages as “original” was a laudatory of the alleged merit of a product
`
`and the wording “the original pineapple” was merely descriptive) ; In re Boston Beer Co., 198
`
`F.3d 1370, 53 USPQ2d 1056, 1058-59 (Fed. Cir. 1999) (“The Best Beer in America,” although
`
`not generic name of the goods, is such a commonly used laudatory phrase that is incapable of
`
`registration as a trademark).
`

`Registration of the Application is barred by Section 2(e)(1) of the Trademark Act,
`
`15 U.S.C. § 1052(e)(1) because Applicant seeks to register wording that is highly laudatory and
`
`merely descriptive of the goods and services inasmuch as it describes an ingredient, quality,
`
`character, function, feature, purpose, or use of the specified goods or services.
`
`27.
`
`Applicant has not provided proof that “liquid gold” has acquired distinctiveness in
`
`connection with each of the goods and services listed in the Application, and the wording
`
`therefore is not registerable on the Principal Register under §2(f) of the Trademark Act, 15
`
`U.S.C. § 1052(f).
`
`28.
`
`Registration of the Application would provide color of prima facie exclusive
`
`rights to Applicant to use the “liquid gold” wording. Therefore, allowing registration of
`
`

`Applicant’s mark is a source of damage and injury to Opposer inasmuch as it would preclude
`
`Opposer form using the same or similar descriptive wording or phrasing in its advertising for
`
`cosmetic products. See In re Abcor Development Corp., 588 F.2d 811, 813, 200 USPQ 215, 217
`
`(C.C.P.A. 1978) (descriptive marks should not be registered to maintain freedom of the public to
`
`use the language involved, thus avoiding the possibility of harassing infringement suits by the
`
`registrant against others who use the mark when advertising or describing their own products).
`
`29.
`
`Registration of the Application should be refused in order to maintain freedom of
`
`the public and Opposer to use the laudatory and descriptive wording in the Application that is
`
`necessary to advertise and properly describe Opposer’s own products.
`
`30.
`
`Opposer will thereby be injured by the registration of Application Serial
`
`No. 98176558.
`
`WHEREFORE, Opposer asks that its opposition be sustained and that registration to
`
`Applicant be refused in Classes 3 and 35.

`penetration of the Liquid Gold (optional step). Then. apply approximately 1 dropper
`full to cover the face. Do not put anything on top.Thinkofit like a mask that stays on
`all night.
