`Applicant, The Boogie Badge, Inc., by counsel, provides the following response to the
`
`Trademark Trial and Appeal Board’s (“TTAB”) order dated September 26, 2023. The TTAB’s
`
`order suspended the proceedings and allowed Applicant twenty (20) days from the date of the
`
`order to submit a substitute drawing page for the amended mark. Thus, this response is timely
`
`filed.

`Applicant and Opposer jointly filed a consented motion to amend the application in this
`
`Opposition proceeding and, contingent thereupon, dismiss the Opposition proceeding on August
`
`21, 2023. In response, the TTAB issued the September 26, 2023, order.
`
`
`
`The TTAB’s order states that because Applicant seeks to amend the mark as it appears on
`
`the drawing page submitted with the application, a separate, substitute drawing page showing the
`
`revised depiction of the mark must be submitted. See Trademark Rules 2.51, 2.53 and 2.544; see
`
`also TRADEMARK MANUAL OF EXAMINING PROCEDURE (TMEP) § 807.15 (2023).
`
`Additionally, the TTAB’s order stated that: “although the Board finds that the proposed change
`
`to the mark does not constitute a material alteration, the amendment to the mark cannot be
`
`approved and entered without the referenced substitute drawing. Once a substitute drawing page
`
`is submitted, the Board will be able to consider and enter the proposed amendment to the mark.”
`
`(Emphasis Added).

`
`Thus, Applicant is submitting with this response a separate substitute drawing page
`
`showing the revised depiction of the mark as required by the TTAB’s order dated September 26,
`
`2023, for consideration by the TTAB.
`
