`| Love Daiquiris LLC (Applicant) does not agree with anyof the alleged claims from
`Bodegas Caro S.A. (Opposer). This documentwill serve as “Exhibit A”.

`1s Applicant’s ARUMBA Mark and Opposer’s ARUMAMark are not similar in
`appearance as can be seen in attached, “Exhibit B” and “Exhibit C”.
`. The goods covered by the Applicant’s ARUMBA Markare “wine-based cocktails”.
`ARUMBAis made from “Other Than Standard Orange Wine”. This is a clear colored
`product made from oranges. The ARUMBAproducthas artificial rum flavoring
`added as per the label. It is used as a neutral tasting wine-base for daiquiri and
`margarita type drinks. “Exhibit B”
`. The goods covered by the Opposer’s ARUMA Markare “wines”. Their productis a
`Malbec. This is a dark red table wine made from grapes.
`It is characterized as a
`medium to full-bodied red wine. “Exhibit C”
`. The Applicant’s ARUMBAproductis packaged in 5-gallon cardboard boxes or 4-liter
`plastic bottles. “Exhibit B”
`. The Opposer’s ARUMAproductis packaged in 750ml glass bottles. “Exhibit C”
`. The proposed mark in our ARUMBAapplication will in no way cause confusion,
`mistakes, or deception when used in connection with the proposed goods and
`services.
