`shares, having a principal place of business at Abbey Road, Whitley, Coventry CV3 4LF, United

`Kingdom (“Opposer”), believes that it is and will continue to be damaged by registration of the
`
`mark JAAGS in the name of Jaags LLC (“Applicant”) shown in U.S. Trademark Application
`
`Serial No. 90210363, and hereby opposes the same.

`A request for an extension of time to oppose was filed on August 10, 2021 and was
`
`granted, extending the time to file to November 10, 2021.
`
`As grounds for opposition, Opposer alleges that:
`

`Opposer and its predecessors have manufactured and sold vehicles, vehicle parts
`
`and accessories, and a wide variety of related automotive and non-automotive goods and services
`
`worldwide for over 80 years.
`

`
`Since at least as early as 1935, Opposer has owned and used the trademark
`
`JAGUAR in connection with motor vehicles, vehicle parts and accessories, and related
`
`automotive and non-automotive goods and services in the United States and throughout the
`
`world.
`
`3.
`
`Since at least as early as 1985, the general public has come to know and
`
`informally refer to both Opposer and its vehicle-related goods and services, as well as collateral
`
`merchandise, as JAG, and Opposer thus has strong and valuable common law rights in the JAG
`
`trademark.
`
`4.
`
`In the United States, Opposer is the owner of, among others, the following
`
`registrations for JAGUAR covering motor vehicles, vehicle parts and accessories, and related
`
`goods in Class 12: U.S. Trademark Registration Nos. 423961 (registered September 17, 1946);
`
`1562075 (registered October 24, 1989); and 5506095 (registered July 3, 2018). These
`
`registrations are valid and subsisting, uncancelled, and unrevoked, and the 1562075 registration
`
`is incontestable.
`

`In the United States, Opposer is the owner of, among others, the following
`
`registration for JAGUAR covering “hand tool kit consisting of pliers; screwdrivers and wrenches
`
`for promotional use relating to the field of automotive vehicles” in Class 8: U.S. Trademark
`
`

`Registration No. 2451257 (registered May 15, 2001). This registration is valid and subsisting,
`
`uncancelled, and unrevoked, and is incontestable.
`

`In the United States, Opposer is the owner of, among others, the following
`
`registration for JAG: U.S. Trademark Registration No. 5537653, covering motor vehicles,
`
`vehicle parts and accessories in Class 12 and vehicle-related services in Class 37. This
`
`registration is valid and subsisting, uncancelled, and unrevoked.
`

`
`Opposer has expended considerable time, effort, and expense in advertising and
`
`promoting the JAGUAR and JAG Marks and the goods and services associated with them
`
`throughout the United States, with the result that the purchasing public has come to know and
`
`recognize goods and services of Opposer by the JAGUAR and JAG Marks. Opposer has
`
`exceedingly valuable goodwill established in its JAGUAR and JAG Marks.
`
`8.
`
`Applicant is seeking to register JAAGS as a trademark for “windshield repair kits
`
`comprised primarily of hand-operated windshield repair tools in the nature of a specialized
`
`manual tool with a suction cup portion to attach it to the glass and having an injector portion to
`
`hold over the break in the glass, and also including resin, a suction clamp used as a syringe
`
`holder for injection of a chemical compound, vacuum and pressure pump, and syringe” in Class
`
`8. This is evidenced by publication of the mark in the Official Gazette on July 13, 2021.
`
`Applicant filed this application on September 25, 2020 and claims dates of first use of August
`
`12, 2020 and September 8, 2020.
`

`There is no issue as to priority. Opposer used, filed, and/or registered the
`
`JAGUAR and JAG Marks in connection with its goods and services long prior to Applicant’s
`
`September 25, 2020 filing date and the claimed dates of first use.
`

`Upon information and belief, Applicant did not use the JAAGS mark prior to
`
`Opposer’s first use of JAGUAR or JAG.

`Applicant’s JAAGS mark is virtually identical to Opposer’s JAG Mark.

`Applicant’s JAAGS mark is confusingly similar to Opposer’s senior JAGUAR

`Because the purchasing public has come to recognize and associate the goods of
`
`Opposer by the JAGUAR and JAG Marks, Applicant’s proposed JAAGS mark is likely to be
`
`confused with Opposer’s Marks.
`

`Opposer is not connected with the goods sold or intended to be sold by Applicant
`
`under its JAAGS mark.
`
`15.
`
`The fame and reputation of Opposer is such that, if Applicant’s JAAGS mark is
`
`used with Applicant’s designated goods, a connection with Opposer will be presumed.
`
`16.
`
`Applicant’s JAAGS mark in Application No. 90210363 so resembles Opposer’s
`
`JAGUAR and JAG Marks and the goods identified are so closely related to the goods of Opposer
`
`as to be likely, when used in connection with Applicant’s goods, to cause confusion, or to cause
`
`mistake, or to deceive in violation of Section 2(d) of the Lanham Act, 15 USC §1052(d).

`If Applicant were granted the registration herein opposed, it would obtain at least
`
`a prima facie exclusive right to use of the JAAGS mark in connection with the designated goods.
`
`Such registration would be a source of injury and damage to Opposer’s prior and established
`
`rights in its JAGUAR and JAG Marks.
`
`WHEREFORE, Opposer respectfully requests that registration of the JAAGS mark,
`
`Application Serial No. 90210363, be refused and that this opposition be sustained.
