`Opposer, Chums, Inc., is a Utah corporation with a business address located at 2424 South
`
`2570 West, Salt Lake City, Utah 84119 (“Opposer”). Opposer believes that it will be damaged by
`
`the issuance of a registration for the trademark TOOLCHUMS (“Applicant’s Mark”) as applied
`
`for by Guansheng Li (“Applicant”) in Application Serial No. 98/253,394 (the “Application”).
`
`Accordingly, Opposer hereby opposes registration of Applicant’s Mark and requests that the
`
`registration of the Application be refused.
`
`
`
`As grounds in support of its opposition, Opposer asserts as follows:

`Opposer is in the business of providing a wide variety of consumer products,
`
`including, without limitation, eyeglass retaining straps, eyeglass chains, eyeglass cords, cords for
`
`sunglasses, straps for sunglasses, pince-nez, carrying cases for personal electronic devices, cases

`accessories, and a variety of other goods (“Opposer’s Goods”).

`Opposer, since at least as early as 1996, and long prior to the filing date and the
`
`alleged October 19, 2023, date of first use for Applicant’s Application, has used the CHUMS,
`
`HANG WITH YOUR CHUMS, and other CHUMS-formative marks (“Opposer’s Marks”) in
`
`connection with its marketing and promotion of Opposer’s Goods.

`Opposer is the owner of U.S. Registration Nos. 7,381,284, 7,367,509, 6,612,694,
`
`6,612,693, 6,075,221, 5,729,903, 5,648,968, 5,186,140, 4,277,154, 4,094,394, 4,094,384,
`
`4,094,383, 4,094,382, 2,915,595, 2,432,635, and 1,335,312 for use of Opposer’s Mark with
`
`Opposer’s Goods (“Opposer’s Registrations”). Opposer’s Registrations are valid, subsisting,
`
`unrevoked, and uncanceled. A true and correct copy of a printout of each of Opposer’s
`
`Registrations from the U.S. Patent and Trademark Office’s (“USPTO”) Trademark Status &
`
`Document Retrieval (“TSDR”) system is attached hereto as Exhibit A.

`Opposer’s Mark is an invented, fanciful mark that is highly distinctive. Opposer’s
`
`Mark has no descriptive meaning as applied to the marketplace or to any of Opposer’s Goods in
`
`connection with which it uses Opposer’s Mark.

`Opposer has expended considerable effort and expense in promoting Opposer’s

`Mark and Opposer’s Goods offered in connection with Opposer’s Mark, both in the United States
`
`and internationally.

`On November 3, 2023, Applicant filed the Application requesting registration of
`
`Applicant’s Mark for use in connection with “Headphones; Microphones; Microscopes; Radios;
`
`Telescopes; CD players; Hand-held microphone sleeves; Loudspeaker systems; Personal stereos”
`
`in Class 9 (“Applicant’s Goods”). The Application was assigned Ser. No. 98/253,394. A true and
`
`correct copy of a printout from the USPTO’s TSDR system for Applicant’s Application is attached
`
`hereto as Exhibit B.
`

`Opposer is not affiliated or connected with Applicant or Applicant’s Goods; nor
`
`has Opposer endorsed or sponsored Applicant or Applicant’s Goods or consented to Applicant’s
`
`registration or use of Applicant’s Mark.

`Applicant’s Mark is confusingly similar to Opposer’s Mark and, when applied to
`
`Applicant’s Goods, are likely to cause confusion, mistake, or deception within the meaning of
`
`Section 2(d) of the Trademark Act. Opposer has no control over the nature and quality of
`
`Applicant’s Goods offered by Applicant under Applicant’s Mark, and Opposer’s reputation and
`
`goodwill will be damaged and the value of Opposer’s Marks jeopardized by Applicant’s
`
`registration and use of Applicant’s Mark.
