`
`HUGO BOSS AG
`
`v.
`
`Floyd Bennett
`
`
`
`Steven W. Ferrell Jr., Interlocutory Attorney:
`
`Applicant’s submission filed on July 5, 2024, failed to include proper proof of
`
`service as required by Trademark Rule 2.119(a). The proof of service is defective
`
`because it does not include the title of the submission, the name of opposing counsel
`
`or party, the date of mailing, the method of delivery, or the name and address or email
`
`address of the opposition counsel or party. In other words, Applicant has not filled in
`
`the blanks in his certificate of service.
`
`Trademark Rule 2.119(a) states that every submission filed in an inter partes
`
`proceeding must be served upon the other party or parties, and proof of such service
`
`must be made before the submission will be considered. See TRADEMARK TRIAL AND
`
`APPEAL BOARD MANUAL OF PROCEDURE (TBMP) § 113.02 (2024).
`
`
`
`
`
`Opposition No. 91290247
`
`
`Applicant is allowed until 10 days from the date of this order to submit a
`
`proper certificate of service, failing which the submission will receive no
`
`consideration.
`
`The Board informed the parties of the rules governing service and the service
`
`requirement in the notice of institution. Trademark Rule 2.119(b) sets forth the
`
`manner of service. See also TBMP § 113.04. The parties may access the record of this
`
`proceeding via TTABVUE at https://ttabvue.uspto.gov/ttabvue/.
