`shown in Application Serial No. 97291311 in Class 3, iled by WPS Group, LLC dba World Product
`
`Solutions dba Onoxa dba Evora Worldwide, a Delaware limited liability company doing business
`
`at 7935 114th Avenue, Largo, FL 33773 (“Applicant”) on March 2, 2022, and published in the
`
`Trademark Oficial Gazette for opposition on May 23, 2023.
`
`Opposer opposes Application Serial No. 97291311. The grounds for this opposition are as
`
`follows:

`Opposer is a manufacturer, supplier and marketer of herbal extracts,
`
`nutraceuticals, cosmeceuticals, minerals, dietary supplements and specialty ine chemicals for
`
`the nutritional, cosmetic, pharmaceutical and food industries.

`Since being founded in 1988, Opposer has brought to market more than 100
`
`standardized botanical extracts and privately funded several clinical studies in conjunction with
`
`prestigious institutions in support of these products.

`With about 100 full time scientists conducting ongoing research in India and the

`United States, Opposer continues to develop and patent phytonutrients for the world market.

`nutraceuticals, cosmeceuticals, minerals, dietary supplements and specialty ine chemicals.

` One of Opposer’s leading and most well-known products is its proprietary

`phytoextract, Curcumin C3 Complex®, made from (cid:318)urcuma longa (commonly known as

`turmeric).

`Opposer and its afiliates have taken extensive measures to protect its intellectual

`property in Curcumin C3 Complex, including multiple trademark registrations for “C3 Complex”

`and “Curcumin C3 Complex” in the U.S. and throughout the world:

`and promote its goods under Opposer’s “C3 Complex” and “Curcumin C3 Complex” marks,

`including but not limited to sponsoring peer-reviewed scientiic research as well as publishing a

`website, https://curcuminoids.com/, a promotional video, “Curcumin C3 Complex®: The Whole
`
`Picture and the Whole Truth,” https://vimeo.com/436336951, a book, “Curry Powder to Clinical
`
`Signiicance,” https://www.amazon.com/Powder-Clinical-Signiicance-Muhammed-Majeed

`Opposer routinely licenses its “C3 Complex” and “Curcumin C3 Complex” marks

`to third parties, requiring use of the circle-R symbol and an attribution statement on the product

`long history of use” of turmeric in cosmetics, see Kim, L. & Lio, P., “Turmeric, Curcumin, and
`
`Curcuminoids: A Dermatologic Review,” (cid:331)ractical (cid:319)ermatology (Oct. 2020)2 (Exhibit 6), use of
`
`Opposer’s “C3 Complex” and “Curcumin C3 Complex” marks in connection with cosmetics and
`
`similar products in U.S. commerce is a natural extension of Opposer’s current use.

`Notwithstanding Opposer’s rights in and to its “C3 Complex” and “Curcumin C3
`
`Complex” marks since 1994, on March 2, 2022 Applicant iled an application to register the
`
`“CitraC3 Complex” mark for “Beauty care cosmetics; Cosmetic creams for skin care; Non-
`
`medicated skin care preparations” in Class 3. Said application was made on an intent-to-use
`
`basis, see 15 U.S.C. § 1051(b), and was assigned Serial No. 97291311 and published for opposition
`
`in the Oficial Gazette on May 23, 2023.

`Applicant’s “CitraC3 Complex” mark so resembles Opposer’s “C3 Complex” and
`
`“Curcumin C3 Complex” marks that it is likely to cause confusion or mistake of customers and
`
`end users and/or to deceive customers and end users as to the origin and sponsorship of
`
`Applicant’s goods, misleading customers and end users into believing that such goods emanate
`
`from, are licensed by, or are in some way directly or indirectly associated with, approved by
`
`and/or are sponsored by Opposer.
`

`Applicant’s “CitraC3 Complex” mark so resembles Opposer’s “C3 Complex” and
`
`“Curcumin C3 Complex” marks that it is likely to cause confusion or mistake of customers and
`
`end users and/or to deceive customers and end users as to the formulation of Applicant’s goods,

`misleading customers and end users into believing that such goods contain and/or are
`

`Applicant’s “CitraC3 Complex” mark so resembles Opposer’s “C3 Complex” and

`“Curcumin C3 Complex” marks that it will dilute the distinctiveness of Opposer’s famous marks
`
`within the meaning of the provisions of the Federal Trademark Act of 1995, as amended by the
`
`Trademark Revision Act of 2006.
`
`20.
`
`Opposer will be irreparably damaged by the registration of Applicant’s mark.
`
`21.
`
`Pursuant to 15 U.S.C. § 1052(d), Applicant is not entitled to register its mark.

`WHEREFORE, Opposer requests that the Trademark Trial and Appeal Board grant this

`Opposition and deny registration of the subject application, namely, U.S. Trademark Serial No.
