`Joseph J. Norton (“Opposer”) believes that he will be damaged by registration of the mark
`
`
`
`BUGICE, as identified in U.S. Trademark Application Serial No. 90/353,700 (the “Application”)
`
`filed by Gret E-commerce Inc. (“Applicant”), and hereby opposes registration of the Application.
`
`
`
`As grounds for the opposition, Opposer alleges as follows:
`
`A. Opposer and its Prior Rights in the BUG Marks.
`
`1.
`
`Opposer Joseph J. Norton is a citizen of the United States, residing in Brighton,
`
`Michigan.
`
`2.
`
`Opposer has extensively used the trademark BUG, alone and in conjunction with
`
`other terms, such as BUG JUICE, BUG BITE, and BUG PICNIC, to identify and distinguish his
`
`goods in the marketplace (together, the “Opposer’s BUG Marks”).
`
`3.
`
`Opposer is the owner of numerous valid and subsisting trademark registrations on
`
`the Principal Register with the USPTO for the Opposer’s BUG Marks, many of which are
`
`
`
`
`
`
`
`
`
`

`
`incontestable. Noteworthy is Opposer’s longstanding and incontestable registration of its BUG
`
`mark pursuant to U.S. Reg. No. 3,357,163, filed in 2005, with first use in commerce dating back
`
`over fifteen years.
`

`A chart with registration particulars of just some of the Opposer’s BUG Marks is
`
`attached as Exhibit A. True and correct copies of the Trademark Status & Document Retrieval
`
`(TSDR) documents printed from the USPTO website for the BUG Marks identified in Exhibit A
`
`are attached as Exhibit B.
`

`Opposer does business under the name Bug Juice Brands and produces and
`
`distributes health-conscious fruit-flavored beverages and anti-inflammatory itch cream, as well as
`
`clothing, toys, candy, and other products under Opposer’s BUG Marks. Opposer has a bona fide
`
`intent to offer vitamin-enriched snack bars under its BUG JUICE mark, as evidenced by Opposer’s
`
`U.S. Trademark Application Serial No. 90/298,058, filed with the USPTO on November 4, 2020.
`

`
`For over three decades, and long prior to any use by Applicant, Opposer has
`
`marketed and sold fruit-flavored beverages, among other goods, in interstate commerce in the
`
`United States under Opposer’s BUG JUICE house mark.
`
`7.
`
`Opposer has expended considerable
`
`time and expense on
`
`the creation,
`
`development, advertising and promotion, and enforcement of Opposer’s BUG Marks. Through
`
`Opposer’s widespread promotion and use, Opposer’s BUG Marks have become strong and well-
`
`known. As a result, the public has come to know, identify, and recognize a vast array of BUG
`
`products as originating with or authorized by Opposer.
`

`As a result of long-standing and consistent use of Opposer’s BUG Marks, as well
`
`as Opposer’s nationwide promotion of the products offered under Opposer’s BUG Marks, those
`
`marks have become widely known, and are strong and distinctive throughout the United States.

`The goodwill represented by the Opposer’s BUG Marks is a valuable and important asset of
`
`Opposer, and because of this, Opposer exerts strict control over Opposer’s BUG Marks.
`
`B. Applicant and its Confusingly Similar Mark.
`

`
`On information and belief, Applicant is a Colorado corporation with an address of
`
`818 Salmon Pond Way, Colorado Springs, Colorado 80921.
`

`
`On December 2, 2020, notwithstanding Opposer’s prior and senior rights in and to
`
`the Opposer’s BUG Marks, Applicant filed an application for the mark BUGICE in the United
`
`States, which was assigned U.S. Application No. 90/353,700.
`

`
`The application covers various goods in Class 5. However, the relevant goods for
`
`purposes of this opposition proceeding are “Glucose dietary supplements; Nutritional
`
`supplements; Protein dietary supplements; Yeast dietary supplements” in International Class 5 (the
`
`“Opposed Goods”).
`

`The Application was published in the USPTO’s Official Gazette (Trademarks) on
`
`June 22, 2021. This Opposition is timely pursuant to the U.S. Trademark Trial & Appeal Board’s
`
`July 22, 2021 order allowing Opposer until October 20, 2021 to file his Notice of Opposition.
`
`C. Opposer Will Be Harmed If the Application Registers.
`

`
`Applicant’s filing date, December 2, 2020, and Applicant’s first use of Applicant’s
`
`BUGICE mark, August 26, 2020, are each more than three decades after Opposer’s first use of
`
`Opposer’s BUG Marks, specifically, Opposer’s BUG JUICE house mark.
`
`14.
`
`Applicant’s mark is confusingly similar in terms of sight, sound, meaning, and
`
`commercial impression to each of the marks in the family of Opposer’s BUG Marks, including,
`
`but not limited to, Opposer’s BUG JUICE marks, which are nearly identical in sight and meaning
`

`On information and belief, Opposer’s products under the Opposer’s BUG Marks
`
`are marketed to and provided through the same channels of trade as Applicant’s Opposed Goods.
`
`Opposer markets and advertises health-conscious products under Opposer’s BUG Marks,
`
`including Opposer’s VITA BUG mark, for which Opposer filed a federal trademark application
`
`on April 20, 2020 (U.S. Serial No. 88/878,839). The Opposed Goods for which Applicant seeks
`
`registration of its Application, namely dietary and nutritional supplements, are often used in
`
`connection with or infused into those same products by the same class of consumers.
`

`Applicant’s applied-for mark BUGICE is confusingly similar to Opposer’s prior-
`
`used and registered BUG Marks, and therefore, if Applicant’s mark is allowed to register in
`
`connection with the Opposed Goods covered by the Application, it would likely cause confusion
`
`and mistake among consumers concerning the origin, source, ownership, or sponsorship of
`
`Applicant’s goods in violation of 15 U.S.C. § 1052(d).

`Further, deficiencies or faults in the quality of Applicant’s Opposed Goods covered
`
`by the Application are likely to reflect negatively upon and seriously injure the reputation which
`
`Opposer has established for its products and marketed under Opposer’s BUG Marks. This
`
`confusion is likely to result in loss of revenues to Opposer and damage to its reputation.
`

`For these reasons, registration of the Opposed Goods listed in the Application is
`
`contrary to the provisions of Section 2 and 43 of the Lanham Act, 15 U.S.C. § 1052, and Opposer
`
`would be damaged thereby.
`

`In order to protect the public against confusion and deceit, and to protect Opposer’s
`
`BUG Marks from infringement and unfair competition, registration of the Opposed Goods in
`
`Applicant’s BUGICE Application should be refused under Sections 2(d), 43 and 13 of the Lanham
`
`Act, 15 U.S.C. §§ 1052(d) and 1063.

`Opposer does not believe that consumer confusion is likely to result from

`Applicant’s use of the BUGICE mark in connection with the remaining, unopposed goods listed
`
`in the Application, namely: “Acaracides; Analgesics; Antimicrobial hand-sanitizing preparations;
`
`Cod liver oil; Contact lens cleaning preparations; Cotton for medical purposes; Diapers for pets;
`
`Dietary fiber for treating constipation; Disinfectant liquid soap; Dried Chinese boxthorn fruits for
`
`Chinese medicinal use; Medicated hair lotions; Medicinal alcohol; Menstruation tampons; Pearl
`
`powder for medical purposes.”
`
`WHEREFORE, Opposer respectfully requests that the Opposed Goods in Application
`
`Serial No. 90/353,700 be deleted from the Application, that no registration be issued to Applicant
`
`for the BUGICE mark in connection with the Opposed Goods, that this Opposition be sustained in
`
`favor of Opposer and that the Trademark Trial and Appeal Board grant such other and further relief
`
`as it deems just and appropriate.
`
`The requisite filing fee prescribed by 37 C.F.R. § 2.6(a)(17) should be charged to Deposit
`
`Account No. 502876. If there are any additional fees due in connection with this Notice of
`
`Opposition, they should also be charged to Deposit Account No. 502876, and any excess fees
`
`should be credited to the same.
`
