`Welly Health PBC, a Delaware corporation, having a principal place of business at 8733

`Livingston Lane, Eden Prairie, Minnesota 55347 (hereinafter, “Opposer”), believes it will be
`
`damaged by the registration of the trademark WELLY’S WELLNESS shown in Application Serial
`
`No. 90/580,139 (the “Application”). Opposer timely files this Notice of Opposition. As grounds
`
`for the opposition, Opposer alleges as follows:
`

`
`On information and belief, Ashley Girad, Inc. is a California corporation with a
`
`principal address of 1707 Pacific Coast Highway, Ste 312, Hermosa Beach, California 90254
`
`(hereinafter, “Applicant”).
`
`2.
`
`Opposer provides personal care products throughout the world, including in the
`
`United States.
`
`3.
`
`Opposer is the owner and registrant of the mark WELLY and related design marks
`
`covered by United States registrations, which are valid registrations in full force and effect.
`
`The details of these registrations are shown in the chart below and copies of the registration
`
`certificates/notices of allowance, as applicable, along with the TSDR records as of August 8,
`
`2022, are attached hereto as Exhibit A:

`WELLY marks are similar in sight, sound, and overall commercial impression, particularly in
`
`light of the fact that Opposer’s mark is contained within Applicant’s Mark.

`
`The class 35 services covered by Applicant’s Mark are related to the goods covered
`
`by Opposer’s registrations and applications referenced above.
`
`8.
`
`The classes of purchasers are the same with respect to Opposer’s goods and
`
`Applicant’s services.

`Applicant’s services offered in connection with the WELLY’S WELLNESS mark
`
`travel in the same trade channels as the goods offered under Opposer’s WELLY marks.
`
`10. When used in connection with the services listed in the Application, Applicant’s
`
`Mark is likely to cause confusion, or cause mistake, or to deceive, within the meaning of
`
`Section 2(d) of the Lanham Act, 15 U.S.C. §1052(d).
`
`11.

`The relevant consuming public is likely to mistakenly believe that Applicant’s
`
`services originate from, are sponsored or authorized by, or are otherwise connected to
`
`Opposer’s goods.
`
`12.
`
`Applicant filed the Application on March 15, 2021, on an intent-to-use basis.
`
`13.
`
`Opposer’s WELLY marks are senior to Applicant’s Mark.
`
`14.
`
`Based upon the foregoing, registration of Applicant’s Mark is likely to cause injury
`
`and damage to the Opposer.
`
`WHEREFORE, Opposer respectfully requests that registration of the mark WELLY’S
`
`WELLNESS as shown by Application Serial No. 90/580,139 be denied under Section 2(d) of the
`
`Lanham Act, 15 U.S.C. §152(d), and that this Opposition be sustained.
