`Welly Health PBC, a corporation organized and existing under the laws of Delaware,

`having a place of business at 8733 Livingston Lane, Eden Prairie, Minnesota 55347 (“Opposer”),
`
`believes it will be damaged by the issuance of a registration to Parmtrade FZCO (“Applicant”) for
`
`the mark WELLNEE (the “WELLNEE Mark”) shown in Application Serial No. 97/598,498 (the
`
`“Application”), and hereby opposes registration on the basis of a likelihood of confusion under
`
`Section 2(d) of the Lanham Act, 15 U.S.C. § 1052(d). In support of this Opposition, Opposer
`
`alleges as follows:

`Opposer’s WELLY Mark
`

`Opposer is a leading health and wellness company and the owner of the premium
`
`first aid brand WELLY, which has been in continuous use in U.S. commerce since at least 2019.
`
`Opposer’s WELLY products include first aid products, such as a variety of bandages and first aid
`
`kits, skin care products, such as ointments, body lotions and creams, and patches for the skin.

`Products sold under the WELLY mark are widely available for purchase throughout
`
`the United States in thousands of retail locations, including Walgreens, CVS, Target, Rite Aid
`
`Walmart and on Opposer’s website, accessible at http://www.getwelly.com.
`

`Opposer has made, and continues to make, substantial investments in the promotion
`
`of its first aid and personal care goods under its WELLY mark.
`
`4.
`
`As a result of the widespread use, continuous sales, and extensive advertising and
`
`promotion of the goods under the WELLY mark for almost 5 years, consumers have come to know
`
`and trust Opposer’s WELLY brand as the source of high-quality, safe, and effective first aid and
`
`personal care products. The WELLY mark has come to identify Opposer’s goods exclusively and
`
`uniquely, and enjoys enormous goodwill. Opposer has thus established strong common law rights
`
`in the WELLY mark that entitles it to exclusive use of and exclusive rights in the WELLY mark
`
`for first aid and personal products and related goods.
`

`In addition to its strong common law rights in the WELLY mark, Opposer owns
`
`the following U.S. trademark registrations, which are legally and validly registered on the Principal

`Attached as Exhibit A are true and correct copies of the current status and title

`reports from the USPTO’s Trademark Status and Document Retrieval (“TSDR”) system for the
`
`above-listed registrations. Opposer’s registrations and common law rights in and to the WELLY
`
`mark are hereinafter referred to collectively as the “WELLY Mark.”
`
`Applicant’s WELLNEE Application
`

`On September 20, 2022, Applicant filed the Application based on actual use of the
`
`mark WELLNEE in connection with “Transdermal patches featuring wormwood herbal
`
`compounds for pain relief” in Class 5.
`
`8.
`
`The Application was assigned Serial No. 97/598,498 and published in the Official
`
`Gazette on August 8, 2023. Attached as Exhibit B is a true and correct copy of the TSDR status
`
`report for the Application.
`
`9.
`
`Long before Applicant’s filing of the Application, and long before any date of first
`
`use that Applicant may claim, Opposer adopted, first used, and registered the WELLY Mark in
`
`connection with its various first aid and other personal care goods in Class 5. Under 15 U.S.C. §
`
`1072, Applicant had constructive notice of Opposer’s federally-registered rights in the WELLY
`
`
`

`Mark since at least as early as June 25, 2019. Opposer has continuously used and has not
`
`abandoned its WELLY Mark.
`
`10.
`
`The goods for which Applicant seeks registration of the WELLNEE Mark are
`
`identical or closely related to the goods for which Opposer uses its WELLY Mark and owns prior
`
`registrations.
`
`11.
`
`Applicant’s Application to register the WELLNEE Mark in connection with goods
`
`in Class 5 is without the consent or permission of Opposer.
`
`PRIORITY AND LIKELIHOOD OF CONFUSION – 15 U.S.C. § 1052(d)
`
`12.
`
`Opposer repeats and realleges the allegations contained in the preceding paragraphs
`
`as if fully set forth herein.
`
`13.
`
`The filing date of the Application is significantly later than Opposer’s first use of
`
`its WELLY Mark and significantly after Opposer acquired rights in, and federal registrations for,
`
`the WELLY Mark. As such, Opposer’s rights in the WELLY Mark are prior and superior to any
`
`rights Applicant may claim in the WELLNEE Mark.
`

`Applicant’s WELLNEE Mark is virtually identical to Opposer’s WELLY Mark in
`
`appearance, sound, connotation, and commercial impression, because it contains the same first
`
`four letters (WELL) and because the second portions of the mark (-NEE vs. -Y) are virtually
`
`phonetically and aurally identical. As a result, the registration and use of the WELLNEE Mark by
`
`Applicant in connection with the Class 5 goods identified in the Application is likely to cause
`
`confusion, mistake, or deception that Applicant’s goods are those of Opposer or are otherwise
`
`endorsed, sponsored, or approved by Opposer, or cause confusion, mistake, or deception as to the
`
`affiliation, connection, or association between Applicant and Opposer.

`Applicant’s adoption, use and/or registration of the WELLNEE Mark in connection
`
`with the goods identified in the Application interferes with Opposer’s use of the WELLY Mark,
`
`and use or registration of the WELLNEE Mark would seriously damage Opposer.
`
`16. Moreover, if Applicant is granted registration for the WELLNEE Mark, then
`
`Applicant would obtain a prima facie exclusive right to use the mark, and such registration would
`
`be the source of irreparable damage and injury to Opposer. Opposer therefore has a real interest in
`
`this proceeding and a reasonable basis for its belief of damage.
`
`17.

`Accordingly, Applicant’s Application to register the mark WELLNEE should be
`
`refused registration under Section 2(d) of the Lanham Act, 15 U.S.C. § 1052(d).
`
`
`
`WHEREFORE, Opposer respectfully requests that this Opposition be sustained and that
`
`registration of the WELLNEE Mark as applied for in the Application be refused in its entirety.
