`NOTICE OF OPPOSITION

`
`Almires USA LLC, is a Limited-Liability Company with a business address of
`
`141 Canal Street, Mill #4, Floor 3, Unit J (the "Opposer").
`
`Opposer believes that it will be damaged by the registration of the mark in Trademark
`
`Application Serial No. 97638982 (“the Application”) and hereby opposes same.
`
`As grounds of opposition, Opposer alleges that:
`
`1. Opposer is in the business of manufacturing, marketing, distributing, and/or selling musical
`
`instruments, including, but not limited to, electric guitars and ukuleles.
`
`2. The Opposer is in the business of manufacturing, marketing, distributing, and/or selling in
`
`interstate commerce musical instruments with the mark JET, which is identical to the mark
`
`subject to Trademark Application Serial No. 97638982 (the "word mark JET").
`
`3. Opposer has invested substantial funds to promote these guitars and in the creation and
`
`maintenance of goodwill in its guitars and the intellectual property associated therewith.
`

`4. Upon information and belief, Applicant Fred W. Gretsch Enterprises Ltd. ("Applicant") is a
`
`corporation established under the laws of ILLINOIS, and having an address at 200
`
`Governor Treutlen Road, Suite 25, Pooler, GA 31322.
`
`5. Upon information and belief, Applicant manufactures, sells and distributes musical
`
`instruments, including, but not limited to, electric guitars and electric bass guitars.
`
`6. On October 19, 2022, Applicant filed a federal trademark application to register the word
`
`mark JET that it uses on its guitars. This application is the subject of Serial No. 97638982
`
`(the "Application").
`
`7. On or about October 19, 2022, Applicant filed a specimen in the Application for word mark
`
`JET. The specimen does not use the word mark JET alone. Rather, the specimen is
`
`composite and used in conjunction with other marks “G5260 ELECTROMATIC®”
`
`JETTM” or “ELECTROMATIC®” JETTM.” See, e.g., Exhibit A. The mark JET is never
`
`used alone to identify the product.
`
`8. Applicant filed Application No. 97638982 claiming exclusive rights to use the mark JET in
`
`connection with the goods.
`
`9. As of the filing date for Application No. 97638982, Applicant did not have an exclusive
`
`right to use the mark JET in connection with the goods.
`
`10. The Application was published in the Official Gazette on September 5, 2023.
`
`11. On or about 1989, Applicant or its predecessors-in-interest alleges it began using the word
`
`mark JET the subject of Application Serial No. 97638982 in connection with musical
`
`instruments, namely, guitars.
`
`12. Applicant did not seek to register the word mark JET with the U.S. Patent and Trademark
`
`Office (the "PTO") for nearly thirty-three (33) years until the Application was filed in 2022.
`

`13. The word mark JET has been used in commerce ubiquitously and concurrently by multiple
`
`third-party musical instrument companies for several decades, including but not limited to
`
`company names, product model names and product series.
`
`14. Upon information and belief, these manufacturers all used the word mark JET without any
`
`contest or complaint from Applicant.
`
`15. At any given point from 1963 to the present, it is demonstrable that countless products
`
`from third party manufacturers were marketed, advertised, and available to consumers in
`
`the relevant marketplace which contain the word “JET” that were confusingly similar or
`
`identical to the word mark JET.
`
`16. One of the earliest uses of Jet is found in Guild’s line of guitars. See Exhibit B. The Guild
`
`“Jet-Star” was introduced in 1963 with the “Jet-Star” Bass following in 1964.
`
`17. In the last five years, Guild has used the unhyphenated “JETSTAR” in the marketplace.
`
`See Exhibit C- offering a 1966 GUILD Jet Star Bass on Reverb. & See Exhibit D.
`
`18. YAMAHA’s use of the word mark JET on its guitar model name of “RGXA2 Jet Black
`
`[SN QNN183062].” See Exhibit E.
`
`19. Guild Guitar also has a line of electric guitars marked with the word mark JET. For
`
`example, see Starfire Jet 90 line of guitars. See Exhibit F.
`
`20. Jeffrey Earle Terwilliger, began using JET in commerce in 1999 as a mark for distributing
`
`string musical instrument products. See Exhibit G.
`
`21. Ibanez’s JET KING 2 is another electric guitar using the word mark Jet. See Exhibit H.
`
`22. JET Guitars provide several series of numbered guitars and basses each which falls under
`
`the mark JET or Jet Guitars. See Exhibit I.
`
`23. Vivian Guitars & Basses, uses the word mark Jet on it’s SONIC JET guitar. See Exhibit J .
`
`

`24. The word mark Jet is also sold by Aria Pro. See their J-1 Jet Series Electric Guitar, see
`
`Exhibits K and L.
`
`25. Reverend’s brand of solid body electric guitars includes the Jetstream 390. See Exhibits
`
`M, N and O..
`
`26. Cordoba offers a steel-string acoustic guitar, here the Fusion 5 Jet acoustic guitar. See
`
`Exhibit P.
`
`27. Similarly, brands such as Tagima and Airline each use the word mark JET alone or as part
`
`of a compound mark as their model names. Tagima sells JET BLUES guitars, Reverend
`
`additionally sells JETSTREAM guitars and Airline sells JETSONS JR. See Exhibits Q, R
`
`28. The above instances confirm that countless third-party guitar manufacturers were and still
`
`are marketed, advertised, and available to consumers in the music industry marketplace
`
`which use the word mark JET and variations of the same that were and are confusingly
`
`similar or identical to the word mark JET.
`
`29. Applicant consistently uses the word mark Jet with a prefix, a suffix and often times both.
`
`See Exhibit S. A short listing of some of Applicant’s guitar names using the word mark Jet
`
`is shown below but never is it used as a standalone mark for a guitar.
`

`31. Thus, Applicant’s own non-use of the word mark JET shows that the mark is never serves
`
`as a standalone mark.
`
`32. In addition to use of the word mark Jet on guitars, a substantial number of competitors have
`
`been or are currently using noticeably similar or identical word mark JET on multiple
`
`music instrument products such as, but not limited to effects pedals, speakers, amps,
`
`woodwind instruments, drums, and guitar slides.
`
`33. For instance, the instrument maker Dixon sells drum kits including the Jet Set Plus. See
`
`Exhibit T.
`
`34. By way of example, the word mark is used regularly on guitar effect pedal brands as well
`
`as individual pedals.
`
`35. The Maxon brand of pedals show an updated version of their 1970s Jetlyzer. Maxon offers
`
`its effect pedal called the Vintage Jet Riser Flanger Pedal. See Exhibit U.
`
`36. Also, the Warm Audio Jet Phaser is a guitar effect pedal providing an authentic re-creation
`
`of a similarly named guitar effect pedal from the 1970s. See Exhibit V.
`
`37. The Mooer brand of pedals offers the JET ENGINE Digital Flanger. The JET ENGINE is
`
`designed to recreate analog flange effects from the 70s and 80s. See Exhibit W.
`
`38. The JET pedal line of guitar effect pedals offers multiple types of pedals including the JET
`
`Micro and JET MCX. See Exhibit X In a YouTube interview, the owner of the line of
`
`pedals Edwin Jr. Thompson says his use of the word mark JET is taken from the initials in
`
`his name. See Exhibit Y “History of JET Pedals (and other cool things you don't want to
`
`miss)” https://www.youtube.com/watch?v=xa535tVaA_M. Additionally, see Exhibit Z
`
`http://digital.premeirguitar.com/january-2024 “JET PEDALS Eternity Delay.”
`

`39. An Ibanez effects pedal is offered under the name JD9 Jet Drive Overdrive. See Exhibit
`
`AA.
`
`40. Jensen is a manufacturer of speakers and speaker cabinets and has a long history tracing
`
`back to the early 1900s. In the late 1990s, it started to offer a line of speakers under the JET
`
`name. See Exhibit BB.
`
`41. A maker of preamps is known by the brand JET CITY. Jet City’s history began in 2009 and
`
`they offer a variety of amps including the Jet City 5L0 20 Red & White and the Jet City
`
`JCA20H 20-Watt Tube Guitar Amp Head from the 2010s. See Exhibits CC and DD
`
`42. Recently, Bad Cat started offering a new line of amplifiers called “Jet Black”. See Exhibit
`
`EE. https://www.premierguitar.com/news/bad-cat-jet-black.
`
`43. Moving to woodwind instruments, the word mark Jet has been used with mouthpieces that
`
`were well-known throughout the ‘60s and ‘70s under the brand Jet-Tone. See Exhibit FF.
`
`44. Similarly, in 2014, JodyJazz introduced the JET series of mouthpieces. See Exhibit GG.
`
`45. Also, in the category of woodwinds, specifically woodwind accessories, Fliphead provides
`
`mouthpieces for transverse flutes. The mouthpiece is offered in the color Jet Black. See
`
`Exhibit HH.
`
`46. Derivations of the word “Jet” are utilized in the music industry for more than guitars and
`
`basses. For instance, see the guitar slides such as the JetSlide Guitar Slide Brass 10,
`
`Exhibit II.
`
`47. As stated above, the word mark JET is commonly used in the musical instrument industry.
`
`The use is clearly apparent in names for amps and speakers and companies manufacturing
`
`the same Thus, the word mark JET on other music instrument products such as but not
`
`

`

`limited to effects pedals, speakers, amps, woodwind instruments, drums, and guitar slides
`
`are ubiquitous.
`
`48. Thus, consumers in the relevant marketplace often see the word mark JET on guitar and
`
`non-guitar products and such usage are confusingly similar or identical to the word mark
`
`JET.
`
`49. Alluded to above, the most pervasive use of the word mark Jet is when it is used to denote
`
`the color or finish jet black. Other examples where the color jet black (“Jet Black”) is used
`
`in the music industry are plentiful. For instance, Jet Black Metallic finishes are seen in
`
`guitars such as Epiphone’s Les Paul Muse and Kramer’s NightSwan guitars. See Exhibits
`
`JJ and KK.. See also finishes in Jet Black by:
`
`a. Exhibit LL Supro and its 1575JB Black Holiday Dual Pickup Americana Series
`
`Electric Guitar from 2010s
`
`b. Exhibit MM Collings and its Eastside Jazz LC Jet Black
`
`c. Exhibit NN Eastwood’s Sidejack Pro DLX
`
`d. Exhibit OO G&L’s Tribute Series Doheny
`
`e. Exhibit PP Kramer’s NightSwan Electric Guitar
`
`f. Exhibit QQ Vox’s Bobcat S66B with Bigsby _ Reverb
`
`g. Exhibit RR Rickenbacker’s Limited Edition 90th Anniversary 480XC - Jet Glo
`
`h. Exhibit SS Blackstar Carry-On Travel Guitar - Jet Black
`
`50. In addition to the color Jet Black, Ibanez’s AM Artcore Expressionist 6- String Electric
`
`Guitar uses the word mark Jet for the finish called “Jet Blue Burst.” See Exhibit TT
`
`51. The color Jet Black is not just used with guitars and bases; we see the color Jet Black
`
`frequently used for drums. In fact, Applicant Gretsch has a 1960s “Progressive Jazz” model
`
`

`in Jet Black. A decade later, the 1970’s Gretsch Name Band Outfit is shown in Original Jet
`
`Black Nitron. See Exhibits UU and VV.
`
`52. Other makers of drums sold in Jet Black include a ‘70s Tama Imperial Star Jet Black Drum
`
`Set, the Pearl Drum Set EXX Export Fusion Jet Black, a 1982 Yamaha 5000 Stage Series
`
`BD-522GA Bass Drum 1982. See Exhibits WW, XX and YY.
`
`53. Whether presented as “Jet Black” or “jet blue” the immediate association of color with the
`
`word Jet is easy and frequently made.
`
`54. The third-party adoption and utilization of the word mark JET over the last sixty (60) years
`
`has been widespread, substantial and significant.
`
`55. Through the extensive usage of the word mark JET by many musical instrument
`
`manufacturers over the last sixty (60) years, the word mark JET cannot serve as a source
`
`identifier for Applicant.
`
`56. Musical instrument consumers do not view the word mark JET as an indicator of source for
`
`Applicant.
`
`57. Instead, musical instrument consumers view the marketing materials as well as any logos,
`
`word marks indicating on instruments, or other distinctive trade dress on products
`
`containing the word mark JET to determine the source of the goods.
`
`58. In the alternative, even if the word mark JET did not become generic, the Application for
`
`registration under §2(f) must be denied because musical instrument purchasers are
`
`confronted with numerous independent users of JET that are confusingly similar or
`
`identical to the word mark JET. Accordingly, Applicant cannot have acquired
`
`distinctiveness in the word mark JET.
`

`59. If the Application is granted and Applicant is granted an exclusive right to use the word
`
`mark JET, the Opposer and untold third-party manufacturers will have to discontinue all of
`
`its marketing, advertising, and sales of musical instrument products containing “JET”
`
`which are similar or identical to Applicant’s word mark JET and will suffer business injury
`
`therefrom.
`
`60. If the Application is granted, the trademark rights granted to Applicant will have a chilling
`
`effect on the manufacture and sellers of guitars using “JET” that have been widely used in
`
`the musical instrument marketplace for over sixty (60) years.
`
`
`

`
`
`WHEREFORE, Opposer prays that the Trademark Application Serial No. 97638982 be refused
`
`and not be allowed to mature to registration. The opposition fee is submitted herewith.

`Scott L. Myfirst guitar was a '63 Guild Polara | got in 1965 (which|still have) so this is quite similar in feel. They both have the
`Hagstrom bridge and Tremar andessentially the same Guild made single coils. However the single PU on the Jetstar
`
`whichis placed in the middle position is magical--a variety of tones can still be had depending wherethe guitar is
`
`picked. Even though the asymmetrical head stocksof the earlier '60s solid body Guilds are myfavorite,| believe these
`
`last year '67 S-50s with the flame maple headstock veneers look great. Great guitar for surf instrumentals!

`This is, by far, one of the best playing, best
`sounding, and coolest looking bassesI've
`ever owned.
`
`Guild really nailed it with this.
`According to the serial number,it's a 1966
`Jet Star Bass.
`
`These were not exactly common even when
`they werein production. And its rare to find
`them in such good shape AND all original like
`this one --- right down to the small black
`rubber stopper on the lowerright bottom of
`the body that also appeared on the guitars
`(they had the infamous "kickstand" and the
`stopperallowed you to set it on the ground
`without the guitar body getting potentially
`scuffed; Guild used the same body for the
`guitars and basses.)
`Great sounding single-coil pickup that's
`surprisingly loud and powerful. Great scale
`length. Neckis straight as can be. Action is
`perfect.
`Has the original "Hagstrom" bridge and
`tuners (a lot of people changeoutboth).
`There is wear and tear --- as one would
`expect from and almost 50 year old bass ---
`but its pretty minimal. | am hesitant to use
`the word "Excellent" as | am sure therewill
`
`be someone to refute that, but | will
`confidently say its in vey VERY good shape.
`Look at the pictures and seefor yourself
`No case. | will pack it well and insure it for
`the full amount.
`Don't sleep on this one.
`| will ship internationally, but realize the
`shipping cost quoted is for DOMESTIC
`orders only. So you will need to contact me
`before you payto get an accuratetotal.

`decided it was time that today's players be allowed to get their hands on this one-of-a-kind instrument. This reissue remainsfaithful to thefirst line of
`Jetstars with a solid mahogany body and set neck. A shallow C-shaped mahogany neck and pau ferro fingerboard with no-frills pearloid fret markers
`also provide vintage looks and vibe as well as incredible playability. This reissued Jetstar has a longer 25.5” scale length than the original, which
`translates to a faster feel and improved responsein your hands. Guild LB-1 Little Bucker pickups kick out a diverse array of tones, from spanky,single-
